HomeMy WebLinkAboutORD 691 (1976) 157 ORDINANCE NO. 691 AN ORDINANCE OF THE CITY COUNCIL, OF THE CITY OF TUSTIN, CALIFORNIA, RELATIVE TO THE REGU- LATION OF TOW TRUCKS. The City Council, of the City'of Tustin, California, does ordain as follows: '1. Sections 3700 through 3714, comprising Chapter 5, of of Article 3, are hereby added to the Tustin City Code, to read as follows: CttAPTER 7: TOW TRUCKS. Sections: 3700 - Definitions. 3701 - Tow Truck Permit Required. 3702 - Exemptions 3703 - Designation As Official Police Toying & Storage Service (OPTS) 3704 - Application For Tow Trucks 3705 - Standards For Tow Truck Permit - Liability Insurance. 3706 - Hearing on Application. 3797 - Issuance of Permit. 3708 - Standards For Tow Truck Equipment. 3709 - Attendant or Operator's Permit Required. 3710 - Standard Rules of Operation. 3711 - Grounds For Revocation. 3712 - Suspension. 3713 - Renewal. 3714 - Appeals. 3700. Definitions. 1. A non-emergency towing assignment includes towing of vehicles that have been involved in a collision, but have been removed from the scene; that have experienced mechanical failure, but have been removed from the roadway and no longer constitute a hazard; or that being mechanically operative, are towed for convenience. 2. An Official Police Towing and Storage (OPTS)' service means a towing company selected by the Chief of Police to be used, on call, and on a rotating basis, for any police emer- gency situation where a tow truck is required. 3. Where specific reference is made to an OPTS service in this Chapter, such reference shall apply only to OPTS services and not to other tow truck services. All other references to any tow truck service shall include OPTS services and other tow truck services. It is the intent of this subsection that all tow truck services be subject to certain general standards and that where an OPTS service is specifically mentioned, the OPTS service alone is subject to the additional standards. 3701. Tow Truck Permit Required. Mo tow truck service shall operate in the City of Tustin without a valid tow truck permit issued by the City of Tustin. Such permit shall be in addition to any business license or fee required by any other provision of the Tustin City Code. 158 158 3702. Exemptions- The provisions of this chapter shall not apply to any towing services: 1o That provide towing services exclusively to members of an association, automobile club,. or similar organiza- tlon, and receive remuneration only from the sponsoring associa- tion, automobile club or similar organization; 2. That are licensed in other communities and come ~' within the City limits of the City of Tustin to deliver to a Tustin residence or business a vehicle picked up outside Tustin, 3. That are licensed in other communities not contiguous to the City of Tustin and who come within the City limits on non-emergency towing assignments with the purpose of towing a disabled vehicle to another city for repairs; 4. Persons soliciting for non-emergency towing assignments within the City of Tustin shall be deemed to come within the provisions of this chapte.r and .are required to have a permit as specified here in. 3703~ Designation As Official Police Towing & Storage Service (OPTS).. 1. It is the intent of this section and the appli- cable parts of Chapter 7 of this Code to provide for OPTS service~ in police emergency situations and in the removal of vehicles which are apparently abandoned, or involved in an accident, or which constitute an obstruction to traffic because of mechanical failure. It is the purpose of the City Council in enacting this section and the applicable parts of Chapter 7 of this Code to provide a fair and impartial means of distributing requests for towing services among qualified firms, and to insure that such service is prompt and reasonably priced, and in the best interests of the public as well as in the interest of efficient policing operations. 2. There shall be 3 OPTS services selected and designated to provide service at the request of the Police Department. The number of OPTS services may be altered upon a determination by the Chief of Police that more or fewer OPTS services are required to provide a sufficiently high level of service to the public. 3. Applications to be licensed as an OPTS service shall be in the same form as an application for a permit under SeCtion 3704 except that the application shall designate that application is made for an-OPTS service permit. The holding of an OPTS service permit does not alone entitle the holder to engage in OPTS services for the City. In order to operate as an OPTS service a towing service must be licensed as an OPTS service and must be designated as an OPTS service pursuant to subsection (4) of Section 3703. 