HomeMy WebLinkAboutORD 836 (1980) ORDINANCE NO. 836 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, APPROVING PRE-ZONE 80-1 2 OF THE IRVINE/PETERS CANYON AREA The City Council of the City of Tustin, California does hereby ordain as follows: 5 1. The City Council finds and determains as follows: A. That a proper application NO. PZ 80-1 has been iDitiated 7 on the motion of the City Council for a prezoning from the Orange County Agricultural District to the 8 City of Tustin Planned Community District for the property bounded by the easterly existing boundary 9 to the proposed Myford Road/Weir Canyon Road, northerly of Moulton Parkway to the ultimate city 10 limits, as described in Exhibit "A" and "B" attached hereto and incorporated herein by this reference as 11 though set forth herein in full. 12 B. That an Environmental Impact Report (78-3) for the requested changes was prepared and certified by the 15 City Council on May 7, 1979. An Environmental Impact Report (79-ER-0040) for the requested changes was 14 prepared and certified by the City Council of the City of Irvine on September 23, 1980. 15 C. That a public hearing was duly called, noticed, and 16 held on said application on October 20, 1980. 17 D. That the prezoning should begranted for the following reasons; 18 1. The prezoning will establish a mutual understanding 19 between the land owner, residents of the area, and the City of Tustin as to potentials for develop- 20 ment and enable the land use planning in advance of preparation of precise development plans. 21 2.- The prezoning will enable the development. of public 22 works improvement plans related to land use dev- elopment patterns and circulation requirements. 3. The subject area is within a flood plain and the 24 prezoning will enable the application of develop- ment standards related to flood plain hazards. 4. The prezoning will enable the preparation of pre- 26 cise development plans to maximize the retention of open space and environmental protection. 27 · 5. The proposed prezoning is in conformance with the 28 Tustin Area General Plan. 29 E. Development of the subject property at such time as it is removed from the agricultural preserve shall be 50 in accordance with the policies as in effect at that. time and as adopted by the City Council, to include 51 Uniform Building Code, Fire Codes, street improvement standards, parkland dedication, energy conservation 52 requirements, and such other laws and ordinances as adopted by the State legislature and City of Tustin. 1 F. Prior to the issuance of building permits, a 2 specific plan shall be submitted to the Planning Agency and City Council for review and approval. ~ Said plans may incorporate neighborhood designs with integrated land use patterns to consist of ~ support commercial, mixed residential, public ,,, facilities, and open space. Specific plans shall 5 conform to the following criteria: 6t 1. Aggregate residential densities shall not exceed four dwelling units per gross acre for the- ~ total area. 8 2. Foothill areas northerly of'an alignment with Foothill Boulevard, as shown by Exhibit 1, shall 9 not exceed a density of two dwelling units per gross acre. 3. Site development plans shall accommodate neigh~ 11 borhood public and commercial facilities ade- quate to serve the projected population densities. 4. Site development plans shall accommmodate parkland 15 and open space requirements, including incorpora- tion of trail systems and drainage facilities. 14 5. Mitigation measures, as discussed in the EIR's 15 shall be incorporated into development plans. 16 6. Accommodations shall be made for affordable housing as may be required by applicable laws " 17 and regulations at time of development plan approval. 18 II. The City Council hereby approves PREZONE 80-1 which pre- 19 zones the subject property to the Planned Community Res- idential, Planned Community Commercial, Planned Community ~0 Industrial as shown on Exhibit "A" and "B" and the Zoning Map of the City of Tustin is amended accordingly.
