HomeMy WebLinkAboutCC RES 79-33RESOLUTION NO. 79-33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE CITY OF TUSTIN FISCAL YEAR 1978-79 STREET MAINTENANCE PROGRAM AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS. WHEREAS, it is the intention of the City Council of the City of Tustin, California to construct certain street maintenance improvements and appurtenant work desi§nated as Fiscal Year 1978-79 Street Maintenance Program; WHEREAS, the City Engineer has presented plans and specifications for the construction of said work; NOW, THEREFORE, BE IT RESOLVED that the pl'ans and specifications presented by the City Engineer be and are hereby approved as the plans and specifications for the construction of the City of Tustin Fiscal Year 1978-79 Street Mainte- nance Program. BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for the receipt of sealed bids or proposals for the doing of the work specified in the aforesaid plans and specifications which said advertisement shall be substantially in the following words and figures, to-wit' "NOTICE TO CONTRACTORS" SEALED PROPOSALS will be received at the office of the City Clerk,-Tustin City Hall, Centennial at Main Street. Tustin, California, until' ll-O0 A.M. on the3]_st day of May , i979, at which time they will be publicly opened and read, for performing work as follows- Construction of City of Tustin Fiscal Year 1978-79 Street Maintenance Program. The City of Tustin has budgeted a fixed amount for the work encompassed by these plans and specifications. In the event that the low bid exceeds th~~' budgeted amount, the City reserves the ri§ht to .delete one or more of t~e proposed projects from the contract as necessary to stay within the bu~-§eted amount. The provisions of Section 4-103B of the Standard Specifications (increased or decreased quantities) shall not apply to this contract. Plans, s'pecifications and proposal forms to be used for bidding o~ this. project can only be obtained by prospective bidders at the offic~ of ~e City Clerk, Tustin City Hall, Centennial at Main Street, Iustin, California, 92680, upon payment of $2.50 per set which amount shall be non'refundable. Plans and specifications will only be mailed out upon payment of $5.00 per set which amount shall be non-refundable. In conformance with Section 37931 of the Government Code, all bids shall be presented under sealed cover on the proposal form provided and accon~anied by one of the followin§ forms of bidder's security- a. Cash. b. Cashier's check made payable to the City of Tustin. c. Certified check made payable to the City of Tustin. d. Bidder's bond executed by an accredited surety insurer, made payab!e to the City o.f Tustin. The security shall be in an amount equal to at least ten percent ~10%) of the amount of the bid. A bid shall not be considered unless one of the forms of bidder's security is enclosed therewith. A Surety Bond for payment of labor and materials will be required in the. amount of fifty percent (50%) of the estimated total contract price an~ a Faithful Performance Bond in the amount of one hundred percent (100%) ~f the estimated total contract price in the form attached to the contract documents. Said bonds shall be issued by a company having a rating of A+AA or better. City of Tustin reserves the right to reject any or all bids, and/~r waive any informality on a bid. No bidder may withdraw his bid for a period ~f thirty (30) days after the date set for the opening thereof. The contract will be awarded to the lowest qualified bidder. · ProviSions of the State Contract Act are not applicable, and pros~ctive bidders will not be required to be prequalified. All work to be done under the direct supervision of the City En§i~eer, City of Tustin. All work to be paid for at the unit prices bid from appropriated m~nies. A-3 Said City of Tustin, pursuant to the Labor Code of the State of California, has ascertained and determined that the general pre- vailing rate of hourly and per diem wages in the locality in .which the said work herein described is to be performed, for each craft or type of workman or mechanic needed to execute the contract and also the general prevailing rate for legal holidays, and overtime work for each craft or type ef workman or mechanic, to be as indicated in Resolution 77-52 as previously published in a newspaper of general circulation, and on file in the office of the City Clerk. Employer payments other than those itemized therein, as de- fined in Section 1773.1 of the Labor Code, are to be paid in accor- dance with the terms of the collective bargaining agreement appli- cable 'to the type or classification of the workmen or mechanics employed on the project. . Copies of all collective bargaining agreements relating to the work as set forth in the aforementioned Labor Code are on file and available for inspection in the.office of the Department of Indus- trial Relations, Division of Labor Sta%istics and Research.