4. In order to be designated as an OPTS service an individual shall make an application to the Chief of Police requesting that the applicant be considered as a candidate for OPTS service contract with the City. The application shall contain the information required for an OPTS permit and any other relevant information which the Chief of Police may require. The Chief of Police shall consider all applicants and make a deter- mination, based on the standards and requirements of Chapter 7 of -2- 159 this Code for OPTS operations, as to which applicants are most qualified to best serve the public interest as OPTS services. ~ The Chief of Police, with the authorization of the City Council, shall enter into OPTS service contracts with those applicants. -- 5 determined to be most qualified, but not to exceed the number of OPTS services as prescribed by Section 3703(2). 4 3704. Application For Tow Truck Permit. Applications for 5 tow truck permits hereunder shall be made upon such forms as may be prepared or prescribed by the City Clerk and shall contain: ? 1. The name and address of the applicant and of the owner of the towing service. (If the applican~ or the owner is a 8 corporation, provide a copy of the certificate of incorporation, and a statement by the Secretary of State that the corporation is 9 in good standing.) 2. The trade or fictitious name, if any, under which the applicant does business and proposes to do business, and a copy of the fictitious name statement on file with the County of Orange. 3. The training and experience of the applicant in the conduct of the tow truck business. 4. A description of available equipment to-be used in towing services: ~5 ' (a) Include State motor vehicle license numbers, color scheme, insignia, name, monogram or other dis- tinguishing characteristics to be used to designate applicant's towing vehicles. 5. The location and descriptions of the place or places from which the business will operate, including address of storage facilities; specify equipment and personnel available at each place of business. S0 6- A description of the method of operation of the communication system between the place of business and operating tow trucks, as well as the means utilized for insuring prompt dispatch of trucks upon receipt of call from the Police Depart- ment or requesting party. 7. Such other information as the License & Permit Board shall deem reasonably necessary .to a fair determination of compliance with this Chapter. 8. An accompanying permit fee of $25.00 plus $10.00 for each vehicle the applicant(s) proposes to use in the business. ~7 9~ A financial statement prepared by a certified "'~ public accountant showing the financial status of the applicant Z8 during the past two years preceding the application. ' ~9 10. A schedule of rates to be charged for the fol- lowing services: (Fill our unit-basis charge as appropriate.) 50 (a) Charge per emergency call, with tow truck and 51 operator; (b) Charge per non-emergency call, tow truck and operator; -3- (c) Charge per hour for towing service with tow truck and operator; (d) Charge per call for towing service of tow truck with one ton capacity or greater, including operator; (e) Charge per hour for towing service of tow truck with one ton or greater capacity, including operator; (f) Additional charge for dolly service; ' (g) Dolly service charge, weekends and after hours; (h) Open-up fee; (i) Open-up fee--weekends and after' hours; (j) Additional charges for mechanical aids; (k) Charge per mile for towing service, with truck and operator; (1) Charge per mile for towing service, with tow truck of one ton capacity, or greater, including operator; (m) Additional labor per hour; (n) Storage charge for 24-hour .period per auto- mobile; (o) Storage charge for 24-hour period per truck, one ton and over; (p) Miscellaneous additional charges; (q) Explanation of any further or additional charges o 11. Applicants for OPTS permits may submit a separate, additional rate schedule which shall apply only to OPTS services. 12. Applicants shall submit their fingerprints and photographs taken by the Tustin Police Department. 3705~ Standards For Tow Truck Permit - LiabilitV Insurance. 1. No tow truck permit shall issue under this Chaptel nor shall such permit be valid after issuance, nor shall any tow truck service operate in the City unless there is at all times in force and effect insurance by a company authorized to do busin~ in the State of California, for each and every tow truck owned and/or operated by or for the applicant or permittee, providing for the payment of damages as follows: (a) For injury to or death of individuals in accidents resulting from any cause for which the owner of said vehicle would be liable on account of liability imposed on him law, regardless of whether the tow truck was being driven by the owner or his agent, in the amounts of: $100,000.00 on any one person; $300,000.00 covering two or more persons in one accident: and (b) For the loss of or damage to the property of another, including personal property, under like circumstances, in the amount of $25,000.00 for each accident, and including -4- 161 comprehensive fire and theft insurance covering the vehicle and its contents. (c) The monetary amounts of coverage listed in subsections (a) and (b) are subject to change as may be required by law. 2. Said insurance policies shall be submitted to the License and Permit Board for approval prior to the issuance of each tow truck permit. Satisfactory evidence that such in- surance is at all times in force and effect shall be furnished to the License and Permit Board, in such form as the City Clerk may specify, by all permittees required to provide such insurance under the provisions of this Chapter. 