HomeMy WebLinkAboutORD 1012 (1988) 1 ORDINANCE NO. 1012 2 AN ORDINANCE OF THE CITY COUNCIL OF 3 THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE 4 RELATIVE TO POLITICAL SIGNS . 5 The City Council of the City of Tustin does hereby 6 ordain that Section 9483, Political Signs, of the Tustin City Code is hereby amended to read as follows: 7 "9483 POLITICAL SIGNS 8 Political signs having to do with any issue, candidate 9 or group of candidates in any district, municipal, county, state or federal election shall be permitted subject to the 10 following provisions: 11 (1) No person shall install or maintain or cause to be installed or maintained any sign which simulates 12 or imitates in size, color, lettering or design any traffic sign or signal, or which makes use of 13 words "STOP," "LOOK " "DANGER," or any other W ' ' ' words, phrases, symbols, or characters in'such a 14 manner as to interfere with, mislead or confuse traffic. 15 (2) Unless authorized by specific approval by the City 16 Council, no person except a public officer in performance of a public duty, shall affix by any '17 means any form of sign on any public property or right-of-way, including a street, median, island, 18 parkway (except as permitted below),-sidewalk, traffic signal, traffic signal post, traffic sign 19 post, traffic control sign post, any other traffic control device, utility pole or tree. (3) It shall be unlawful for any person to exhibit, 21 post or display, or cause to be exhibited, posted, or displayed upon any sign, anything of an ob- 22 scene, indecent or immoral nature or unlawful activity. (4) Signs consisting of any moving, swinging, rotat- 24 ing, flashing, blinking, scintillating, fluctuat- ing or otherwise animated light are prohibited. (5) The permission of the property owner is required 26 for signs on private property. 27 (6) Political signs are only authorized in parkways :=" (defined as the area between the curb line and the 28 private property line), subject to the following WOODRUFF 1 LAW 1 restrictions, procedures and conditions: 2 (a) No more than three (3) political signs shall be permitted in the parkway abutting any one 5 parcel 'of property. 4 (b) Signs shall be limited to four -(4) square feet in size and four (4) feet in height. 5 (c) Signs shall require the permission of the 6 abutting property owner. 7 (d) Signs shall not be attached in any manner to any traffic signal, traffic signal post, traffic 8 sign post, traffic control sign post, any other traffic control device, utility pole, or tree or 9 placed so as to impede pedestrian walkways or con- stitute a hazard to or endanger persons using the 10 sidewalks. 11 (e) Signs shall be located so as not to obstruct the vision of motorists and shall be prohibited in 12 any area designated by the City Engineer as a hazardous area. 15 (f) Any person, party or group posting such signs 14 shall be liable to the City of Tustin, private property owners and the general public for any 15 injury to persons or property resulting from the- placement and maintenance of such signs. 16 (7) Signs in violation of this Code shall be' removed 17 by the City and destroyed if not claimed by the owner within forty-eight (48) hours and payment 18 made to the City for the direct costs incurred in the removal of such signs. 19 (8) Any person who intentionally defaces, obliterates, 20 tears down, or destroys any political sign installed in accordance with the provisions of 21 this Code shall be charged pursuant to the General . Penalty provisions of this Code."
