HomeMy WebLinkAboutCC RES 80-27RESOLUTION NO. 80-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR (PROJECT I) MAIN STREET SIDEWALK CONSTRUCTION AND (PROJECT II) PROSPECT AVENUE SIDEWALK CONSTRUCTION AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BID'S. WHEREAS, it is the intention of the CitY .Council of the City of Tustin, California, to construct certain sidewalk and streei~-imprOvements and' appurtenant work designated as (Project I) Main Street Sidewalk Construction and (Project II) Prospect .Avenue Sidewalk Construction; WHEREAS, the City Engineer has presented plans and specifications for the construction of said work; NOW, THEREFORE, BE. IT RESOLVED that the plans and specifications presented by the City Engineer be and are hereby approved as the plans and sp. eci fi cations for the construction of (Project I) Main Street Sidewalk Construction and (Project I I) Prospect Avenue Sidewa.1 k Construction; BE IT FURTHER 'RESOLVED that the City Clerk is hereby authorized and di' rected to advertise as required by law for the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid plans and specifications which said advertisement shall be substantially in the following works and figures, to-wi t' "NOTI CE TO CONTRACTORS" SEATED PROPOSALS will be received at the office of the City Clerk, Tustin City Hall, 300 Centennial .Way, Tustin,' California, until 11:00 A.M. on the llth day of April, 1980, at which time they will be publicly opened and read, for performing work as follows- Construction of (Project I) Main Street Sidewalk Construction and (Project II) Prospect'Avenue Sidewalk Construction. The foregoing quantities are approximate only, being given as a basis for the comparison of bids, and the City of Tustin does not, expressly or by implica- tion, agree that the actual amount of work will correspond therewith, but reserves the right to increase or decrease the amount of any class or portion of the work, or to omit portions of the work as may be deemed necessary or advisable by the Engineer. Plans, specifications and proposal forms to be used for bidding on this project can only be obtained by prospective bidders at the offi.ce of ~he City Clerk, lustin City Hall, 300 Centennial Way, Tustin,"California, 92680, upon pay- ment of $5.00 .per set, which amount shall be' non-refundabi'e... . Plans and specifications will only be mailed out upon payment of $10.00 per set, .which amount shall be non-refundable. In conformance with Section 37931 of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and accompanied by one o'~ the following forms of bidder's security- a. Cash' · b. Cashier's check made payable to the City of Tustin. c. .Certified check made payable to the City of Tustin. d. Bidder's bond executed by an'accredited surety insurer, made payable to the City of T'ustin. · · . The security shall be in an amount equal to at least ten percent (10%) of the amount of the bid. City of Tustin reserves the right' to reject any and all bids, and/or waive' any informality on a bid. No bidder may withdraw his bid for a period of thirty (30) days after .the date set for the opening thereof. The contract will be awarded to the lowest qualified bidder. Provisions of the State Contract Act are not applicable,, and prospective bid- ders will not be required to -be prequalified. All work to be done under the direct supervision of the City Engi.neer, City of Tustin. All work to be paid for at the unit prices bid from appropriated monies. Said 'City of Tustin, 'pursuant to the Labor Code of the State of California, has ascertained and determined that the general prevailing rate of hourly and ~-:..r~iem wages in the locality in which the said work herein described is to be De,.f~-,~'med, for each' craft or. type of workman or mechanic needed to execute the ~'o~tract and al so the general prevailing rate for legal holidays, and overtime ;~ork for each craft or type of workman or mechanic, to be as indicated in Reso- lution 77-52 as previously published in a newspaper of general circulation, and on file in the office of the City Clerk. Employer payments other than those itemized therein, as defined in Section 1773.1 of ~he Labor Code, are.to be paid in accordance with the terms of the col- lective bargaining agreement applicable to the type of classification of the work- men or mechanics employed on. the project. Copies of.all collective bargaining agreements relating to 'the work a.s set" forth in the aforementioned LabOr Code are on file and available for inspection in the office of the Department of Industrial Relations, Division of Labor Statis- tics and Research.
