RESOLUTION NO. 80-13
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, FINDING AND DETERMINING
THAT PUBLIC INTEREST AND CONVENIENCE REQUIRE
THE SALE OF REAL PROPERTY ADJACENT TO NEWPORT
AVENUE HAVING AN AREA OF APPROXIMATELY 5,581
SQUARE FEET.
The City Council of the City of Tustin, California does hereby resolve
as fol 1 ows'
1. The City Council hereby finds and determines as follows'
a. That the property is not needed for any present or prospective
public use, and is therefore excess and surplus land.
b. That the public interest and convenience require the sale of
said real property.
c. That the proposed sale of said real property was declared and
qualified as a negative declaration under the California Environ-
mental Quality Act by Resolution of the City Council passed and
adopted at a regular meeting held on January 21, 1980.
d. That the real property proposed for sale is described in
Exhibit "A" and as shown on a map referred to as Exhibit "B"
both which are attached and made a part hereof and more commonly
described as a 30' wide parcel of land on the westerly side of
Newport Avenue between Holt Avenue and the Orange County Flood
District Channel.
2. That any person who wishes to make an offer to purchase the said
real property may do so by submitting to City an offer in writing on the form
attached as Exhibit "C", accompanied by a cashier's check in the sum of
$5,000.00, payable to the City of Tustin, at or before the time of said
hearing, and any and all persons are hereby solicited for offers.
3. That minimum bid lshall be $ 17,700.00. Final sale.shall be subject
to the normal real estate sales provisions as prepared by the City Attorney.
.6. That the City shall reserve the right to refuse all bids.
5. That proposals shall be submitted no later than 3'00 o'clock p.m. on
March 6
, 1980, to thelCity Clerk's office, at which time the

staff shall open and review the bid and proposals prior to
1980.

6. That a hearing is set for March 17 , 1980, at 7'30 o'clock .....
p.m. in the Council Chambers of the City of Tustin at Tustin City Center,
300 Centennial Way, Tustin, California, at which time and place any and all
persons interested in said proposed sale may appear, make or increase offers,
protest the proposed sale, and/or otherwise be heard. The City Council shall
pass on any and all offers and protests at said time and place.
7. That a copy of this resolution shall be published once a week for
two weeks in the Tustin News, a newspaper of general circulation published
in the City of Tustin, not less than fifteen days before said hearing, and
notice of said hearing shall be posted conspicuously along the line of the
portion of said 'property proposed to be sold not less than ten (lO) days be-
fore said hearing and not less than three (3) copies shall be posted.
PASSED AND ADOPTED at a regular meeting of the City Council held on
the 19th day of February , 1980.

EXHIB IT A
ALL THAT LAND SITUATED IN THE CITY OF TUSTIN, COUNTY
OF ORANGE, STATE OF CALIFORNIA, DESCRIBED AS FOLLOWS-
Beginning at the point of intersection of the easterly right-of-way line of
Holt Avenue, an 80 foot wide street as shown on a map of the Vanderlip and Rowan
Tract recorded in book 5, page 160 of miscellaneous records of Los Angeles County,
California, with the northwesterly right-of-way line of the Southern Pacific Rail-
road as conveyed in a deed recorded in book 570, page 288, Records of Los Angeles
County, California;
Thence, N.O0O 22' 03" E., along said easterly right-of-way line of Holt
Avenue, a distance of 46.59 feet to the point of intersection with a line parallel
with and distant 30.00 feet northwesterly of, as measured at right angles to, said
northwesterly right-of-way line of the Southern Pacific Railroad;
Thence, N.39° 43' 00" E., along said parallel line, a distance of 82.64 feet
to the point of intersection with the existing easterly right-of-way line of Holt
Avenue, said point of intersection also being the true point of beginning of the
parcel to be described;
Thence, N.39° 43' 00" E., continuing along said parallel line, a distance of
203.19 feet to the intersection with the westerly right-of-way line of the Orange
County Flood Control District easement as per deed recorded in book 5670, page 846
of Official Records of Orange County, California;
Thence, S.O0° 22' 03" E., along said westerly right-of-way line of the Orange
County Flood Control District easement, a distance of 23.62 feet to the beginning
of a tangent curve concave easterly and having a radius of 543.00 feet;
Thence, southerly along said curve and continuing along said westerly right-
of-way line, through a central angle of 20 21' 59", an arc distance of 22.42 feet
to the poin~ of inter, section with the previously mentioned northwesterly right-.of-
way line of the Southern Pacific Railroad;
Thence, S.39o 43' 00" W., along said northwesterly right-of-way line to the
Southern Pacific Railroad, a distance of 163.90 feet to the point of intersection
with the existing easterly right-of-way line of Holt Avenue;
Thence, N.880 41' 24" W., along said right-If-way line of Holt Avenue, a dis-
tance of 10.25 feet to a point on a non-tangent curve concave easterly and having a
radium of 2t0.00 feet, a radial to said point bears N.41° 54' 32" E.;
Thence, northerly along said curve and said easterly right-of-way line of Holt
Avenue, through a central angle of 6o 01' 16", an arc distance of 22.07 feet to the
true point of beginning.

PROPERTY'
Real property described in Exhibit "A" and as shown on Exhibit "B" and
more commonly described as the westerly side of Newport Avenue between Holt
Avenue and the Orange County Flood Control District Channel and an area con-
tent of approximately 5,581 square feet and presently zoned retail commercial.
The real property is not considered developable property as it stands without
access to Newport Avenue and only 30 feet of depth under the existing zoning
ordinance.

b) City will review the proposals and hold a .public hearing on same
on March 17 1980, at 7'30 o'clock p.m. in the City Council
Chambers, at whic~ time proposals will be considered and all persons
may appear to make new offers, increase, offers, protest the proposed
sale, and/or otherwise be heard. Increased offers must be in writ-
ten form outlining what elements of the original written proposal
that have been changed.
c) The City of Tustin reserves the right to reject all proposals.
d) Purchasers will be subject to all provisions contained in
Re solution No. 80-13 .
6. Each bidder is required to submit a statement of the proposed use
of the real property.
Bidder(s) have fully read the provisions of Resolution No.80-13 and
agree to comply with them as a condition of this bid.
