Home My WebLink AboutORD 740 (1977) ORDINANCENO. 740 ~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE ANNEXATION OF ~ CERTAIN UNINHABITED TERRITORY, DESIGNATED "HOLT-LILLIAN- BENETA ANNEXATION NO. 101" TO THE CITY OF TUSTIN, ~ CALIFORNIA 4 The City Council of the City of Tustin, California, does 5 ordain as follows: 6 WHEREAS, pursuant to the provisions of the Government Code of the State of California, application was made to the 7 Local Agency Formation Commission to annex to the City of Tustin all that territory situate in the County of Orange, State of 8 California, hereby designated as "Holt-Lillian-Beneta Annexation No. 101" , and described in Exhibit "A" attached hereto and 9 incorporated herein by this reference as though set forth..herein in full; and 10 WHEREAS, the Local Agency Formation Commission, in session · 1 duly assembled, on July 27, 1977, did adopt the'. negative 12 declaration and approve said proposed annexation; and WHEREAS, the City Council hereby finds and determines ~3 that all of the territory is uninhabited within the meaning of ' Government Code Section 35303, and that said territory. is con- 14 tiguous to the City of Tustin, and 15 WHEREAS, on the 1st day of August 1977, the Council of the City of Tustin did pass and adopt Resolution No. 77-78 ~6 giving notice of the proposal to annex certain uninhabited territory to the City of Tustin, said territory_ being therein 17 designated as "Holt-Lillian Beneta Annexation No. 101", said resolution describing t~he boundaries of the territory proposed to 18 be annexed; and 19 WHEREAS, said Resolution contained a notice of the day, hour and place when and where the Council of the City of Tustin R0 would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said 21 hearing being prescribed by law; and WHEREAS, on the 19th day of S~ptember, 1977, at the hour of R3 7:30 o'clock, P.M., in the Council Chambers, Centennial at Main in the City of Tustin, County of Orange, State of California 24 said time and place being the day, hour and place fixed in said Resolution for hearing protests to the said annexation, the 25 said City Council did hear and pass upon any and all protests made tG the proposed annexation and did determine that insuf- ficient protests had been made by the owners of the privately 26 and publicly owned territory proposed to be annexed as deter- 27 mined by said legislative body; and WHEREAS, said territory is contiguous to the City of 28 Tustin, and is uninhabited territory in the County of Orange; and WHEREAS, the property within the annexed territory shall ~0 be taxed to pay the indebtedness and liability of the City contracted to or existing at the time' of annexation.
