2 AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, APPROVING THE RE-ZONING
3 OF CERTAIN PROPERTIES FROM C-1 TO CG
DISTRICT AT THE NORTHEASTERLY CORNER OF
4 NEWPORT AVENUE AND MITCHELL AVENUE
5 The City Council of the City of Tustin does hereby ordain as
fol 1 ows:
I. The City Council finds and determines as follows:

A. That a proper application, (Zone Change 82-2), has
8 been filed by Taco Bell on behalf of Realty Income
Proprties, for a zone change from the Retail Commercial
9 (C-1) District to Commercial General (CG) District for
the property described in Exhibit "A" attached hereto
lO and incorporated herein by this reference as though set
forth herein in full.
B. That a public hearing was duly called, noticed and
12 held on said appl i cati on.
13 C. That a zone change should be granted for the follow-
ing reasons:

1. The Commercial General District is in conformance
15 with the commerical land use designation of Tustin
Area General P1 an.

2. The Commercial General District authorizes a broader
17 range of permitted uses in an area of increasing
commerical activity.

D. Development of subject property shall be in
19 accordance with the policies adopted by the City
Council; Uniform Building Codes as administered by the
20 Building Official; Fire Code as administered by the
Orange County Fire Marshal; and street improvement
"21 requirements as administered by the City Engineer.
22 E. Final development plans shall require the review and
approval of the Community Development Director.

F. That this project is categorically exempt from the
24 requirements of the California Environmental Quality
Act.

3 II. The City Council hereby approves Zone Change 82-2 for
the above described properties {Exhibit "A") from
4 Retail Commercial (C-1) District to Commercial
General (CG) District.

PASSED AND ADOPTED at a regular meeting of the City Council held on
8 the 20th day of September , 1982.
