HomeMy WebLinkAboutCC RES 80-104 RESOLUTION NO. 80-104 A Resolution of the City Council of the City of Tustin, AGREEING TO ACCEPT THE EXCHANGE OF PROPERTY TAX REVENUES IN CONJUNCTION WITH THE ANNEXATION OF ISLAND AREAS. WHEREAS, the City of Tustin has proposed the annexation of fully developed island areas to the City pursuant to the authority of Section 35013 of the Municipal Organization Act of 1977;. and WHEREAS, the authority for island annexations expires on December 31, 1980; and .. WHEREAS, Section 99(b) of the California Revenue and Taxation Code requires the City of Tustin and the County of Orange to negotiate and adopt a resolution agreeing to the exchange of proper~y tax revenues for a change of jurisdiction within thirty (30) days from the receipt of the report from the auditor as to the amOunt and allocation factors with respect to the subject territory; and WHEREAS, the Board of Supervisors on September 2, 1980 adopted a policy for the distribution of property tax revenues for fully developed areas that are annexed to a City; and WHEREAS, the adoption of a resolution by the County of Orange for the distribution of property tax revenues relative to all cities in Orange County is awaiting formal agreement between the cities and county which may delay acceptance prior to the expiration of the authority of Section 35150(f) of the Municipal Organization Act of 1977 for island annexations; NOW, Tkq~REFORE, BE IT RESOLVED, that the City Council accepts the formula as contained wi'thin paragraph 4 of the proposed agreement for the distribution of property taxes within fully developed annexation area numbers 107, 109, 111, and 123 to the City of Tustin whereby property taxes are divided in accordance with the historical division of property taxes within .., the City of Tustin as determined by the County Auditor. A certified copy of this Resolution shall be furnished by the City Clerk with the Clerk of the Board of Supervisors, the Auditor-Controller of Orange County, and the Local Agency Formation Commission.