3. Every insurance policy required hereunder shall contain a provision for a continuing liability thereunder to the full amount thereof, notwithstanding any recovery thereon, that the insurer's agreement to pay damages for which the insured is to be held liable shall not be affected by the insolvency or the bankruptcy of the assured, and that until the policy is revoked the insurance company will not be relieved from its agreement to pay damages on account of nonpayment of premium, failure to renew permit at the end of the year, or any act or omission of the named assured. Such policy of insurance shall be -further conditioned for the payment of any judgments up to the limits of the said policy, recovered against any person other than the owner, his agent or employee, who may operate the same with the consent or acquiescence of the owner. 4. Every insurance policy required'hereunder shall extend for the period to be covered by the permit appli- cation and the terms of the policy shall require the insurer to give not less than ten (10) days' written notice to the City of Tustin, License and Permit Board, and to the assured before any cancellation or termination thereof earlier than its expiration date. The cancellation or other termination of any such policy shall automatically revoke and terminate the permit issued for the tow trucks covered by such policy, unless another insurance policy complying with the provisions of this Section shall be provided and be in effect at the time of such cancellation or termination. 3706. Hearing on Application. Upon receipt of any such application, the City Clerk shall, upon determining the application to be in order, refer the matter to the Chief of Police for investigation. In the course of the investigation the Chief of Police shall inspect the vehicles and equipment and shall require the applicant or any person named in the appli- cation to be photographed and fingerprinted. The Chief of Police shall complete his investigation within thirty (30) days unless prevented from doing so by lack of cooperation of the applicant or other person named in the application, and shall report his findings to the City Clerk regarding the moral character of the applicant and other persons named in the application, the adequacy and safety of the vehicle with respect to cleanliness, equipment, safety devices, brakes, lights, and obsolescence, and the reasonableness of the rate schedule in comparison to rates of other tow services in the vicinity. Upon receipt of said report, the City Clerk shall transmit the application and report to the Secretary of the License & Permit Board who shall set the same for hearing before the License & Permit Board. The Secretary of the License & Permit Board shall give written notice of the -5- · '162 time so set at least five (5) days before the date of said hearing to the applicant by mail at the address set out in such application- 3707. Issuance of Permit. At the time set .for the hearing of such application, the License & Permit Board may examine the applicant'and all persons interested in the matter set forth in said application, and may order the City Clerk to issue a permit in accordance with said application, subject to the filing and approval of an undertaking subject to such conditions as may be imposed by the License & Permit Board, including the minimum and maximum number of vehicles that may be used. In reaching a decision, the License & Permit Board shall consider the following factors: 1, Whether the applicant is qualified on the basis of moral character, experience in the towing business, and financial responsibilitY; 2. The probable effect that approval of the appli- cation would have on the level and quality of service available to the public; 3. Whether the facilities, personnel and equipment Which the applicant proposes to use are adequate. 4~ The reasonablenes~ of the rate schedule in comparison to rates of other tow services in the same vicinity- 3708. Standards For Tow Truck Equipment., 1. .Company name: Company name, address and phone number shall be displayed on both sides of the tow truck in letters not less than two and one-half (2-1/2) inches in height- 18 2o Lights: Trucks must, at all times, be equipped 19 with such headlights, tail lights, red reflectors, stop lights, warning lights, and other lights as required by California law, 20 plus one white utility light (adjustable or portable); and may be equipped with such other lights as the owner may desire which are 21 not forbidden by law. 22 3. Additional equipment: Trucks must be equipped with all equipment required by law for tow trucks ~ngaged in 25 towing services° 4. Additional requirements for OPTS trucks: (a) OPTS trucks must have at least two (2) rigs of one ton capacity with rear dual wheels. 26 (b) OPTS trucks mus~ be equipped with red 27 flares, lanterns or reflectors, hand tools, crow-bar, rope, broom, shovel, dustpan, fire extinguisher (the dry chemical 28 type), portable red tail lights and stop lights for towed vehicl equipment for opening locked vehicles, and safety snubber chain. 