RESOLUTION NO. 80-103
·
A RESOLUTION OF THE CITY COUNCl L OF THE CITY OF
TUSTIN, AGREEING TO ACCEPT THE EXCHANGE OF PROPERTY
TAX REVENUES IN CONJUNCTION WITH THE MITCHELL-RED
HILL-SYCAMORE ANNEXATION NO. 109 (REVISED) TO THE
CITY OF TUSTIN.
WHEREAS, the City of Tusfin has filed an application with the Local Agency
Formation Comrnission for the annexation of the territory known as the Mitchell-
Red 'Hill-Sycamore Annexation No. 109 (Revised) to the city of Tusfin pur-
suant fo Sections 35013 and 35150(f) of the Municipal Organization Act of
1977 for island annexations, and ..
WHEREAS, the County Audi for has fi led a report dated September 30, 1980
showing the ratio and amount o¢ property fax revenues subject fo negof i-
a f i on, and
WHEREAS, Section 99(b) o¢ the California Revenue and Taxation Code requires'
the City of Tusfin and the County of Orange fo negotiate and adopt a resolution
agreeing fo the exchangeo¢ property fax revenues For a change of jurisdiction
within thirty (30) days from the receipt of the report From the auditor as
fo the amount and allocation factors wi th respect fo the subject territory,
and
WHEREAS the Board of Supervisors on September 2, 1980 adopted a policy for the
distribution of property fax revenues for fully developed areas ,hat are
annexed fo a city, and
WHEREAS, the adoption of a resolution by the County of Orange for the distri-
bution of property fax revenues relative to all cities in Orange County is
awaiting formal agreement between the cities and county which may delay
acceptance prior fo the expiration of the authority
the Mun|cipal Organization Act of 1977 for island annexafions~

NCJ¢I THEREFORE' BE IT RESOLVED, that the City Council accep,s ,he formula as
contained within paragraph 4 of the proposed agreement for the distribution
cf property faxes within fully developed .annexation area No. 109 fo the
city of Tusfin whereby property faxes are divided in accordance wi th the
historical division of property faxes within the city of Tustin as determined
by the County Audi for.
A certified copy of this resolution shall be furnished by the City Clerk
with the Clerk of the Board of Supervisors, the Auditor-Controller of Orange
County, and the Local Agency Formation Commission.
PASSED AND' ADOPTED afa regular meeting of the City Council held on the
6th day of October 1980.
