RESOLUTION NO. 80-8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING ITS INTENTION TO SELL PROPERTY · ADJACENT TO NEWPORT AVENUE BETWEEN THE ORANGE COUNTY FLOOD CONTROL DISTRICT CHANNEL"AND IRVINE BOULEVARD. . . WHEREAS, there is no contemplated use of the property for public ri~ht~ -. of-way, either presently or prospectively; and WHEREAS, .the hereinafter described Property is not suitabl'e nor adequate for any public purpose to 'include a park; ~OW, IH[R~_FOR[, the ¢~ty Council of the ¢~ty of lust:~n, California re.- sol ves as fol lows' 1. It appears that the property described in Exhibit "A" and as shown on a map referred to as Exhibit "B" both which are attached 'and made a part hereof, is unnecessary for any present or prospective public uses.-. ' 2. It is proposed that said property be sold as excess, unused, and unneeded 1 and. 3. The proposed action is declared as qualified as a Negative Declara- tion under the California Environmental Quality Act. 4.. A public hearing is hereby set for February 18, 1980, at 7-30 p.m. in the Chamber of the City Council at 300 Centennial Way, Tustin, California, for hearing all persons interested in being heard or objecting to the proposed sale. 5. A copy of this resolution shall be published once a week for two weeks in the Tustin News, a'newspaper of general circulation pub- lished in the City of Tustin, not less than fifteen (15) days before said hearing, and notice of said hearing shall be posted conspicuously along the line of the portion of sa.id property pro- posed to be sold not less than ten (10) days before said hearing and not less than three (3) copies shall be posted. EXH I B IT A ALL THAT LAND SITUATED IN THE CITYi OF TUSTIN, COUNTY OF ORANGE, STATE OF CALIFORNIA, DESCRIBED AS FOLLOWS' Beginning at the point of intersection of the easterly right-of-way line of Holt .. Avenue, an 80 foot wide street as shown on a map of the Vanderlip and Rowan Tract re- corded in Book 5, Page 160, of miscellaneous records of Los Angeles County, California, with the northwesterly right-of-way line of the Southern Pacific Railroad as conveyed in a deed recorded in book 570, page 288, Records of.Los Angeles County, California; Thence, N.O0° 22' 03" W., along said easterly right-of-way line of Holt Avenue, a distance of 46.59. feet to the point of intersection with al line parallell with and distant 30.00 feet.northwesterly of, as measured at right angles to, said northwester-. ly right-of-way line of the Southern Pacific railroad; Thence, N.39° 43' 00" E., along said parallel line, a distance of 402.29 feet to the point of intersection with the easterly right-of-way line of the Orange County Flood Control District easement as per deed recorded in book 5670, page 846 of Official Records of Orange County, California, said point of intersection being the true point of beginning of the parcel to be described; Thence, N.39o 43' 00" E., along said parallel line, a distance of 198.44 fe~t to the northerly line. of the land conveyed to Raymond C. Barnes and Nila M. Barnes as per deed recorded in book 292, page 220 of deeds, Records of Orange County, California; Thence, N.89o 36' 53" E., along said northerly line, a distance of 39.22 feet to the point of intersection with the previously mentioned northwesterly right-of-way line of the Southern Pacific Railroad; Thence, S.39° 43' 00" W., along said northwesterly right-of-way line, a distance of 259.34 feet to the point of intersection with the previously mention easterly right-~. of-way line of the Orange County Flood Control District easement; Thence, N.O0° 22' 03" W., along said easterly right-of'way line, a distance of 46.59 feet to the trueI point of beginning.