29 Each tow company shall have at least one set of dollies readily available at all times, and one motorcycle sling. 50 (c) OPTS services shall have 1 truck equipped 51 with a winch of sufficient size and capacity to retrieve vehicles which have gone over embankments or'off roadways into inundated 52 areas or other inaccessible locations, which is equipped with safety dogs or equivalent braking devices. -6- 163 i (d) OPTS services shall have at least one. (1) truck to be equipped with adjustable twin-booms with the capabil. '~ -~ of at least four-ton capacity from the side of the truck. Said truck must also be equipped with. 300 feet of not less than 3/8" 5 cable free from partial breaks or knots. 3709. Attendant or Operator ' s Permit Required. ~ 1. Application: No tow truck as described in this Chapter shall be operated in the City of Tustin by a driver who 6 has not first obtained a permit in writing to do so from the Chief of Police.- Any person desiring to obtain an operator's ~ permit shall make a written application therefor to the Chief of Police accompanied by the fee of $17.50. APPlicants for atten- 8 dants or operator's permits shall be required to be Photographed and fingerprinted° No attendant or operator's permit shall be 9 issued to any person: 10 (a) Under the age of 18 years. li (b) Who is not a citizen of the United States or who has not lawfully declared intention of becoming such. 15 (c)7 Who has been convicted of a felony. (d) Who, within a period of two (2) years -- 14 immediately preceding such application, has been convicted of reckless driving or any provisions of the Alcoholic Beverage ~15 Control Act, California Penal Code, California Vehicle Code, or any other code, which is directly concerned with the operation of 16 a motor vehicle while under the influence of alcoholic beverage 17 or drug, or combination of alcohol and drug. (e) Who has physical impairments, handicaps or 18 deficiencies of such nature as to interfere with said driver's ability to competentty perform the duties of his employment, or 19 to operate such vehicle safely. (f) Who. is not of good moral character. (g) Who is not able to speak, read and write the English language sufficiently to deal with customers. (h) Who does not hold a vehicle driver's license issued by the Motor Vehicle Department of the State of California. ~4 (i) Who falsifies the application for said permit. ~5 3710. Standard Rules of Operation. ,.. 26 1. Requests .for towing service and the removal of traffic hazards may be made through the Police Department. Z7 . 2. All officers are specifically prohibited from -- 28 soliciting for or recommending any garage or tow service either directly or indirectly. Z9 3. OPTS services shall not by their advertisements 50 in any way publicize any official or other connection with the City of Tustin, nor shall they advertise any address or phone 51 number of the City of Tustin as a ldcation to call for vehicle towing and storage service. -7- 164 4. At the discretion of the Police Department of the City of Tustin an OPTS service operator may use. his own radio to receive police calls on traffic accidents and other traffic incidents which may require police attention and tow service. Priority shall be given to calls received from the Police Department. 5o If more than one garage is designated as an OPTS service, the system of calling for service shall be on a rotating basis as established by the Chief of Police. 6. If telephones are the means of communication for receipt of calls from the Police Department, the Official Police Towing and Storage Service shall provide a list of telephone. numbers to be called in order of priority, and immediately upon any change in said telephone numbers or in the priority thereof shall 'notify the Police Department in writing with effective of the change~ 7. Any additions to or deletions from the tow truck fleet of any OPTS service shall be immediately reported to the Police Department in writing, with descriptions and information as specified in Section 3704(4)(a) above. 8~ Any change in operating locations of an OPTS service shall be reported in writing to the Police' Department with information as s.Decified in Section 3704(5) above, at least thirty (30) days prior to such change.' 9o Official Police Towing and Storage Services shall be scheduled by the Police Department to insure that there sha]h' be an attendant on call capable of responding to police request! for towing as well as be present or available for release of vehicles to. the public twenty-four (24) hours a day, seven (7) days a week. Operators must be available at the hours specified in the Police Department schedule and in the necessary numbers to operate the service equipment. If the service's telephone or radio is not answered, or if the line is busy when called by the Police Department after two (2) tries, the service being called will be by-passed and the next OPTS service in rotation will be called. 