WHEREAS, the City Council o¢ Tusfin on behalf o¢ residents with a certain inhabited are. a constituting an 84-acre unincorporated County island lo- cated east of: Newport Avenue; west of: Red Hill Avenue; south of Mitchell Avenue; north and south Of: Walnut Aven'ue; north and south of: Sycamore Avenue in the south Tusfin area consents.to the annexation of said prop- erfies info the city; and WHEREAS, the proposed annexaf'ion':..was determined to be categorically exempt f:rom the requirements ot: the Calit:ornia Environmental Qualify Act for environmental impact review by notice f:iled on January 4, 1978; and WHEREAS, the City of Tustin is willing fo extend the full range of muni- cipal services fo the properties within said unincorporated island; and · WHEREAS, the Local Agency Formation Commisson on February 22,1978, found that the proposed annexation was within Tusfin's Sphere of Influence and met all 0¢ the criteria required by Section 35150(f:) of the ~unicipal Organization Act; WHEREAS, the Board of: Supervisors denied the proposed annexation in 1978 due to the protests of residents fo the additional faxes that would re- suit from annexation fo the city of Tustin; and WHEREAS, Proposition 13 has eliminated the basis of protest by establish- ing maximum tax rates irrespective ot:poli.t~.¢al.jurisdiction; ~ . NOW, THEREFORE, BE IT RESOLVED by f'he City Council, City of: Tustin' ii That the City of Tusfin requests the recommencemenf of: annexation proceedings in connection wi th said inhabited territory in accord- ance with the ~unicipal Organization Act of: 1977 governing unin- corporated islands. 2~ That said unincorporated territory be, and hereby is, designated as the "Sycamore-Walnut-Mitchell Annexation No. 109 (Revised) to the city of Tusfin and is shown on Exhibit "A" attached, hereto and in- corporated herein by this reference, and as legally described in Exhibit "B" attached hereto and incorporated herein by this ref:ef- ence. m i That the proposed annexation is made pursuant to Sections 35013 and 35150(f) of: the /~unicipal Organization Act of :[977, · That the subject area is a totally developed urbanized area of_ + 84 acres consisf|ng' of apartments, condominiums, single f:amily and ¢ourplex units. The area is totally surrounded by the incorporated limits of the city of Tustin. m That the jusfi, ficafion f:or the proposed change of organization is fo provide full mUnicipal services fo an urbanized County island area fhaf is remote from County service facilities and thereby increase the economy and efficiency o¢ urban services. 6~ That the Local Agency Formation Commission is hereby petitioned fo determine pursuant to Section 35150(f:) of the Municipal Organization Act ot: 1977 that the proposed area' a.
