HomeMy WebLinkAboutORD 0877 (1982) ORDINANCE NO. 877 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, APPROVING THE RE-ZONING 2 OF THE PROPERTIES LOCATED AT 17311 AND 17341 MCFADDEN STREET FROM MULTIPLE-FAMILY 3 RESIDENTIAL (R-3)DISTRICT TO COMMERCIAL GENERAL-PLANNED UNIT DEVELOPMENT (CG-PUD) 4 DISTRICT 5 The City Council of the City of Tustin does hereby ordain as 6 follows: 7 I. The City Council finds and determines as follows: 8 A. That a proper application, (Zone Change 82-4), has been filed by the City of Tustin, for a zone change from 9 Multiple-Family Residential (R-3) District to Commercial General-Planned Unit Development (CG-PUD) District for lO the property described in Exhibit "A" attached hereto and incorporated herein by this reference as though set 11 forth herein in full. 12 B. That a public hearing was duly called, noticed and held on said application. 13 C. That a zone change should be granted for the follow- 14 ing reasons: 15 1. The Commercial General District is in conformance with the commerical land use designation of Tustin 16 Area General Plan. 17 2. The Commercial General District authorizes a broader range of permitted uses and provides the opportunity for review of unclassified uses for appropriateness 18 of site and development. 19 D. Development of subject property shall be in 20 accordance with the policies adopted by the City Council; Uniform Building Codes as administered by the 21 Building Official; Fire Code as administered by the Orange County Fire Marshal; and street improvement 22 requirements as administered by the City Engineer. 23 E. Final development plans shall require the review and approval of the Community Development Director. 24 F. That a Negative Declaration was previously approved 25 to comply with the requirements of the California Environmental Quality Act. 26 G. Uses within the District are subject to approval of a 27 Use Permit 28 Ordinance No. 877 Page 2 1 2 II. The City Council hereby approves Zone Change 82-4 for the above described properties (Exhibit "A" ) from 3 Multiple-Family Residential (R-3) District to Commercial General -P1 anned Unit Development (CG-PUD) District. 4 PASSED AND ADOPTED at a regular meeting of the City Council held on 5 the 20th day of September , 1982. 7 8 Ri'c'hard B'.
