HUSTON, CITY MANAGER FROM' PARKS AND RECREATION SERVICES 920-30 NO. 15 1 0.15-01 SUBJECT' GRANT FUNDS FOR THE ROBERTI-Z'BERG-HARRIS GRANT PROGRAM SUMMARY: Cities choosing to submit applications for Roberti-Z'Berg-Harris (RZH) grant funds under the Safe Neighborhood Parks, Clean Water, Clean Air, and CoaStal Protection Bond Act of 2000 must first submit an approved resolution from the applicant's governing body. The Bond Act would be used to fund a major portion of the construction and design costs for the Pioneer Road Park project. RECOMMENDATION' The City Council approve the application for Grant Funds for the RZH Urban Open Space and Recreation Grant Fund Program under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 and adopt the attached Resolution No. 01-99 to support the grant request. FISCAL IMPACT: The estimated budget for Pioneer Road Park, $1.3 million, includes architectural services, project management and construction costs. Under the RZH grant program the City would receive $198,000 while under a previous application from the Per Capita Grant Program the City would, receive $619,000 for a total of $817,000 in Safe Neighborhood Bond Act of 2000 funds. The remaining project costs were included in the City's 2001/2002 Capital Improvement Program. BACKGROUND: The Safe Neighborhood Parks, clean Water, Clean Air and Coastal Protection Bond Act of 2000 was intended to revive urban areas by investing in neighborhood and state parks, clean water protection, coastal beaches and scenic areas. As a means of addressing critical neighborhood park needs, the Bond Act provided 200 million dollars in funds for the RZH Program. The Parks & Recreation Department identified the development of Pioneer Road Park as an eligible project. The three-acre site located at Pioneer Road and Jamboree, near the Salvation Army facility, provides an opportunity to develop a neighborhood park that has been identified as a priority project by the Tustin Ranch community, the City Council and-the Parks and Recreation Commission. SUMMARY: The Parks and Recreation Services Department is requesting that the City Council approve the attached resolution. WHEREAS, The Legislature of the State of California has enacted the R°berti-Z'Berg-Harris Open Space and Recreation Program, which provides funds to. certain political subdivisions of the State 8 of California for acquiring lands and developing facilities to meet urban recreational needs; and WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility for the administration of the grant project, setting up the neCessary procedures, and WHEREAS, said procedures established by the California Department of Parks and Recreation require the APplicant's .Governing Body to certify by resolution the approval of the Application to apply for the Roberti-Z'Berg-Harris allocation; and WHEREAS, the Applicant will enter into a contract with the State of California; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin, California does hereby resolve, declare, determine and order as follows' Approves the filing of an Application for assistance funds from the Roberti-Z'Berg- Harris Urban Open Space and Recreation Program under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000; and , Certifies that Applicant has or will have sufficient funds to operate and maintain, the project; and . , Certifies that Applicant has reviewed, understands and agrees to the General provisions contained in the Contract shown in the Procedural Guide; and Appoints the Director of Parks and Recreation Services as agent to conduct all negotiations, execute and submit all documents including, bdt not limited to Applications, agreements, payment requests and so on, which may be necessary for the completion of the Project.
