AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, AMENDING PART
4 OF CHAPTER 4 OF ARTICLE 3 OF THE TUSTIN
CITY CODE PERTAINING TO ICE CREAM VENDORS.
5 The City Council of the City of Tustin, California
6 does ordain as follows:
7 Section 1: Section 3441 of the Tustin City C~de is
8 amended to read as follows:
9 "3441. APPLICATION
10 Any person desiring a vendor's permit shall make
11 application in the form prescribed by the License and Permit
_ 12 Board. Applications shall include the following information:
15 (1) The name and address of the applicant;
14 (2) The name and address of all o~mers and
15 officers of the applicant's business and of any other
16 persons having an interest therein;
17 (3) A description of each vehicle proposed~to
18 be operated by the applicant;
19 (4) The name and address of the registered owner
20 of each vehicle proposed to be operated;
21 (5) Evidence of insurance in a form satisfactory
22 to the License and Permit Board;
25 ~6) Evidence of compliance with the provisions
24 of Part 1 of Chapter 1 of Title 4 of the Tustin City
~5 Code pertaining to food and food establishments;
26 (7) The name, address, birthdate, city and state
~7 of birth, physical description and social security num-
b8 ber or vehicle operator's license number of each driver
~9 proposed to operate any vehicle to be licensed;
50 (8) The name, address, birthdate, city and state
51 of birth, physical description, and social security
~2 number or vehicle operator's license number of each
i person, other than a-driver, proposed to ride in, or upon,
Z a vehicle to be licensed; and
3 (9) Such other information as may be required by
~ the License and Permit Board.
5 Any person providing false or misleading information
6 shall be guilty of a misdemeanor. The provision of false or
7 misleading information shall be grounds for denial or revocation
8 of any permit required by this Chapter."
9 Section 2. Section 3442 of the Tustin City Code is
10 amended to read as follows:
11 "3442. INVESTIGATION OF DRIVERS AND VEHICLES
lZ All persons proposed to drive or operate or drive
13 in, on or upon any vehicle to be licensed pursuant to --=
14 this part shall be photographed and fingerprinted at
15 the police department. The police department shall
16 make a record check of each such person and shall make
17 a report thereon to the License and Permit Board, All
18 vehicles proposed to be licensed shall be inspected for
19 safety at the police department'. A person shall be
20 prima facie disqualified to drive or operate or ride in,
Z1 on or upon any vehicle licensed pursuant to this p.art if
22 he has been convicted of a felony or of any offense
23 enumerated in Section 290 of the California Penal Code
24 or in Section 11590 of the Health and Safety Code or of ~
25 any misdemeanor in which ~minor or minors
26 are the primary or common victim of such crimes. The
Z7 License and Permit Board may adopt such requirements
28 and standards for qualification to drive or operate or
29 to ride upon any vehicle licensed pursuant to this
~0 -part as the board deems reasonable."
