HomeMy WebLinkAboutCC RES 78-0608 lO 16 l? 3.8 ~0 ~6 ~8 ~9 ~0 RESOLUTION NO. 78-60 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING THE CITY'S PARTICIPATION IN A JOINT RISK MANAGEMENT AGENCY. WHEREAS, the City has been subjected to sharply increased costs in providing for its liability, worker's compensation, and employee medical ri sks; and WHEREAS, the City has participated in the planning, stages of a Joint Powers Risk Management Agency designed to reduce the cost and frequency of such risks; and WHEREAS, the City Council has approved in principle the establish- ment of a Joint Powers Agency for risk management purposes; and WttEREAS, the consultants retained by the seventeen participating cities have prepared a Joint Powers Agreement, By-Laws for operation of the doint Agency, and estimated costs of operation; and WHEREAS, based on the estimated cost figures, substantial cost saving can be realized; and it appears that a ~HEREAS, if final cost figures are not equal to or less than the consultant's cost estimates, the City has the option of withdrawing its consen't to participate in the Joint Powers Agency;. NO¥1, THEREFORE, resolves as follows' the C i ty Count i 1 of the C i ty of Tust in hereby 1. That the City of Tustin agrees to join and participate in an Orange County Cities Risk Hanagement Agency, as defined by the Joint Powers Agreement and By-Laws prepared by the Risk Man- agement Group, and approved by participating city representatives, provided that the total cost of participation is equal to or less than the cost esti~.~ates submitted by The Risk Management Group, as attached here to. 2. That the City reserves the right to withdraw its consent to enter into said Agreement if participation costs are greater than those submitted by The Risk Management Group. 3. That the City Administrator is authorized to execute said Joint Powers Agreement on the conditions set forth above. 4. That the City Administrator be appointed as the City's repre- sentative to the Risk Manager,~ent Board, and the Finance Director be appointed as the City's alternate representative. held on the ATTEST.
