AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AMENDING CHAPTER 3 OF
ARTICLE 3 OF THE TUSTIN CITY CODE PERTAINING
TO POOL HALLS AND BOWLING ALLEYS.
5 The City Council of the City of Tustin, California, does
6 ordain as follows:
7 Section 1. Tustin City Code Section 3301 is hereby ~epealed
8 Section 2. Tustin City Code Section 3303 subsection b is
9 amended to read as follows:
10 "b Prerequisites to Issuance '
11 When a permit shall be issued for the business
1~ of billiards, pool, bagatelle, bowling alleys,
15 more than five pinball or electronic games, or
1~ other lawful games conducted and carried on for
15 profit and gain, they shall be subject to all
16 conditions contained in this Chapter and like-
17 wise the place where such business shall be
18 carried on, its location, arrangements and
19 suitabilitv for such purposes and the character,
~0 reputation and reliability of the person conduct-
E1 ing such business subject to the consent and
~ approval of the License and Permit Board."
~5 Section 3. Tustin City Code Section 3304 is amended to
~ read as follows:
~5 "3304 GAMBLING PROHIBITED
~6 It shall be unlawful for any games of cards,
~7 dice, or other game~ of chance to be carried
~8 on in any room in which any of the businesses
~9 regulated b~ this Chapter shall be conducted
50 or in any room accessible therefrom."
51 Section 4. Tustin City Code Section 3306 is amended to
5~ read as follows:
1 "3306 LOITERING
2 It shall be unlawful for any person to loiter
5 in or about any room whereby games regulated
4 by this Chapter are being conducted or carried
~ 5 on and upon which such premises alcoholic
6 beverages are sold or dispensed.
7 It shall be unlawful for any Derson or his
8 agents or employees to permit any person under
9 the age of eighteen years to loiter about any
10 room in which any of the businesses regulated
11 by this Chapter shall be conducted or in any
12 room accessible therefrom and upon which premises
15 alcoholic beverages are sold or dispensed."
15 PASSED AND ADOPTED at a regular meeting of the City
16 Council of the City of Tustin on the 17th day of November
17 1980.
