HomeMy WebLinkAboutCC RES 80-21RESOLUTION NO. 80-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE CiTY OF TUSTIN FISCAL YEAR 1979-80 STREET MAINTENANCE PROGRAM AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS. WHEREAS, it is the intention of the City Council of the City of Tustin, California, to construct certain street maintenance improvements and appurtenant ~.tork designated as Fiscal Year 1979-80 Street Maintenance Program; WHEREAS, the City Engineer has presented plans and specifications for the construction of said work; NOW, THEREFORE, BE IT RESOLVED that the plans and specifications presented by the City Engineer be and are hereby approved as the plans 'and specifications for the construction of the City of Tustin Fiscal Year 1979-80 Street Maintenance Program. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and direct- ed to advertise as required by law for the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid plans and specifications which said advertisement shall be substantially in the following 'words and figures, to-wit- ,..~ .. Mal ena Drive Laurie Lane Westbury Lane Irvine Boulevard 3rd Street Main Street Red Hill Avenue Olwyn Drive E1 Camino Real South to cul-de-sac Nisson Road Edi nger Street The foregoing quantities are approximate only, being given as a basis for the comparison of bids, and the City of Tustin does not, expressly or by implications, agree that the actual amount of work will correspond therewith, but reserves the right to in- crease or decrease the amount of any class or portion of the work, or to omit portions of the work as may be deemed necessary or advisable by the Engineer. The City of Tustin has budgeted a fixed an~unt for the work encompassed by these plans and specifications. In the event that the low bid exceeds or is less than the budgeted amount, the City reserves the right to delete or add projects to the contract A-2 as necessary to stay within the budgeted amount. The provisions of Section 4-103B of the Standard Specifications (increased or decreased quantities) shall not apply to this contract. Plans, specifications and proposal forms to be used for bidding on this project can only be obtained by prospective bidders at the office of the City Clerk, ' Tustin City Hall, 300 Centennial Way, Tustin, Cali'fornia, 92680, upon payment of $2.50 per set, which amount shall be non-refundable. Plans and specifications will only be mailed out upon payment of $5.00 per set, which amount shall be non-refundable. In conformance with Section 37931 of the Government COde, all bids shall be presented under sealed cover on the proposal form provided and accompanied by one of the. following forms of bidder's security' a. Cash b. Cashier's check made payable to the City of Tustin. c. Certified check made payable to the City of Tustin. d. Bidder's bond executed by an accredited surey insurer, made payable to the City of Tustin. The security shall be in an amount equal to at least ten percent (10%) of the amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed therewith. A Surety Bond for payment of labor and materials will be required in the amount' of fifty perc"ent (50%) of' the esi:imated total contract' price and'a Fa'ithful Performance Bond-in the amount of one hundred percent-(100%) of the extimated t~tal -. Co~ltract price in. the form attached to the contract documents.- Said bonds shall be issued by a Surety Company rated Grade A or better and Class I.X or better by the latest edition of Best's Key Rating Guide. City of Tustin reserves the right to reject any or all bids, and/or waive any informality on a bi'd. No bidder may withdraw his bid for a period of thirty (30) days after the date set for the opening thereof. The contract will be a¥~a'r, ded to the lowest qualified bidder. Provisions of the State Contract Act are not applicable, and prospective bid- ders will not be required to be prequalified. Tustin. All work to be done under the direct supervision of the City Engineer, City of All work to be paid for at the unit prices bid from appropriated monies. Said City of Tustin, pursuant to the Labor Code of the State of California, has ascertained and determined that the general prevailing rate of hourly and per diem wages in the locality in which the said work herein described is to be perform- ed, for each craft or type of workm~n or mechanic needed to execute the contract and also the general prevailing rate for legal holidays, and overtime work for each craft or type of workman or mechanic, to be as indicated in Resolution 77-52 as pre- viously published in a newspaper of general circulation, and on file in the office A-3 of the City Clerk. Employer payments other than those itemized therein, as defined in Section 1773.1 of the Labor Code, are to be paid in accordance with the terms of the col- lective bargaining' agreement applicable to the type or classification of the work- men or mechanics employed on the project. Copies of all collective bargaining agreements relating to the work as set forth in the aforementioned Labor Code are on file and available for inspec~tion in the. office of the Department of Industrial Relations, Division of Labor Statistics and Research.