10o If an Official Police Towing and Storage Service is unavailable, or in case of disaster or emergency, the City of Tustin reserves the right to call other tow services with adequate capabilities which are not under contract or agreement with the City. Determination of these conditions shall rest with the Tustin Police Department. 11. Removing Hazards: After being dispatched by the Police Department to the scene, the Official Police Tow Truck operator shall cooperate with the police officers in removing hazards and illegally parked vehicles as requested. It is the duty of the police officers to determine when such a vehicle should be impounded or moved and the tow truck operator shall abide by their decision. 12o Each towing company shall comply with Section 27907 of the Vehicle Code of the State of California regarding signs on tow trucks. Only tow trucks bearing the name of the company called shall be dispatched to the scene of need. 13. All owners of towing companies shall conduct · -8- 16 8 i their business in an orderly, ethical, businesslike manner and use every means to obtain and keep the confidence of the motoring pub 1 i c. 5 14. Vehicles impounded by the police for special "' investigation shall be held in maximum security until cleared by 4 the investigating officers, at which time the owners shall be permitted a '48 hour grace period at no charge in which to remove 5 the vehicles from storage. Contents of vehicles with a "Police Hold"' shall not be removed. 15. The tow and storage service shall'be responsible 7 for the protection of police-impounded vehicles regardless of the location of storage until the vehicles have either been released 8 to their owners or disposed of through legal process. 9 16. The owners of towing and storage companies participating in towing assignments by the Police Department 10 shall be responsible for the acts of their employees while on duty. Such towing and storage companies shall be responsible for li damage to vehicles while in their possession. 1~ 17. Notwithstanding any provision or language which might indicate to the contrary, in responding to a cal. 1 from the 13 Tustin Police Department, the vehicle towing and storage service shall have no claim against the City of Tustin for the cost of 14 its services rendered, but shall look solely to the owner of the vehicle transported. No representation is made by the City of 15 Tustin that such person will be financially responsible. 16 18. All vehicles stored or impounded as a result of a "tow ordered by the Police Department" shall be made available to 17 the owner of the vehicle or his representative, any insurance agent, insurance adjustor, or any body shop or car' dealer, for 18 the purpose of estimating or appraising damages, except vehicles with a "Police Hold". 19 19. Each Official Police Towing and Storage Service Z0 shall record its time in and its time out on every official assignment. Such records shall be available and open to police Zl examination. 20. The records of all vehicles impounded or stored at the direction of the City of Tustin shall be available for inspection only to authorized employees or officials of the City of Tustin and the Chief of Police. ~4 21. Each Official Police Tow Truck Service shall submit a monthly report to the Chief of Police, which shall include the following: (a) Total police impounds. (b)' Number of times dispatched by Tustin Police ""' 28 Department. · ~9 (c) Number of these calls resulting in impounds. 50 (d) Number of calls answered in which time beyond one hour was required to handle. 51 22. The equipment and performance of each Official 32 Police Towing and Storage Service shall be subject to periodic -9- 166 review by the Chief of Police, who may on the basis of such review suspend the servlce's license or permit for up to sixty (60) days. The Chief of Police shall also recommend to the License & Permit Board either continuance or termination of the service's official status and place on the rotation list. 23. All Official Police Tow Trucks used shall be equipped with two-way radio or telephone or other acceptable communications equipment. Citizen's Band Class D is not accep- tab le. 24. Storage lots shall be adequately fenced with gates locked and secured and reasonably well-lighted to maintain a maximum of security for stored and impounded. vehicles. 24(a). Adequate impound space shall be provided to accommodate vehicles held as evidence for the purposes of proces~ ing for physical evidence. 1. Impound space shall be protected by an consisting of four walls, a roof and a door with a locking devie~l~' for the protection from the elements of weather and other forms of contamination. 2. Protection shall also be provided to preclude evidence contamination by employees and other individuals during normal business hours. 25. OPTS storage service lots shall be located within the City limits of the City of Tustin or within ten (!0) miles the City limits. 26. All Permittees shall comply with the appropriate sections of the California Business and Professions Code with regard to unauthorized charges or repair work on a vehicle-in its charge. 