Adoption, Articles 5 and 8 are hereby amended as lZ follows: For the purposes of amending the 1976 Editions, Uniform Building Code, Uniform Building Code Standards, Uniform Mechanical Code, Uniform ttousino Code, Uniform Code for the Abate~ ment of Dangerous Buildings and'the Uniform Fire Code which regu- 15 late the erection, construction; enlargement, alteration, repair, moving, removal, conversion, demolition, occupancy, equipment., 16 height, area and maintenance of buildings or structures, Drovi< the maintenance of buildings or structures, provide for the 17 issuance of permits and collection of fees therefor and declare and establish fire districts, adopted and published by the inter- 18 national Conference of Building Officials and the Western Fire Chief's Association, 5360 S. Mechanical Code, Chapter 2, Article 8200, Tustin City Code is amended by the second portion of Page 103 and the first ~5 portion of Page 104 of the 1978 accumulative supplement. "Swimming Pool Code", Chapter 5 is hereby amended by 3 omitting Chapter 5 and substituting the following to read as follows: 4 ARTICLE 8500 - ADOPTION OF THE 1976 U~]IFOPJ.~ SWIMMING POOL CODE 5 'For the purpose of prescribing regulations for the 6 erection, construction, enlargement, alteration, repair', equiDment and use of swimming pools within the City, all of the provisions oI 7 the 1976 edition of the Uniform Swimming Code, adopted and pub- lished by the International Association of Plumbing and Mechanical 8 Officials, 5032 Alhambra Ave., Los Angeles, California 90032, of which not less than three (3) copies ]]ave been and now are filed 9 in the office of the City Clerk of the City of Tustin, are hereby adopted and incorporated herein as fully as though set forth in 10 fu].l herein. 11 ARTICLE 8501 - AMENDMENTS, ADDITIONS AND DELETIONS 1~ The 1976 Edition of the Uniform Swimming Pool Code is hereby amended as follows: (a) Section 8101. Administration 14 Section 1.5, Administrative Authority 15 The administrative authority is the Building 16 Official. 1~ Section 1.7, Violation and Penalties 18 Section 1.7 is omitted. 19 Section 1.11, Cost of Permit ~0 Section 1.11 is omitted. Add a new Section 1.11 to read as follows: 21 ~p~ Sec. 1.11 - Cost of Permit Every applicant for a permit to install, alter 25 or repair a s:./imming pool system or part thereof, shall state in writing on the application form provicled for that purpose, the E4 character of work proposed to be done and the amount and kind in connection therewith, together with such information pertinent 25 thereto as may be required. ~ Such applicant shall pay for each permit at the time of making application, a fee as prescribed in Resolution Z? and at a rate provided for each classification shown therein. 28 Any person who shall comJnence any swimming pool ~-:ork for which a permit is required by this Code without having Z9 obtained a permit therefore shall, if subsequently n~.rp~{t*~c<{ to obtain a permit, pay double the permit fee fixed by the section ~0 for such work, providC, d, however, that this provision shall not al.~l~ly to cxn<:rgex~c:y %.~ork when it shall be demonstrated to the .51 :{atis£act'l. on of thf: Administrative Authority that such work was urgently n<:cessary and t}xat it was no[~ practical to obtain a ZZ permit therefor, before the commencement of the work. In all such 1 Ordinalice No. Page 3 cases a permit must be obtained as soon as it is practical to do s¢ ~ and if there be an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged. 4 Extra Inspections: 5 ~ When extra inspections are necessary by reaso~ 6 of deficient or defective work, or otherwise through fault or error on the' part of the holder of the permit or on the part of 7 his employees, only one such extra inspection shall be made under the regular fees as herein prescribed; and for each and every 8 further extra visit or inspection for which the holder of the permit or his employee is entirely responsible, a fee as prescribe~' 9 by a City Council Resolution. 10 Whenever it shall be necessary to make any addi tional inspection due to the failure or neglect of the applicant 11 give the correct address or location of the work specified in permit when applying therefor, for each additional inspection a ~ fee as prescribed in a City Council Resolution. 15 Section 1.12 14 Section 1.12 is omitted- Add a new Section 1.12 to read as follows: 15 Sec. 1.12 - All Work to Be Inspected All swimming pool installation or alterations 1~ thereto including equipment, piping and appliances related the: shall be inspected by the administrative authority to insure 18 pliance with all the requirements of this code. The various in- spections are as follows: 19 1. Observe excavation, main drain, bonding and Z0 rebar prior to placing concrete. 