HomeMy WebLinkAboutORD 0909 (1984) ORDINANCE NO. 909 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING PART 8, CHAPTER 1, 2 SECTION 81.03 OF THE TUSTIN MUNICIPAL CODE, ESTABLISHING AMENDMENTS OF THE 1979 UNIFORM 3 BUILDING CODE t The City Council of the City of Tustin does hereby ORDAIN as follows: 5 Chapter 51 of the Appendix is amended by amending Section 5108, 0 Permits - Certificate of Inspection, to read as follows: 7 (a) Permits Required. It shall be unlawful to hereafter install any new elevator, moving walk, escalator, . or 8 dumbwaiter, to make major alterations tO any existing elevator, dumbwaiter, escalator or moving walk without 9 having first obtained a permit for such installation from the State of California Division of Industrial 10 Safety. Permits shall not be required for maintenance or minor alterations. (See, ANSI Code, Sections 1002, 11 1200.1b and 1201.1b. ). 19. (b) Certificates of Inspection Required. It shall be unlawful to operate any elevator, dumbwaiter, escalator 1~) or moving walk without a current Certi fi care of Inspection issued by the State of California Department li of Industrial Safety. Such Certificate shall be issued annual ly upon payment o9 prescri bed fees and the 15 presentation of a valid inspection report indicating that the conveyance is safe and that the inspection was 16 made within the previous six months. Certificates shall not be issued when the conveyance is posted as unsafe 17 pursuant to Section 5114. 18 EXCEPTION: Certificates of Inspection shall not be required for conveyances within a dwelling unit. 19 20 (c) Application for Permits. Application for a permit to install shall be made on forms provided by the State of California Division of Industrial Safety and the permit 21 shall be issued to an owner upon payment of prescribed permit fees. 22 (d) Application for Certificates of Inspection~ Application 23 for a Certificate of Inspection shall be made by the owner of an elevator, dumbwaiter, escalator of moving 21 walk. Applications shall be accompanied by an 25 inpsection report as described in Section 5113. 26 27 28 Ordinance No. 909 · Page 2 2 Chapter 51 of the Appendix, Section 5113, Requirements for Operation and Maintenance, is amended by amending Section 5113(b) and (3), to 3 read as follows: 4 (b) Annual Inspections and Tests. Except in dwelling units, elevators, escalators and moving walk shall be inspected 5 at least once every 12 months by an inspector for the State of California Division of Industrial Safety. Such 6 inspections shall include tests of the car and counterweight safeties, gorenots and oil buffers to be 7 made in accordance with Rule 1001.1b of the ANSI Code. 8 (e) Inspection Reports. After each required inspection, a full and correct report of such inspection shall be g filed with the State of California Division'of Industrial Safety. 10 Chapter 51 of the Appendix is amended by amending Section 5144, 11 Unsafe Conditions, to read as follows: 12 When an inspection reveals an unsafe condition, the inspector for the State of California Division of Industrial Safety 13 shall immediately file with the owner and the building official a full and true report of such inspection and such 14 unsafe condi ti on. If the inspector for the State of California Division-of Industrial Safety finds that the 15 unsafe condition endangers human life, he shall cause to be placed on such elevator, escalator or moving walk in a 16 conspicuous place, a notice stating that such conveyance is unsafe. The owner shall see to it that such notice of unsafe 17 condition is legibly maintained where placed by the inspector. The building inspector shall also issue an order 18 in writing to the owner requiring the repairs or alterations to be made to such conveyance which are necessary to render 19 it safe and may order the operation thereof discontinued unti 1 the repairs or al terati ons are made or unsafe 20 conditions are removed. A posted notice of unsafe conditions shall be removed only by the building inspector when he is 21 satisfied that the unsafe conditions have been corrected. 22 For purposes of clarification, all cross-references to provisions of the 1979 Uniform Buildin Code pertaining to Requirements for 23 Operation and Maintenance and Unsafe Conditions, remain in full 25 26 27 28 Ordinance No. 909 Page 3 force and effect. The State inspectors shall enforce the local standards, codified in the UBC, which are more restrictive than State standards. A Negative Declaration for Amendment to Part 8, Chapter 1, Section 8103 of the Tustin hiunicipal Code is hereby approved in conformance with the requirements of the California Environmental Quality Act.
