RESOLUTION NO. 115
A RESOLUTION OF THE CITY COUNCIL, CITY OF TUSTIN,
CALIFORNIA, RELATING TO THE TERMS AND CONDITIONS
OF CITY PERSONNEL EMPLOYED PURSUANT TO THE PRO-
VISIONS OF THE FEDERAL COMPREHENSIVE EMPLOYMENT
AND TRAINING ACT (PL 93-203- C.E.T.A.)
WHEREAS~ the United States Congress enacted the Comprehensive Employ-
ment and Training Ac[ of 1973 as Public Law 93-2133 for [he purpose of providing
job training and employment, opportunities for economicalty disadvantaged unem-
ployed and underemployed persons and to assure that [raining and other services
lead [o maximum future employment oppor[unibies~ and
WHEREAS~ under [he p~ovisions of the Commprehensive IEmpIoymen[ and
Training Ac[ of 1973~ hereinafter referred [o as ~'C.E.T.A.'% [he Federal Gov-
ernment is providing partial or complete financial funding to employ persons
local governmen[a! programs designed [o [~ain and educate said individuals in order
that [hey may later secure and retain employment a~ their maximum capaci[y~ and
WHEREAS~ pursuant [o the authority contained in the C.E.T.A. [he Secretary
of Labor has issued rules and regulations to implement said Ac[ when loca!
governments have joined in [he par[icipa[ion~ and
WHE~EAS~ said Act is designed [o provide this ~raining experience but with
expiration da[es which~ [o da[e~ have been repeatedly extended~ and
WHE[~EAS~ ~he provisions regarding compensation and working conditions for
[he emptoyee participants are contained in ~he Secretary's rules and regulations
and provide that the employing agency is; with certain exceptions, ~equired to
provide att of the existing benefits and related programs to the C.E.T.A. employees
~har, are otherwise provided [o regular permanent employees of the agency; and .
WHEP, EAS~ the City does have Lt~e option to provide additional benefits over
and above ti~e minimum requirements of the Secretary of Labor; and
WHEP, EAS~ the City has entered into a grant assistance program with the
.County of Orange pursuant to the provisions of C.E.T.A. in order to obtain
necesaFy funds to employ personnel; and
WHEREAS~ the City Council desires to specify the respective rights~ duties
and obligations of the City and the C.E.T.A. employees during the term of their
temporary employment with the City.
NOW, THEREFORE, the City Council of the City of Tustin does hereby find,
determine and resolve as follows-
1. In accordance with the provisions of the Tustin City Code, the Tustin
Personnel P, ules & Regulations~ and resolutions and Minute Orders of the City of
Tustin~ the City Council reaffirms that the C.E.T.A. employees are limited service
personnel employed for the purpose of providing training and educational exper-
ience to said employees in order [o obtain future maximum employment.
2. Said C.E.T.A. employees are to serve with the City until the Act is no
longer continued by the United States Government, and concurred in by the County
of Orange or by express consent of the City of Tustin.

3. C.E.T.A. employees are to be governed by the Tustin City Code, and
the Tustin Personnel Rules & Regulations except insofar as more specifically
defined in this IResolu[ion.
4. In accordance with the authority set forth in the C.E.T.A. the City
reserves its right Lo terminate its participation in said program aL any Lime which
could result in the immediate termination of any or all emp]oyees funded under Lhis
program.
5. C.E.T.A. employees shall be compensated at a salary range scl forth in
Paragraph 8 herein, and shall be entitled to receive merit raises, in accordance
with the procedures and requirements set forth in the Tustin Personnel P,u~es &
Regulations.
6. C.E.T.A. employees shall receive the benefits that are granted to
regular permanent service employees, of their same class~ for medica]~ denta]~ life'
insurance~ and disability insuance. Provided~ however, that if and al: such time as
State and Federal laws and regulations permit CETA employees Lo be excluded
from the Public Employees Retirement System, they shall thenceforth be so
exciuded.
7. That the C.E.T.A. employees, while employed in a variety of job
classifications, have one common characteristic, namely, that they are employed
on a full time basis~ but for a fixed period of time in order to gain work experience
and training in order to find future permanent employment in either the public or
private sector.
8. Sala~y and Wage - Schedule C.E.T.A. Employees. The following position

9. Effective Date - Unless otherwise specified to the contrary in this
Resotution~ alt provisions shall be effective as of the dates the benefits of other
employees in their same or similar classification became effective.
