HomeMy WebLinkAboutCC RES 80-0831 2 3 4 5 6 7 8 9 10 11 12 13 14 15 15 17 18 19 20 21 22 23 24 25 26 27 28 29 F 30 31 32 RESOLUTION NO. 80-83 A Resolution of the City Council of the City of Tustin, PROPOSING AN AGREEMENT WITH THE COUNTY OF ORANGE REGARDING A DISTRIBUTION OF PROPERTY TAX REVENUES . ON ANNEXED LAND WHEREAS, the City of Tustin has annexed various parcels of land within its Sphere of Influence since January 1, 1979 in order to improve the efficiency of local government services; and WHEREAS, such jurisdictional changes require negotiations and agreements pursuant to Assembly Bill 8, Chapter 282, 1979 in order to determine the manner by which the City will share in the allocation of property taxes within the area affected; and WHEREAS, representatives of the County and cities within the County have been meeting for almost twelve months to develop a formula for the allocation of property taxes, and have apparently reached a tentative agreement; and WHEREAS, the Legislature has adopted and the Governor has signed into law the provisions of Senate Bill 180 which, among other provisions, extends the parties of such agreements to include special districts which are required to extend service to the annexed area but are presently receiving no share of the basic tax levy; and WHEREAS, the City of Tustin is desirous of resolving its incomplete annexations awaiting the property tax allocation; and WHEREAS, -the areas annexed by the City of. Tustin appear to have no special districts involved which meet the criteria of Senate Bill 180, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin does hereby propose and offer to agree to the following distribution of property tax with the County of Orange: 1. The developed, residential annexations listed below have the present property tax base and future increment of the County Structural Fire Fund and County of Orange, within the annexed area, combined and divided between the City and County in the ratio to which the City and County receive property tax revenues within the balance of the City of Tustin: a. Tract 10258 Annexation No. 114 b. Warren -Newport Annexation No. 115 c: Green Valley -Red Hill Annexation No. 116 d. Newport -Sycamore Annexation No. 118* e. Prospect -17th Street Annexation No. 119* f. "B" Street -McFadden Annexation No.'120 g. Main Street -Freeway Annexation No. 97 h. San Juan --Green Valley Annexation No. 110 (Revised) * Note: Annexations 118 and 119 are now used as 'an office and savings and loan respectively. 2. The undeveloped annexation listed below have the present property tax base and increment of the County Structural Fire Fund allocated to the City, the present property tax base of the County of Orange remain allocated to the County, and the increment of the property tax base of the County be allocated to the City until such time as the total received by each agency is in the ratio to which the City and County receive property tax revenues within the balances of the City of Tustin. Thereafter, each agency shall receive the same ratio outlined above on the combined revenues from the former County Structural Fire Fund and County of Orange entitlements. a. At such time as a special district becomes qualified under the terms of Senate Bill 180, the City of Tustin agrees to participate with the County and Special. District to negotiate a revised allocation formula which will. provide the special district with its reasonable share of the resulting property tax revenue from the areas being annexed. AND, BE IT FURTHER RESOLVED, the Mayor and City Administrator are hereby authorized to negotiate the details of the above proposal. with the appropriate representatives of the County of Orange.
