HomeMy WebLinkAboutORD 1030 (1989) 1 2 ORDINANCE NO. 1030 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING ZONE CHANGE 89-02, TO j~ CHANGE THE LAND USE DESIGNATION OF THE FIRST STREET SPECIFIC PLAN FROM "OFFICE AS PRIMARY USE" TO 5 "COMMERCIAL AS PRIMARY USE" ON THE PROPERTY LOCATED AT 640 WEST FIRST STREET. The Ct~y Council of the Ctty of Tusttn does hereby ordain as follows: 7 I. The City' Counct1 finds and determines as follows: 8 A. That a proper application, (Zone Change No. 89-02) has been g filed on behalf of the David Melilli Company to change the la~rj use designation of the First Street Specific Plan from "Office 10 as Primary Use" to "Commercial as Primary Use" on the property located at 640 West First Street legally described as Lot 5, 11 Tract 334. 12 B. That a public hearing was duly called, noticed and held on said application on August 28, 1989 and September 18, 1989. 13 C. That a zone change should be granted for the following reasons: 1. That the proposed '~one Change is consistent with the 15 General Plan, particularly the Land Use Element which identifies this property with a commercial land use 16 designation on the land use map. 17 2. That the proposed Zone Change is consistent with provisions of the First Street Specific Plan related to encouragement 18 for retail uses, consolidation of smaller parcels, and providing reciprocal access between parcels. 19 3. That the proposed Zone Change is in the best interest of 20 the public health, safety, and welfare of the surrounding neighborhood and property by providing orderly development 21 and compatible land uses with the adjacent retail office, and multi-family land uses. 22 D. A Negative Declaration has been prepared for the project in 23 accordance with the California Environmental Quality Act. 25 26 27 1 2 Ordtnance No. 1030 Page two 5 ZZ. The City Councll hereby approves Zone Change No. 89-02 to change the land use designation of the Ftrst Street Spectflc Plan from "Office 6 as Prtmary Use" to "Commercial as Primary Use" on the property located at 640 West Ftrst Street and legally described as Lot 5 of 7 Tract 334, as shown on the attached Exhtbtt A. 8 PASSED AND ADOPTED at a regular meettng of the City Counc11, held on the 2nd day of October , 1989.
