RESOLUTION NO. 80-48
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTINv CALIFORNIA, AMENDING
SECTION 10F OF THE CITY OF TUSTIN
PERSONNEL RULES AND REGULATIONS PERTAIN-
ING TO DISABILITY RETIREMENT.
The City Council of the City of Tustin, California,
does resolve as follows:
Section 10F of the City of Tustin Personnel Rules
and Regulations is amended to read as follows::
"Disability Retirement. In case of .an
employee other than a police department local
safety member, his disability status and entitle-
ment to retirement shall be established by the
Public Employees' Retirement System. For a
police department employee who qualifies as a local
safety member~ the determinations as to whether
that employee. is (1) disabled, and (2) whether
such disability was industrially caused, shall
be made by the Retirement Review Board Consisting
· .
of the City Administrator, the Finance Director,
and a third department head as may be designated
from time to time by the City Administrator. The
City Attorney shall act as legal advisor to the
Board. The Personnel Director or his designee shall
present evidence to the Retirement Review Board con- '.. .,~'..~...
cerning the disability of the employee. Determinations '...::?:
of the Retirement Review Board shall be submitted to
the City Council for adoption and certification to
the Public Employees' Retirement System Board. Once
adopted by the City Council, all decisions shall be
final. "
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California, held on the 19th