2. Observe underground drains, piping, electric E1 conduit, rough electric, gas piping, circu- lation piping and D-trap including pressure ~ test of drains and circulation piping, prior to backfilling or covering. ~5 3. Observing enclosure, fencing, concrete, gas pressure test, grading and equipment base ~tl prior to plastering. 4: Final - after pool is complete and in Z5 operation. 26 Section 1.17 - Unconstitutionali.t_X '~ Section 1.17 is omitted - R~ ARTICLE 850~ - GENERAL REQUIREMENTS Z9 Section 310 7~0 Section 310 is omitted. Add a new Nec. 310 to re~d as fol lows: Ordinance No. Page 4 Sec. 310 - Waste Water Disposal No direct or indirect connection shall be made bo-tween any storm drain, sewer, drainage system, seepage pit, underground leaching pit, or sub-soil drainage line, and any line connected to a swimming pool unless approved by the Administrative Authority. Waste water, including filter back wash from a swimming pool, shall be disposed of through a public sewer, a mini-- mum three (3) inch P trap shall be installed on the lower terminus of the building drain and the tail piece from the trap shall extenc a minimum of three (3) inches above finished grade and below fin- ished floor grade. This trap need not be vented. The connection between the filter waste discharge piping and the P trap shall be made by means of an air gap. Plans and specifications for any deviation from the above manner of installation shall first be approved by the Administrative Authority before any portion of any such system is installed. When waste ~.~ater disposal' is to a seeDage pit installation, it shall be installed in accordance with the ap- proval granted by the Administrative Authority. Section 315 Section 315 is omitted. Add a new Sec. 315 to read as follows: Section 315 - Equipment Foundations and Enclosure All mechanical equipment shall be set on a concrete base or slab capable of supporting all of the equipment placed upon it. The equipment shall be secured to the concrete base and the concrete base shall be of such mass so as to resist the stresses produced by seismic lateral forces, Chapter 23, U.'3C. All heating and electrical equipment, unless aDproved for outdoor installation, shall be adequately protected against the weather or installed within a building. All enclosed equipment rooms shall be adequately ventilated. Section 320 Section 320 - Add a new Section 320 to read as fol lows: Section 320 - Piping All piping shall be installed and comply with the 1976 Uniform Plumbing Code, Chapter 3, as amended by the Tustin City Code. Section 506 (c) (2) Section 506(c)(2) is omitted. Add a new Section 506(c)(2) to read as follows: (2). The test shall be made using air pressure only, and stall be made in the presence of the Administrative Authority. All nec.- 1~ essary apparatus for conducting tests shall be furnished by the permit holder. 8 · Article 9, Land Use, Part 7, General Regulations, - is 14 amended as follows: 15 Article 9270(i)(1),- Add a new subsection (f) to rea~' as follows.: 16 (f) (1) Every swiging, wadinc or SPa ooe] shall 17 surrounded by a, fence or wall not less than six feet (6') in above the adjacent exterior grade. The fence or walls shall ~8 serve to isdta~e the pool from other activities or structures shall be located within fifty feeE (50') of the pool. Gates ~9 such enclosurcs shall be located in view of the DOe1. A building wall with no doors may be used as part of such pool enclosures 50 when within the specified distance of the pool. EXCI::PTIOIIS: When ap~roved by the Director, Community Development, such enclosures may include sunshade, toilet, or ~hower s~ructures which are used only in conjunction with the pool. 1 Ordinance ~]o. Page 6 ARTICLE 9270 (o), Add a new third paragraph to read as follows: 4 Any lights used to illuminate any swimming pool shall be so arranged and shaded as to reflect light away from any ad- S joining premises. 6 9. Article 7, Public Facilities, Part 2, Curb, Gutte-~ ant.; Sidewalk requirements. a. Add a new Article 7223 to read as follows: 8 7223 Clean-up .Bond · 9 The Building Official shall prior to issuing a 10 permit for a swimming oool require clean-up bonds as follows: 11 (a) Each applicant for a swimming pool permit shall provide, before issuance, an agreement and cash bond for the 12 purpose of insuring a) that all sand, cement, dirt and any other debris is removed from streets, gutters, curbs, parkways, sidewalk 15 and o~her public property, b) that the public property shall be left in clean and undamaged condition, and c) that adequate bar- 14 ricades have been installed and maintained. Said bond shall be in the amount of five hundred dollars ($500.00) for the con- 15 struction of a