HomeMy WebLinkAboutORD 0916 (1984)1 ORDINANCE NO. 916 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REZONING THE PROPERTIES ON THE NORTHEAST 3 CORNER OF SEVENTEENTH STREET AND CARROLL WAY (ASSESSORS PARCEL NUMBERS 395-142-05 THROUGH 395-142-09) FROM RETAIL 4 COMMERCIAL (C-1) DISTRICT TO COMMERCIAL GENERAL-PLANNED UNIT DEVELOPMENT (CG-PUD) DISTRICT 5 The City Council of the City of Tustin does hereby resolve as follows: 0 I. The City Council finds and determines as follows: ? A. That a proper application, (Zone Change 84-3) has been filed 8 by Barry Watkins on behalf of Tustin Properties, to change the zone for the properties on the northeast corner of 9 Seventeenth Street and Carroll Way (Assessors Parcel Numbers 395-142-05 through 395-142-09). The request is to change the 10 zone designation from Retail Commercial (C-1) District to Commercial General -P 1 anned U nit Development ( CG-PUD ) ]1 District. 19, B. That the Planning Commission recommended approval of Zone Change No. 84-3 on July 9, 1984 by the adoption of Resolution 13 No. 2168. 14 C. That a public hearing was duly called, noticed and held on said application. 15 D. That a zone change should be granted for the following 16 reasons: 17 1. The proposed zone designation is in conformance with the Land Use Element of the Tustin Area General Plan. 2. The Planned Unit Development designation will provide 19 greater review authority of any proposed development for the properties. 20 D. A Negative Declaration has been filed in conformance with the 9.1 requirements of the California Environmental Quality Act. 22 E. Development of subject property shall be in accordance with the policies adopted by the City Council; Uniform Building 23 Codes as administered by the Building Official; Fire Code as administered by the Orange County Fire Marshal; and street 24 improvement requirements as administered by the City Engineer. 25 F. Final development plans shall require the review and approval 20 of the Director of Community Development. 27 28 Ordinance No. 916 Page 2 G. A Negative Declaration has been filed in conformance with the requirements of the California Environmental Quality Act and is hereby approved. II. The City Council hereby approves Zone Change No. 84-3 to designate the Commercial General-Planned Unit Development (CG-PUD) District for the properties located on the northeast corner of Seventeenth Street and Carroll Way (Assessors Parcel Numbers 395-142-05 through 395-142-09).
