RESOLUTION NO. 78-130
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
SUSPENDING CONDITIONAL USE PERMIT NO. UP 76-7 OF THE
THIOKOL/DYNACHEM IN ORDER TO CORRECT DEFICIENCIES IN AIR
QUALITY CONTROL EQUIPMENT.
The City Council of the City of Tustin does hereby resolve as follows:
I. The City Council of the City of Tustin finds and determines as
fol 1 ows:
A. That a proper application for Use Permit 76-7 was filed by
Thiokol/Dynachem to allow the construction and operation of
an Organic Chemical Reaction Unit at 2632 Michelle Drive.
B. That said application was heard and approved by the Planning
Commissio~ on May 10, 1976 subject to the following conditions:
1. Ail development would conform to the Uniform Building Code.
2. That air pollution control measures would be properly
exercised as required by the responsible agencies.
3. Engineering design considerations would be submitted to
guarantee the elimination of' fumes, odors, and mitigation
of hazards.
C. That Thiokol/Dynachem has violated the above stated conditions
of approval by operating the Organic Chemical Reaction Unit
without having all. required air pollution control devices
functionin9 in the prescribed manner.
D. That said violations have caused a repeated odor nuisance in
the surrounding areas, leading to the disruption of normal
activities and discomfort to surrounding residents.
II. The City Council of the City of Tustin does hereby suspend Use
Permit 77-6 subject to the following conditions-
A. Ail production or use of chemicals in the Organic Chemical
Reaction Unit that have been the cause of the nuisance violation
shall cease immediately.
B. Only those operations and use of chemicals cited above that are
necessary to the test and insure all air pollution equipment is
functioning as per the conditions of Use Permit 77--6 shall be
allowed.
C. Temporary reinstatement of Use Permit 76-7 to allow full pro-
duction in the Organic Chemical Reaction unit shall not be
allowed until such time as the Air Quality Management District
has inspected and approved the air pollution control devices
· as in 'c6m~liahce with the permit to cons~ruc't issued by the'
South Coast Aik Qhality Management Board on August 8, 1978 and
notified the Community Development Director.
D. Public hearing on Use Permi'k 76-7 shall be continued until

December' 18,~978 at 7:30 p.m. in the City Council Chambers
at which time the City Council shall review Use Permit 76-7
to determine what further action is in order.
PASSED AND ADOPTED at a regular meeting of the City of Tustin City
Council held on December. 4, 1978.