swinuning pool or-other construction related thereto __ requiring the use of heavy equipment. · 16 (b) Said agreement and bond may be reduced to 17 not less than one hundred dollars ($100.00) for the issuance of a spa, jacuzzi, and other small POOl permit not intended for 18 s:,:imming, ~.;hen in the determination of the Building Official the scope of the project will have a minimal im}~act on public imF. rove- 19 meats, by reason of no~ requiring the use of heavy construction equil~ment over curbs, sidewalks or public streets. (c) Said bond shall terminate had ]Se'returnable 21 to the applicant at the time and provided that a) debris and oth: materials have been properly removed, b) the public property has ~o~ been !e'ft clean and undamaged, and c) final inspection, approval ~nd acceptance of the ~,:ork and public pro}_~crty has been made by ~5 the Street Det~artnte-nt. Add a new Chapter 8, Article 4, tlealth ancl 4 Sanitation, Tustin City Code incorporating the omitted, "Construction and Abandonment of Wells." The following new Chapter 6 is substituted for the omitted Chapter: 7 SIGN CODE, CHAPTER 6 hereby reads as follows; 8 ARTICLE 8600 - ADOPTION OF 1976 UNIFORM SIGN CODE For the purpose of prescribing regulations fdr the 9 erection, construction, enlargement, alteration, repair, moving, 10 removal, conversion, demolition, occupancy, equipment, use, height and area of building structures, all of the provisions of the i97~:_L ll edition of the Uniform Sign Code including the appendix thereto, adopted and published by the International Conference of Building 1~ Officials, of which not less than three (3) copies have been and now are filed in the office of the City Clerk of the City of Tusti: 15 are hereby adopted and incorporated herein as fully as though set forth in full herein, save and except. such portions as are here- 14 inafter deleted, modified or amended. 15 ARTICLE 8601 - CONFLICTS WITH ARTICLE 9400, SIGNING CODE 16 8601 - Conflicts with Article 9400, Signing Code 17 Add a new Article 8601 to read as follows: Nothing in this Article 8600 shall be construed 'to be 18 in conflict with Article 9~-00, Signing Code, Tustin City Code and 19 Ordjnance 684. The? provisions of Article 9400 "...is to est. ab].ish guidelines and standards..." regarding ".-..the character of signs ~0 and sign structure..." The purpose of Article 8600, Sign C,,:~de, Tustin City Code, "-..is to provide minimum standards to saf,~c;uard 21 life, health, propert},- and public welfare by regulating an~l trolling the desig:~, quality of materials, construction, location, 2~ electrification and majntenance of all signs and sign structures not within a building." Any conflicts between Article 9400 and ~ Article 8, Building .qegulatio:~s, Tustin City Code, regarding en- forcement of adol~ted codes and amendments, the provisions and re~ 24 quiremeats of Article 8 shall govern. 11. Article 7, Part 6, Article 9400, Signing Code, Tust._ City Code is amended as follows: Add a ne;.; Sec. 9456 to read as follows: 9456 - Underground electric service Signs accessory to a building, separately located or the same lot or premises shall have connecting conductors run underground to each sign and between signs if there are more than 50 one sign on the lot or premises. 51 17.. Article 8101, Amendment of Code The 1976 Edition, Uniform Building Code is hereby 12 amended as follows: 15 a. Section 301, Application for Permits is amended by adding a new subsection to read as follows: 14 301 (e) Micro Filmin.g. For permanent City records, as required by State 16 Law, prior to permit ~ssuance, a copy of all approved construction and grading drawjongs, engineering calculations and soils report.? 17 shall be submitted to the Building Official in Micro Film form ~n strips in jackets as follows: 18 35 mm ("A" drawings or larger) 19 1. Jackets shall be made of transparent ultra- ~0 thin polyester film- 21 2. Jackets shall have a ½ inch title head, in which the address shall be typed in the up.Oe~ 22 left hand corner, the number of jacket of total jackets shall be t_%;ped in upper riglit ~5 hand corner. Example: 1 of 3, 2 of 3, 3 of 3, etc. 24 3. Film jackets shall be 2 channels, 4"x6" in ~5 size. 26 4. Silver lined micro film strips and duplicate micro film strips shall be provided, both ~ strips stuffed in jackets ~8 16 mm (Calculations and Soils Reports) 29 1. In addition to the, penalties hereinabove provided, any condition caused or }~ermitt_ed to exist in violation of any of. the provisions of_ this Code, or of any code adopted by reference herei_; shall be deemed a public nuisance and may be summarily abated as such by this City, and each day such condition continues shall be regarded as a new and se}~arate nuisance and offense. 15.
