ORDINANCE NO. 875 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, 5 AMENDING TttE TUSTIN CITY CODE RELA- TIVE TO THE REGULATION OF SECURITY 4 BUSINESSES 5 6 The City Council of the City of Tustin, California, ordains as follows: 7 Section 1: Part 1 of Chapter 5 of Article 3 of the Tustin 8 Cit~ Code is hereby amended to read as follows: 9 "PART 1 10 BURGLARY AND ROBBERY ALA~4 SYSTEMS 11 3511 GENERAL 12 It shall be unlawful for any person or entity to operate in the City of Tustin as an Alarm 13 Company Operator or as an Alarm Agent, as said terms are defined at Business and Pro- 14 fessions Code Sections 7521(e) and (f) respectively, without prior comDliance with 15 the Private Investigator Act contained at Business and Professions Code Section 7500 16 et' seq. 17 3512 REGISTRATION 18 All Alarm Agents shall register their names and file a cooy of their state identification 19 cards with the License and Permit Coordinator of the Cit~[ of Tustin prior to conducting such 20 business. 21 3513 FALSE ALARMS 22 The owner or lessee of any alarm system shall be assessed a fee as shall be determined by 23 resolution of the City Council of the City of Tustin for each false alarm transmitted to the 24 Police Deoartment. For billing. purposes, said fee shall be charged for each false alarm 25 occurring during a calendar month. The Police Chief shall establish a procedure of notification 26 and billing for each false alarm. Such fee shall be paid to the-City Treasurer for deposit 27 in the general fund. For the Durposes of this "false alarm" means the activation of Section, 28 any alarm system through mechanical failure, 1 malfunction, mechanical or electrical defect, accidental tripping, misoperation, misuse, 2 or the neglect or negligent act of the owner or lessee of an alarm svstem, or of his employ- 5 ees or a~ents and where no violation of law occurred requiring a response bv the Police 4 DePartment. False alarms shall not include alarms caused by external causes beyond the 5 control of the owner or lessee of the alarm system such as earthquakes, violent winds, or 6 floods. Whether "no violation of law occurred", as used in this Section, shall be decided bv 7 the oolice officer who responds to the alarm. This determination of the responding officer 8 shall be final." 9 10 Section 2: Part 2 of Chaoter 5 of Article 3 of the Tustin City Code is amended to read as follows: 11 "PART 2 PRIVATE PATROL OPERATORS 13 3520 PRIVATE PATROL OPERATORS 14 It shall be unlawful for any oerson or entity 15 to operate as a Private Patrol Operator as such term is defined at Business and Profes- 16 sions Code Section 7521(b) within the City of Tustin without first obtaining such permits !? as are required pursuant to the Private Inves- tigators Act contained in Business and Pro- 18 lessions Code Section 7500 'et' seq. This permit requirement shall be in add3.~i~'K to any o'ther 19 business license or fee required b~ the City of Tustin. All Private Patrol Operators and t~eir 20 employees or agents shall register their names and a file copy of their state identification 21 card with the License and Permit Coordinator. ~2 3521 STREET PATROL SERVICE ~3 Notwithstanding any other provision contained in this Part, any ~rivate Patrol Operator pro- 24 riding any street patrol. special o~ficer or street patrol service shall be required to 25 acquire a Private Patrol Operator permit from the City of Tustin." Se'Ction 3: Section 3523(a) of the Tustin City Code is 2~ amended to read as follows: ~8 "(a) The applicant shall appear at and present -2- 1 to the License and Permit Coordinator an application containing the information --- 2 required in Section 3522, and proof that the apDlicant has paid the prescribed per- 5 mit fee. Section 1 is correct as set forth, with the exception that on page 1, line 15-1/2 "7500" should be changed to "7512". 2. Section 2, page 2, lines 10 and 10-1/2 should read: "Section 2: Sections 3520 and 3521 of the Tustin City Code are amended to read as follows:" Page 2, line l8 "7500" should be changed to "7512".
