HomeMy WebLinkAboutORD 1369 (2010)ORDINANCE NO. 1369 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, DESIGNATING THE OFFICIAL ZONING MAP OF THE CITY OF TUSTIN. The City Council of the City of Tustin does hereby ordain as follows: The City Council finds and determines as follows: A. That California Government Code Section 65800 et seq. requires each city to adopt, administer and implement zoning laws, ordinances, rules and regulations to implement the community's adopted general plan. B. That the Tustin City Council has adopted zoning laws that divide the City of Tustin into zoning districts where uniform zoning regulations apply and differentiate one type of zone district from those in other types of zone districts. C. That the boundaries of the zoning districts designated' and established in the City of Tustin's adopted Zoning Code are required by 'Mustin City Code Section 9213c to be illustrated on a map entitled "Zoning Map of the City of Tustin." D. That a computerized Geographic Information System (GIS) version of the "Zoning Map of the City of Tustin" has been prepared that is clearer, more accurate, uses color gradations to depict land use intensity, and is easier to use and understand than the current pen and ink version of the Zoning Map. E. That on October 27, 2009, the Tustin Planning Commission adopted Resolution No. 4125 recommending that the City Council adopt Ordinance No. 1369 designating the GIS Zoning Map as the official "Zoning Map of the City of Tustin." F. That proposed Ordinance No. 1369 is exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the State CEQA Guidelines. This section provides that a project is exempt from environmental review where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The proposed amendment deals only with procedural matters and would not change any development or use standards, cause any development to occur, or otherwise directly or indirectly affect the environment. G. That proposed Ordinance No. 1369 is reasonably necessary to protect the health, safety, and welfare of the citizens of the City of Tustin. Ordinance No. 1369 Page 1 of 3 II. The City Council of the City of Tustin hereby ordains the GIS Zoning Map dated December 1, 2009, as shown in Exhibit 1 and displayed before the City Council on this date as the Official "Zoning Map of the City of Tustin" to be administered and maintained henceforward by the Community Development Department on this date as the Official "Zoning Map of the City of Tustin" to be administered and maintained henceforward by the Community Development Department.
