PUBLIC MEETING City Council Meeting October 2, 2007 Minutes Page 1 of 5 CALL TO ORDER - 7:01 p.m. INVOCATION -Councilmember Palmer PRESENTATION OF COLORS AND PLEDGE OF ALLEGIANCE -Tustin American Legion ROLL CALL Present: Mayor Lou Bone; Mayor Pro Tem Jerry Amante; Councilmembers Doug Davert; Tony Kawashima; and Jim Palmer Absent: None City Clerk: Pamela Stoker Others Present: William A. Huston, City Manager and Doug Holland, City Attorney CLOSED SESSION REPORT -Council gave City Attorney direction on Item #D, when action is complete documents will be available in City Clerk's office. PRESENTATION -Certificate of Recognition presented by Mayor Bone to Karrie Good, Chair of the Tustin Relay for Life, 2007 FIRST PUBLIC INPUT -Rosalie Wagner of CR&R commented on refuse company transition. CONSENT CALENDAR ITEMS - It was moved by Councilmember Davert, seconded by Mayor Pro Tem Amante, to approve balance of consent calendar items as recommended by staff. Motion carried 5-0. 1. APPROVAL OF MINUTES -REGULAR MEETING OF SEPTEMBER 18, 2007 Motion: Approve the Minutes of the Regular City Council Meeting held September 18, 2007. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Motion: Approve demands in the amounts of $779,525.37; and $2,873,056.79; Reversals in the amount of $3,641.39; and Payroll in the amount of $667,549.92. 3. PLANNING ACTION AGENDA -SEPTEMBER 25, 2007 All actions of the Planning Commission become final unless appealed by the City Council Meeting October 2, 2007 Minutes Page 2 of 5 City Council or members of the public. Motion: Ratify the Planning Commission Action Agenda of September 25, 2007. 4. CONSIDERATION OF CLAIM OF JOE W. TURNER, JR., CLAIM NUMBER 07-28 The Claimant reported that drains and toilets in his home were backing up and running over - he stated the roots of a City tree had taken out the sewer main drain. Rooter system service was needed to locate, video and clean out the blockage. The Claimant is requesting reimbursement of approximately $10,000 in charges to clear his sewer pipe and to reline to the sewer main line. Motion: Deny Claim Number 07-28, Joe W. Turner, Jr., and direct Staff to send notice thereof to the Claimant. 5. AUTHORIZATION FOR THE STATE TO PURCHASE ONE RIDING LAWNMOWER Authorize the General Services Department of the State of California to purchase one current model year Grasshopper riding lawnmower on behalf of the City of Tustin. Motion: Adopt resolution. RESOLUTION NO. 07-75 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA AUTHORIZING THE DEPARTMENT OF GENERAL SERVICES OF THE STATE OF CALIFORNIA TO PURCHASE CERTAIN ITEMS REGULAR BUSINESS ITEMS 6. INTERNET VIDEO STREAMING OF CITY COUNCIL AND COMMISSION MEETINGS The City Council has expressed an interest in having City Council and Commission meetings available on the Internet for public viewing. Further appropriations will be required depending on the number of meetings the City Council wishes to stream. The following options include the initial capital and installation expenses and the first year's maintenance. 1. City Council Meetings $71,000 2. Council and Planning Commission $86,200 3. Council/Planning/Audit Commission $99,700 City Council Meeting Minutes October 2, 2007 Page 3 of 5 4. Council/Planning/Audit/Community Services Commission $111,300 Motion: It was moved by Councilmember Palmer, to approve option No. 4 (web streaming City Council, Planning, Audit, and Community Services Commission meetings). Councilmembers Davert and Kawashima opposed. Mayor Pro Tem Amante suggested approving option No. 2 (Council and Planning Commission at a cost of $86,200) and budget for next fiscal year to include Audit and Community Services Commissions. Revised Motion: It was moved by Councilmember Palmer, seconded by Councilmember Davert, to approve option No. 2 (web streaming City Council and Planning Commission meetings). Motion carried 4-1 (Councilmember Kawashima opposed). 7. LEGISLATIVE REPORTS SB375 -Regional Comprehensive Plan would include environmental impact reports, air quality, greenhouse gas, reclamation of water, density etc., little control at local level. Councilmember Bone and Mayor Pro Tem Amante encouraged residents to write letters of opposition to legislators, governor, and OCCOG on this issue. Council concurred to send letter of opposition. SECOND PUBLIC INPUT -Bernie Miller thanked staff on help with different issues; commented on police retirement system and suggested pay increases to retain senior officers. OTHER BUSINESS AND COMMITTEE REPORTS Councilmember Kawashima: • Announced Tustin Tiller Days event this weekend and invited everyone to attend. Councilmember Palmer: • Met with Senior Center Advisory Board, kitchen project moving ahead, high demand for senior services; • Thanked Chamber of Commerce for golf tournament; • Congratulated Tustin Golf Course on receiving Best Golf Course in OC award; • Water report -water usage still high, more well options needed in City; and • Co-hosted event with State Board of Equalization member Michelle Steele, Representative Dick Ackerman and Assemblyman Chuck Devore on non-profit tax issues. Councilmember Davert: • Announced Tustin Tiller Days and Chamber of Commerce Pancake Breakfast at 7:30 City Council Meeting October 2, 2007 Minutes Page 4 of 5 a.m.; • Orange County Fire Authority Board, confirmed appointment to Executive Committee, Tustin Fire Stations will host open house on October 13; • Orange County Sanitation District developing policy direction; • Congratulated Mayor Pro Tem Jerry Amante who will be sworn in as 2nd Vice President of Orange County League of Cities; and • Invited all to attend workshop on parking issues to be held October 16 at 3:00 p.m. Mayor Pro Tem Amante: • Looking forward to Tustin Tiller Days event; • Attended San Diego City Council meeting on TCA toll extension, they opposed project because its inherentl~r incompatible, encouraged all to attend Coastal Commission meeting on the 11 t to speak out; • Attended Mayor's Round Table meeting with Anaheim and Santa Ana mayors, RHNA topic discussed; • Special meeting of TCA, authorized $100 million for coastal camp site improvements, Federal lease to expire 2021; and • Will meet with Mayor from Irvine on Light Rail project to connect to Great Park. Mayor Bone: • Attended meeting on Regional Transportation Plan, discussed goods movement in ports of Los Angeles and Long Beach, plan to be completed by February 2008; • Gave MAGLEV presentation to planning committee of OCTA, well taken by OC Supervisor Moorlach & Santa Ana Mayor Pulido; • Tustin Metrolink station will have cameras installed to monitor area; Tustin station ranked 3rd in ridership; • Thanked JT Schmits and colleagues for birthday celebration; • Suggested looking into using sensors on shopping carts; • Tomorrow will be at Heideman Elementary School to welcome kids for "Walk to School" Day; • Requested City Clerk cancel 2nd meeting in December; and • Tustin Tiller Days celebrating 50th Anniversary.
