RESOLUTION NO. 80-30
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA FINDI-NG, DETERMINING,
DECLARING AND. CERTIFYING THAT THE ACQUI-
SITION OF THE TUSTIN WATER WORKS BY THE CITY
OF TUSTIN WILL NOT HAVE A SIGNIFICANT EFFECT
ON THE ENVIRONMENT.

The City Council of the City of Tustin, California, does hereby resolve as
follows:
1. The City council finds and determines as follows:
" A. That the language of Public Resources 'Code ~Section 21065,
defining the meaning of. "project" for purposes of the California Environment
Quality Act ("CEQA"), is ambiguods o's to 'Whether a project includes proposed'
acquisition by the City of the Tustin Water .Works.

':B. That nothwithstanding the ambiguity of Pub!i~ Resources Code
seCtion 21065,.the staff .of City has made a study ...of potential environme, ntal

impacts of the proposed acquisition.

That the City Council has reviewed the analy$is~ study and
recommendations of the staff.

Not withstanding the ambiguity of Public Resources Code
Section 21065, the City Council finds that there is no potential for significant
impact upon the physical, economic or social environment as a result of' the
acquisition of the Tustin Water Works by the City of Tustin.
E. That the proposed acquisition of the Tustin Water Works' is
solely a change of ownership.
F. That the proposed change of ownership in itself will not
expand, diminish or change its existing .service.
G. That 'the proposed acquisition o~ the Tus~in \Voter \Vorks by
the City of Tustin will no~ have a significant effect or impact on the environment
and does not require preparation of an environmental impact report.

The City Council of the City o[ Tustin does hereby find~ declare,
certify and issue a Declaration of Negative Impact on the proposed acquisition by
the City of Tustin of the Tustin Water Works and £inds, declares and certifies that