27. Permittees shall, when disposing of unclaimed vehicles, abide by all California Code Sections pertaining thereto- 28. All vehicles stored or impounded as a result of a "tow ordered by the Police Department" shall be towed directly to an Official Police Storage lot unless the Police Department or other person legally in charge of the vehicle requests that it taken to some other location. 29. Rate schedules for Official Police ToWing Services performed for the City shall be subject to approval of the License and Permit Board upon recommendation of the Chief of Police. The service may a.Dpeal any rate schedule disapproval pursuant to the procedures in Section 2714 herein. 30. Any permittee desiring a change in his rate schedule may make written application for such changes to the License & Permit Board. Such application shall include a copy of the presl, t rate schedule with the proposed changes clearly indicated thereo. so as to facilitate a clear understanding of the proposed changes. A written statement of the justification for the proposed changes shall accompany the application. The secretary of the License & Permit Board shall set the matter for hearing before the License & Permit Board, and shall give written notice of the time as so set at least five (5)- days before the date of said hearing to the applicant by mail at the address set out in such application. 167 i 3711. Grounds for Revocation. Any permit granted under the provisions of this Chapter may be removed by the License & Permit Z Board'either as a whole or as to any person or vehicle described therein, or as to the right to use any distinctive color, monogram 5 or insignia, after ten (10) days' written notice to the permit ~" holder requiring him to appear at a certain time and place to 4 show cause why the license or permit should not be revoked, for any of the following reasons: 1. That the insurance coverage required by Section 3705 hereof has been withdrawn or lapsed or is not in force for any reason. 2. Dissolution of business or bankruptcy. 8 3. For assignment of an Official Police Towing 9 Service 'contract with the City of Tustin or any right or interest stated therein, without prior written consent of the Chief of 10 Police. li 4. For the nonpayment of any City business license or other fees of the City of Tustin. lZ 5. Breach of any rules, regulations or conditions set 15 out in the Tustin City Code. l~ 6. For the violation of any of the laws of the State of California or the City with respect to the operation of the 15 business by any permit holder or repeated violations by operators --- or attendants of any vehicle covered by such license or permit. 7. For failure to maintain satisfactory service to 17 the public or for failure to keep any such vehicle in a safe condition and good repair or for failure to use the distinctive 18 coloring, monogram, or insignia described in the application. 8. Substantial or recurring deviation from the schedule of rates. Z0 9. For any cause which the License & Permit Board finds which makes it contrary to the public interest, convenience, necessity or general welfare for the license or permit to be' continued. 3712. Suspension. Any permit granted under the provisions of this Chapter may be suspended by the Chief of Police for a period of up to sixty (60) days for any violation of this Chapter. The Chief of Police shall give written notice to the offender ten 25 (10) days prior to the effective date of suspension, which notice reasonably apprises the offender of the reasons for the suspension 3713. Renewal. Whenever a person or concern permanently 27 removed from a rotation list for cause has after six (6) months ... again complied with the provi°sions of this Chapter, and the 28 Police Department is satisfied that the operation will not result in the continued violation of these regulations, such tow and 29 storage service may be restored to such list, subject to the limitations of Section 3703(2). 3714. AppealS. 1. When any application for any permit pursuant to Chapter 7 of this Code has been denied, or when any permit has been revoked, the applicant or permittee may make a written -11- 168 appeal to the License & Permit Board within ten (10) days of receipt of such denial or revocation. Upen receipt of such an appeal the License & Permit Board shall set the matter for a hearing allowing at least five (.5) days' written notice to the applicant or permittee. The License & Permit Board shall con- sider all relevant evidence at such hearing. 2. Any suspension under this Chapter may be reviewed 5 by the License & Permit Board upon receipt from the suspended party of written notice requesting such review.. Such request 6 shall be made within ten (10) days of the receipt by the applicant of the notice of suspension. 3~ If the suspended party is not satisfied with the 8 result of the review, he may then make a written request for a hearing. Such request shall be submitted to the License & Permi~ 9 Board within ten (10) days of receipt of the decision based upor~ the review. Upon receipt of such a request, the License & Per'r~ 10 Board shall set a hearing on the matter, giving at least five (5) days' written notice to the party making the request. The li License & Permit Board shall consider all relevant evidence at the hearing.
