RESOLUTION NO. 80-9 A RESOLUTION OF THE CITY COUNCIL, CITY OF TUSTIN, CALIFORNIA REQUESTING THE COMMENCEMENT OF PRO- CEEDINGS FOR THE ANNEXATION OF CERTAIN INHABITED TERRITORY DESIGNATED AS "SAN JUAN-GREEN VALLEY ANNEXATION NO. 110 (REVISED)" TO THE CITY OF TUSTIN. WHEREAS, if is the desire of the City o¢ Tustin to annex info ifs boundaries certain inhabited properties within ifs Sphere of lnt:luence and contiguous fo its existing boundaries; and WHEREAS, the City Council has determined that the proposed annexation is categorically exempt from the CEOA requirements for environmental impact review; and WHEREAS, if is the desire of the City of Tusf. in fo extend the full range of municipal services fo the residents of these unincorporated properties in the interest of the welfare of the total community; and WHEREAS, certain property owners within the area have expressed a desire fo be wi thin the incorporated limits of the city and all other property owners were invited fo express their desires, with the results indicating that a ma]ority.'of the residents and property owners have no objection fo the annexation; NOW, THEREFORE, BE IT RESOLVED by the City Council, City of Tusfin, Cali forni a' That the City of Tustin requests the commencement of annexation pro- ceedi.ngs in connection wi th said inhabited territory pursuant fo Chapter 2, Article 4, Section 35140 and Chapter 3, Article 2, Section 35220 of the Municipal Organization Act of 1977. 2~ That said unincorporated territory be, and hereby is, desfgnafed as the "San Juan-Green Valley Annexation No. :[1_0 (Revised)" to the City of Tustin and is as shown on Exhibit "A" attached hereto and incorporated herein by this reference¢ and as legally described in Exhibit "B" attached hereto and incorporated herein by this reference. 3. That the subject area is a totally developed urbanized area of 12 acres consisting of apartment houses, Single family residences, and d. uplex units. That an 8.7 acre apartment house 'and condominium project will remain as a county island within the immediate vicinity until such time as the residents and owners express a desire for annexation. The re- maining portion cannot reasonably be annexed fo another city or in- corporated as a new cify, thereby qualifying for a waiver of the restrictions of Section 35010. . That the just i f i caf i on for the proposed change of organi za.f i on is fo provide full municipal, services to an urbanized county area that is remote from county service facilities and thereby increase the economy and efficiency of urban services. 6.
