HomeMy WebLinkAboutORD 758 (1978)i { 439 ORDINANCE NO. 1 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, REZONING PROPERTY OF JANSVU PROPERTIES ON Z APPLICATION NO.,ZC 77-1.0. 3 The City Council, City of Tustin, California, does ordain as follows; 4 1. The City Council finds and determines as follows. 5 a. That a proper application, Zone Change 77-10, has been filed on behalf of Jansvu Properties, Inc. for a zone change from 6 i the Single Family (R-1) and Multiple Family ,(R-3) Districts to the Planned Development District (PD) of the property 9 described in Exhibit "A," attached hereto and incorporated 10 herein by this reference as though set forth herein in full. 11 b. That a public hearing was duly called, noticed and held on 12 said application. 13 C. That a zone change should be granted for the following 14 reasons: 15 I. The zone change is in conformance with the Land Use 16 Element of the Tustin Area General Plan. 17 II. The zone change will encourage residential redevelop - 15 ment in the older section of the City. 19 d. Development of subject property shall be in accordance with 20 the policies adopted by the City Council, Uniform Building 21 Codes as administered by the Building Official, Fire Code as 22 administered by the Fire.Chief, and street improvement 23 requirements as administered by the City Engineer. 24 e. Final development plans shall require the review and ap- 25 proval of the Community Development Director. 25 2. The City Council hereby rezones the subject property from the 27 Single Family and Multiple Family Districts to the Planned 28 Development (PD) District, subject to the following conditions: 29 a. Compliance with recommendation and stipulations of the 30 Community Development Director _ and City Engineer related to 31 street trees, street lights, public improvements, drainage 32 and vehicle circulation patterns. „ 440 3 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 b. Submission and approval of finaldevelopmentplans by the Community Development Director. C. Compliance with all conditions of City Council Resolution No. 76-140. d. Submission and approval by the City Engineer of a Tract — Map incorporating both the multiple -family development (PD) and the single family (R-1) land along Second Street prior to the issuance of any grading or building permits: e. Compliance with fire access lane requirements along the southern boundary of the Planned Development District.
