HomeMy WebLinkAboutORD 0862 (1981)1 ORDINANCE NO. 862 2 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING ARTICLE 9, 5 CHAPTER 2 OF THE TUSTIN CITY CODE RELATIVE TO LAND USE AND ZONING 4 5 The City Council of the City of Tustin, California, does hereby ordain that Article 9, Chapter 2, Part 2 of the Tustin 6 City Code shall be and is amended as follows: 7 Section 1. Section 9224g.1. is hereby amended to read as follows: 8 "1. Height Limit: 9 (a) None, except as limited herein below. 10 (b) When a lot in the PD district abuts 11 at any point along its property lines, or is directly across a street or alley 12 from, property zoned R-A, E-4 or R-1 (developed or undeveloped), no main 13 building shall be erected on said PD lot to a height to exceed one (1) 14 story, and/or twenty (20) feet, whichever is more restrictive, within 15 one hundred fifty (150) feet of said R-A, E-4 or R-t zoned property, unless 16 the Planning Agency shall grant a conditional use permit thereof. 17 (c) Further, no main building shall be 18 erected on said PD lot to a height to exceed three (3) stories, and/or 19 fifty (50) feet, whichever is more restrictive, within three hundred 20 (300) feet of said R-A, E-4 or R-1 zoned (developed or undeveloped) 21 property, unless the Planning Agency shall grant a conditional use permit 22 thereof." 23 Section 2. Section 9225 is hereby amended by adding thereto subsection c to read as follows: 24 "c. MaximumHeight-Exception. 25 Notwithstanding any provision to the contrary 26 contained in this Section 9225, when a lot in the R-2 district abuts at any point along its 27 property lines, or is directly across a street or alley from, property zoned R-A, E-4 or R-1 28 (developed or undeveloped), no main building 1 shall be erected on said R-2 lot to a height to exceed one (1) story, and/or 2 twenty (20) feet, whichever is more re- strictive, within one hundred fifty ('150) 5 feet of said R-A, E-4 or R-1 zoned property, unless the Planning Agency shall grant a 4 conditional use permit thereof." 5 Section 3. Section 9226 is hereby amended hy adding thereto subsection c to read as follows: 6 "c. MaximumHeight-Exception. Notwithstanding any provision to the contrary 8 contained in this Section 9226, when a lot in the R-3 district abuts at any point along its 9 property lines, or is directly across a street or alley from, property zoned R-A, E-4 or R-1 10 (developed or undeveloped), no main building shall be erected on said R-3.1ot to a height 11 to exceed one (I) story, and/or twenty (20) feet,..whichever is more restrictive, within 12 one hundred fifty (150) feet of said R-A, E-4 or R-1 zoned property', unless the Planning 15 Agency shall grant a conditional use permit thereof." 14 Section 4. Section 9228 is hereby amended by adding 15 thereto subsection d to 'read as follows: 16 "'d. Maximum Height-Exception. 17 Notwithstanding any provision to the contrary contained in this Section 9228,. when a lot in 18 the R-4 district abuts at any point along its property lines, or is directly across a street 19 or alley from, property zoned R-A, E-4 or R-1 (developed or undeveloped), no main building 20 shall be erected on said R-4 lot to a height to exceed one (1) story, and/or twenty (20) 21 feet, whichever is more restrictive, within one hundred fifty (150) feet of said R-A, 22 E-4 or R-1 zoned property, unless the Planning.
