HUSTON, CITY MANAGER HUMAN RESOURCES DEPARTMENT SUBJECT: TEMPORARY BENEFITS AND COMPENSATION DURING. MILITARY LEAVE FOR CITY EMPLOYEES CALLED TO ACTIVE DUTY WITH THE ARMED FORCES RECOMMENDATION' Adopt Resolution 01-96 establishing additional temporary partially paid military leave of absence and continuation of benefits for eligible City employees called to active, duty in connection with the nation's response to the terrorist attack on the United States of America. FISCAL IMPACT: Estimated at $117,834. BACKGROUND AND DISCUSSION' On September 11, 2001 the New York World Trade Center buildings and the Pentagon were struck by commercial airlines hijacked by terrorists. In response to these acts the President and the Congress of the United States announced a war on 'terrorism. The armed forces of the United States have been alerted and are currently being redeployed to respond. The President has also authorized calling thirty-five thousand reservists-back to active military duty to support the regular armed forces being redeployed. One of our employees has been reactivated in the call-up of reservists and others may be called. Typically, the normal tour of duty to which a reservist may be ordered to serve, without congressional action, is six (~) months. Several Orange County cities and .special districts have adopted, or are considering. adopting, resolutions similar to the one you are being asked to consider. The reservists on staff have expressed concern about making ends meet and benefits for their spouse and/or children in the event they are called to action. S:\City Council Agenda Items\military leave 1001.doc ~City Council Agenda October 15, 2001 Page 2 Adoption of the attached Resolution would provide an eligible employee partial pay (the City would pay the difference between an employees' military pay and his/her Current base salary) and continued employee benefits as currently provided. The Resolution would be effective September 11, 2001 to ensure continuity of salary and benefits and will sunset at the conclusion of our fiscal year, June 30, 2002 which would enable us to more accurately project future costs and include them in our next budget should the City Council wish to extend the Resolution into our next fiscal year. The fiscal impact of the Resolution is most likely overstated at $117,834 as it is estimated based on three (3) employees being called to duty for a period of six (6) months. Funds are currently budgeted to cover the salary and benefit costs associated with the Resolution and we anticipate enough salary savings (due to unfilled positions) to cover any additional overtime costs associated with coverage for the individuals on extended military leave. As such, no budget adjustment is necessary. Arlene Marks, SPHR Director of Human Resources Attachment: Resolution No. 01-96 S:\City Council Agenda Items\military leave 1001 .doc l0 14 l? 20 2! 22 24 25 26 2? 28 RESOLUTION NO. 01-96 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PROVIDING FOR ADDITIONAL TEMPORARY PARTIALLY PAID MILITARY LEAVE OF ABSENCE AND CONTINUATION OF BENEFITS FOR ELIGIBLE CITY EMPLOYEES CALLED TO ACTIVE DUTY WITH THE ARMED FORCES WHEREAS, the City of Tustin currently provides fully paid leave of absence and continuation of benefits for a maximum of thirty (30) calendar days per year to employees who have been in City service for at least one (1') year and who are ordered to report to active duty; and WHEREAS, several City employees have been alerted and have been, or may be in the future, called into active military service in connection with actions to combat terrorism against America; and WHEREAS, the City Council of the City of Tustin desires to alleviate financial hardships which employees and their families will experience as a result of being called' to active duty to serve during such crisis. NOW, THEREFORE, The City Council of the City of Tustin, California does hereby resolve as follows: ,, In addition to the fully paid military leave currently provided by the City of Tustin, each full time officer or employee of the City who is eligible to receive such paid leave and, who has been, or is in the future, called to involuntary active military service with the Armed Forces of the United States to serve in support of the current actions to combat terrorism against America, shall be entitled to military leave with partial pay pursuant to the terms of this Resolution for the period of absence on active duty in excess of the period covered by current paid military leave provisions. , The amount of pay that each such employee shall be entitled to receive from the City for said additional period of military leave shall be the difference between the gross pay and allowances actually received by the officer or employee from the United States for such service and the salary schedule gross wages'that said officer or employee would have received from the City of Tustin if he or she had not been called to active military duty, subject to all required and appropriate deductions and withholdings. , The City shall provide continued health and welfare benefits to such employees' dependents, provided that the dependents were covered for such benefits prior to the employee being called to active duty. , Wage or benefits pursuant to this Resolution are conditioned upon the officer or employee requesting such payment and providing satisfactory proof and documentation of eligibility to receive payment in accordance with the procedures established by the Human Resources Director. DOC l0 14 l? 20 2! 22 24 25 2? 28 29 , The pay and benefits authorized by this Resolution shall terminate on and be of no further force or effect on midnight, June 30, 2002, unless extended by the City Council or otherwise required by law. 6. The effective date of this Resolution shall be September 11, 2001. Passed and adopted at a .regular meeting of the Tustin City Council held on the 15th day of October, 2001.
