HomeMy WebLinkAboutORD 0890 (1983) ORDINANCE NO. 890 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF I TUSTIN, CALIFORNIA, ADOPTING THE SOUTH/CENTRAL REDEVELOPMENT PLAN 2 3 The City Council of the City of Tustin, California, does hereby :ordain as follows: I. The. City Council finds and determines as follows: 5 A. Due notice was given and a joint Redevelopment Agency - City Council 6 public hearing was conducted on July 18, 1983, for the purpose of adopting the South/Central Redevelopmerit Project Plan. 7 B. A report was furnished the City Council by the Redevelopmerit Agency 8 pursuant to Section 33352 of the Community Redevelopment Law (Health & Safety Code), which included the reports of the Planning Commis- 9 ston and Project Area Committee, and recommending a finding of a Negative Declaration of Environmental Impact based on mitigating 10 factors. 11 C. The purpose of the City Council in adopting the South/Central Rede- velopment Plan. is to aid in the revitaltzation and redevelopmerit of 12 blighted properties by the primary means of constructing public works improvements to be financed from incremental tax revenues 13 generated within the project areas. li D. The Redevelopment P1 an for the South/Central Area Redevelopmerit Project on file with the City Clerk of the City of Tustin is incor- 15 porated herein by reference. 16 E. The above referenced redevelopment plan is the official redevelop- merit plan of the project areas. 17 F. The City Council has reviewed the environmental assessment of the 18 Redevelopmerit Plan and finds on the basis of an Initial Study and mitigating measures related to noise, traffic, and circulation, and 19 comments received during the public review process, that the project will not have a significant effect on the environment. 20 I I. The City Counci 1 further fi rids and determines as fol 1 ows: 21 A. The findings and determinations required by Section 33367(d) of the 22 Health & Safety Code of .the State of California are as follows: 23 1. The project areas are blighted areas, the redevelopmerit of which is necessary to effectuate the public purposes declared in the 2i California Community Redevel opment Law. 25 2. The redevelopment plan provides for the redevelopment of the areas in conformance with the California Community Redevelopment 26 Law and in the interests of public peace, health, safety, and welfare. 27 ' 28 Ordinance No. 890 Page 2 1 2 3. The adoption and carrying out of the redevelopment plan is economical ly sound and feasi bl e. 3 4. The redevelopment plan conforms to the general plan of the com- 21 munity subject to an amendment of the Orange County Master Plan of Arterial Highways for the extension of Newport Avenue to 5 Edi nger Street. 0 5. The carrying out of the redevelopment plan would promote the . public peace, health, safety, and welfare of the community and 7 would effectuate the purpose and policy of the California Com- munity Redevel opment Law. 8  6. The condemnation of any real property would be accomplished only 9 if necessary. for the execution of the redevelopment plan and adequate provisions have been made for payment for property to 10 be acquired as provided by law. ll 7. The agency has a feasible method and plan for the relocation of families and persons who may be displaced from the project areas 12 as a result of plan implementation which may result in the tem- porary or permanent displacement of any occupants of housing 13 facilities in the project areas. li 8. Plans and projects are being formulated and developed for hous- ing accommodations within and without the project areas which 15 are not generally less desirable in regard to public utilities and public and commercial facilities and at rents or prices lO within the financial means of the families and persons who may be displaced from the project areas, decent, safe, and sanitary 17 dwellings equal in number to the number of and available to such displaced families and persons and reasonably accessible to 18 their pl aces of employment. 19 9. All noncontiguous areas of a project area are either blighted or necessary for effective redevelopment and are not included for 20 the purpose of obtaining the allocation of taxes from such area pursuant to the redevelopment law without other substantial 21 justification for their inclusion~ I)2 10. Inclusion of any lands, buildings, or improvements which are not detrimental to the public health, safety, or welfare is neces- 93 sary for the effective redevelopment of the area of which they are a part; that any such area included is necessary for effec- 2~ tive redevelopment and is not included for the purpose of obtaining the allocation of tax increment revenues from such 25 area without other substantial justification for its inclusion. The elimination of blight and the redevelopment of the project areas could not be reasonably expected to be accomplished by private enterprise acting alone without-the aid and assistance 3 of the agency. I B. The City Council is satisfied' that permanent housing facilities will be available within three years from the time occupants of the 5 project area are displaced and that pending the development of such facilities there will be available to such displaced occupants 6 adequate temporary housing facilities at rents comparable to those in 'the community at the time of the displacement, and/or rent 7 supplements will be available. 8 C. The City Council is convinced that the effect of tax increment 9 financing, due to the limited scope and tax revenues of the project areas, will not cause a severe financial burden or detriment on any 10 taxing agency deriving revenues from the tax increment project areas. 11 III. The City Council, based on the findings contained with the Report of the 12 Redevel opment Agency, prel imi nary plans, and related reports and recom- mendations, hereby: A. Approves a Negative Declaration pursuant to the provisions of the ~ li California Environmental Quality Act. 15 B. Approves and adopts the Redevelopment Plan for the South/Central Area Redevel opment Project.
