A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS TO IMPROVE HEATING, AIR CON-
DITIONING AND VENTILATION SYSTEMS, POLICE
AND CITY ADMINISTRATIVE BUILDINGS, AND DIRECT-
ING THE CITY CLERK TO RE-ADVERTISE FOR BIDS.
WHEREAS, if is the intention of the City Council of the City of Tustin,
California, to improve heating, air conditioning.and ventilation systems,
Police and City Administrative buildings;
WHEREAS, the Building Official has presented plans and specifications
for the construction of said work;
NOW, THEREFORE, BE IT RESOLVED THAT the plans and specifications pre-
sented by the Building Official be and are hereby approved as the plans
and specifications fo improve heating, air conditioning and ventilation
systems, .Poi ice and Ci f.y Admi ni'strafive bui I di ngs.
BE IT. FURTHER RESOLVED THAT the City Clerk is hereby aufhor, ized and
directed to reject all bids received June'4, 1980 for this project,
Resolution No. 80-58, and to re-advertise as required by :aw for the
receipt of sealed bids or proposals for the doing ot: the work specified
in the aforesaid plans and specifications which said advertisement shall
be substantially in the following words and figures, fo wit'
"NOTICE TO CONTRACTORS"
SEALED PROPOSALS will be received at the office of the City Clerk,
Tusfin, City Hall, ]500 Centennial Way, Tusfin, California, until !1. a,~.
on the 3~rd day of July, 1980, at which time they will be publicly opened
and read, for performing work as follows'
To improve heating, air conditioning and ventilation systems,
Police and City Administrative buildings.
Bids are required for the entire work described herein'

The work is fo be performed wi th the Police buildin9 havin9 preference
over the City Administrative building. The contractor shall commence
work on each HVAC system only when he has all materials and equipment af
hand. Once work commences on a system, work shall be continuous until
work on that system is complete. Each system shall be placed in oper-
ation for fesfin9, balancing, adjusting, and f. ine funin9 upon completion
of work on fhaf system.
Plans, specifications and proposal forms to be used for' biddi'ng on this
project can only be obtained by prospective bidders af the office of the
City Clerk, Tusfin City Hal lt 300 Centennial Way, Tusfin, California, 92680,
upon payment o~: $2.50 per set, which amount shall be non-refundable.

Plans .and specifications will only be mai led out upon pa~,menf of $5 per
set, which amount shall be non-refundable.
In conformance with Section 37951 o¢ the Government Code, all bi ds shall
be presented under sealed cover on the proposal form provided and ac-
companied by one o¢ the following forms of: bidder's security-

Cash
Cashier's check made payable fo the City of: TuSfin
Certified check made payable fo the City of Tustin
Bidder's bond executed by a'n accredited surety insurer, made
payable fo the City o¢ Tusfin
The security shall be in an amount equal fo af least fen. percent (10%)
o¢ ~he amount of: the bid. A bid shall not be considered unless one ot:
the l:orms o¢ bidder's security is enclosed therewith.
A Surety Bond l:or payment ol: labor and materials will be required in the
amount of: l:il:fy percent (50%) of: the estimated fotat contract price and
a Faifhl:ul Per l: ormance Bond in the amount o¢ one hundred percent I100%.)

documents. Said bonds shall be issued by a Surety Company rated Grade
or better and Class IX or better by the latest edition of Besf's Key
Rating Gui de,
City of: Tusfin reserves the right fo reject any or all bids, and/or
waive any int:ormalify on a bid. No bidder may withdraw his bid for a
period ol: thirty (30) days after the date set for the opening fhereo.¢:

The contract will be awarded fo the lowest qualified bidder.
Provisions of: the State Contract Act are not 'applicable, and prospective
bidders will not be required to be prequalified.
All work fo be done under the direct supervision o¢ the City Engineer,
City of: Tusfin.
Ail work to be paid for at the unit prices bid from appropriated monies.
Said City of Tusfin, pursuant to the Labor Code of the State of Calil:orni
has ascertained and determined that the general prevailing rate of hourly
and per diem wages in the locality in which the said work herein described
is to be performed, l:or each craft or type of workman or mechanic needed
to execute the contract and also the general prevailing rate for legal
holidays, and overtime work l:or each craft or type of workman or mechanic,
fo be as indicated in Resolution 77-52 as previously published in a news--
paper of general circulation, and on file in the office, of: the City Clerk.
Employer payments other than those itemized therein, as del:ined in
Section 1773.1 of: the Labor Code, are fo be paid in accordance with' the
terms oF the collective bargaining agreement applicable fo the type or
ctass.[l:ication of: the workmen or mechanics employed on the pro,~ecf.
Copies of: all collective bargaining agreements relating fo the work as
set l:orth in the al:orementioned Labor Code are on file and available for'
inspection in the office of the Department of Industrial Relations,
Division of Labor Statistics and Research.

BE IT ALSO RESOLVED THAT the City Council of the City Of Tusfin has
ascertained and does hereby determine 'that the general prevailing rate
of wages and employee payments' in the locality of the City o¢ Tustin,
California, for each craft or type of workman needed fo execute the work
herein above specified is as set forth in Resolution No. 77-52.
