3 CODE SECTION 6104 ENTITLED "PROHIBITION OF-
LOITERING SO AS TO OBSTRUCT PASSAGE" TO TITLE 6
4 "PUBLIC WELFARE" TO THE MUNICIPAL CODE,

PROHIBITING LOITERING WHICH OBSTRUCTS THE
5 PASSAGE OF PUBLIC RIGHTS OF WAY

? The City Council of the City of Tustin hereby ordains as
follows:

Section 1: Code Amendment

Municipal Code Section 6104, entitled "Prohibition of
'10 Loitering So As To Obstruct Passage," is hereby added to the
11 Municipal Code to read as follows:
"Section 6104. Prohibition of Loiterinq So As To
12 Obstruct Passaqe
13 a. Public Property. No person, after first being
warned by a law enforcement officer, shall loiter, stand,
14 sit or lie in or upon any public street, sidewalk, curb,
crosswalk, walkway area or mall so as to hinder or
15 obstruct the free passage of pedestrians or vehicles
thereon; nor shall any person block, obstruct or prevent
16 the free access to the entrance of any building open to
the public.
b. Private Property Open to the Public. No person
18 after first being warned by a law enforcement officer, or
where a sign or signs have been posted in accordance with
19 this section, shall loiter, stand, sit or lie in or upon
20 any portion of private property utilized for public use,
so as to hinder or obstruct the free passage of
pedestrians or vehicles thereon; not shall any person
21 block, obstruct or prevent the free access to the
entrance of any building open to the public."
PASSED ANDADOPTED at a regular meeting of the City Council of
24 the City of Tustin held on the 3rd day of June, 1991. , 1991.

Mary E. Wynn, City Clerk and ex-officio Clerk of the City Council of
the City 'of Tustin, California, does hereby certify that the whole
number of the members of the City Council of the City of Tustin is
five; that the above and foregoing Ordinance No. 1069 was duly and
regularly read and introduced at a regular meeting of the City Council
held on the 20th day of May, 1991, and was given its second reading and
duly passed and adopted at a regular meeting held on the 3rd day of
June, 1991, by the following vote:
