RESOLUTION NO. 79-80
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING
PLANS AND SPECIFICATIONS FOR THE SYCAMORE
AVENUE STREET RECONSTRUCTION AND DIRECTING
THE CITY CLERK TO ADVERTISE FOR BIDS.
WHEREAS, it is the intention of the City Council of the
City of Tustin, California, to construct certain street' main-
tenance improvements and appurtenant work designated as.
Sycamore Avenue Street Reconstruction;
WHEREAS, the City Engineer has presented plans and speci-
fications for the construction of said work;
NOW, THEREFORE, BE IT RESOLVED that the plans and speci-
fications presented by the City .Engineer be and are hereby
approved as the plans and specifications for the construction
of the Sycamore Avenue Street Reconstruction
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to advertise as required by law for
the receipt of sealed bids or proposals for the doing of the
work specified in the aforesaid olans and specifications which
said advertisement shall be substantially in the following words

SEALED PROPOSALS will be received at the office
of the City Clerk, Tustin City Hall, 300 Centennial Way,
Tustin, California, until 10-00 A.M. on the 20th day of
November, 1979, at which time they will be publicly
opened and read, for performing work as follows'
Construction of Sycamore Avenue Reconstruction.

Them folregoing quantities are approximate.only, being given
as a basis for the comparison of bids, and the City of Tustin
does not, expressly or by implication, agree that the actual
amount of work will correspond therewith, but reserves the
right to increase or decrease the amount of any class or por-
tion of the work, or to omit portions of the work as may be
deemed necessary or advisable by the Engineer.
The City of Tustin has budgeted a fixed amount for the
work encompassed by these plans and specifications. In the
event that the low bid exceeds or is less that the budgeted
amount, the City reserves the right to reduce bid items
to the contract as necessary to stay within the budgeted
amount. The provisions of Section 4-103B of the Standard
Specifications (increased or decreased quantities) shall not
apply to this contract.
Plans, specifications and proposal forms to be used for
bidding on this project can only be obtained by prospective
bidders at the office of the City Clerk, Tustin City Hall,
300 Centennial Way, Tustin California, 92680, upon payment o'f
$5.00 per set, which amount shall be non-refundable.
Plans and specifications will only be mailed out upon pay-
ment of $10.00 per set, which amount shall be non-refundable. 'ii,

The security shall be in an amount equal to at least ten
percent (10%) of the amount of the bid. A bid shall not be
considered unless one of the forms of bidder's security is
enclosed therewith.
A Surety Bond for payment of labor and materials will be
required in the amount of fifty percent (50%) of the estimate
total contract price and a Faithful Performance Bond in the
amount of one hundred percent (100%) of the estimated total ..

State of California, has ascertained and determined that the
general prevailing rate of hourly and perdiem wages in the
locality in which the said work herein described is to be ger-
formed, for each craft or type of workman or mechanic needed
to execute the contract and al so the general prevailing rate
for legal holidays, and overtime work for each craft or type
of workman or mechanic, to be as indicated in Resolution 7'7-52
as previously published in a newspaper of general circulation,
and o.n file in the office of the City Clerk.
Employer payments other than those itemized therein, as
defined in Section 1773.1 of the Labor Code, are to be paid in
accordance with the terms of the.collective bargaining agree-

BE IT ALSO RESOLVED that the City Council of the City of
Tustin has ascertained and does hereby determine that the gen-
eral prevailing rate of wages and employer payments in the
locality of the City of Tustin, California, for each craft or
type of workman needed to execute the work herein above speci-
fied is as set forth in Resolution No. 77-52.
PASSED AND ADOPTED by the City Council of the City of
Tustin, California, this 5th day of November , 1979.
