WHEREAS, Section 1157.2 of the Government Code provides that with the approval of the governing body of a public agency and under such regulations as it may prescribe~ employees of the public agency may authorize deductions to be made from their salaries or wages either for the payment of contributions to bona fide charitable organizations or for the payment of designated sums to a nonprofit California corporation which is compelled by its by-laws to make, and which does expend such sums solely by the making of contributions to bona 'fide charitable organizations; and WHEREAS, Section 13923 ol~ the Government Code provides that charitable payroll deductions from the salaries or wages of state officers and employees are available for charitable contributions made to the agency handling the Principal combined fund drive in any area; and WHEREAS~ the City of Tustin desires to minimize loss of productive work- time from public business by employees occasioned by charitable fund drives in facilities; and WHF'P, EAS~ the City Council of the City of Tustin considers a single~ combined fund drive on behalf of charitable organizations to be more efficient, effective and equitable than multiple fund drives and thus in the best interests ol' ........ and its employees; and WHEREAS~ the City Council of the City of Tustin considers Section 13923 of the Government Code relating to charitable payroll deductions for state officers and employees to be an appropriate and desirable precedent for application within; and WHEtAEAS, the City Council o1: the City of Tustin in determining which organization is best suited to conduct the single, combined fund drive among the employees of the City of Tustin has considered the following criteria- A. The number of charitable agencies in the City of Tustin which rely on the drive for their support. B. The number of dollars raised in the City of Tustin during the last completed fund drive. C. The percentage of dollars dispersed to charitable agencies as a result of the drive. D. The organization using the American Institute of Certified Public Accountants AICPA standards of accounting for financial reporting in the City of Tustin. E. The organization that has an established procedure for channeling designated employee gifts to Intrernal Revenue Service-approved non- profit human care agencies. 4 5 6 '7' 1, 14 15 2! 22 24 25 26 27 28 29 50 52. X]tEREFORE, BE IT RESOLVED that the City Council of the City of Tustin hereby approves and provides, subject to such regulations as the City Administrator may prescribe, that payroll deductions from the salaries or wages of employees of the City of Tustin, may be made for charitable contri- butions to United Way of Oranqe County. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 18thday of December , 1978.
