(URGENCY MEASURE) ,_ 4 The City Council of the City of Tugtin, California, does hereby ordain 5 aa follows: 6 WHEREAS, on the 9th day of February, 1976, the City Council of the ? City of Tustin did pass and adopt Resolutk6n No. 76-15 declaring that the 8 City C~uncil of tae City of Tus~in has initiated procedures to annex certain 9 uninhabited territory to the City of Tustin, and giving notice. of the 10 proposal to annex said territory to the City of Tustin, said territory 11 being therein designated as the "Marine Corps Air Station (]{elicopter) 1Z Annexation No, 71B to the City of Tustin", and said resolution described 15 the boundaries of the territory proposed to be annexed; and- 14 WHEREAS, said ReSolution ~o. 76-15 did contain notice of the day, hour 15 and place when and where the 'Council of the City of Tustin would hear _. 16 protests made by any person owning' real property within the territory 17 proposed to be annexed, tha time of said hearing being not less' than forty 18 nor mort. than sixty days from the date of' passage of said resolution~ and 19 WHEREAS, on the 25th day of March, 1976, at the hour of ~:30 P.M., in 20 the Council Chambers in the City Hall of the City of Tugtin, County of 21 Orange, State of California, said time and place being the day, hour'and 22 place fixed in said Resolution No. ~6-15 for hearin~ protests to the said annexation, the City Council did hear and pass upon all protests mad6 24 to the proposed annexation and did determine that protests had not been 25 made by owners of one-half of the value of the. privately and publicly owned 26 property within the territory. to be annexed as shown by the last equalized assessment roll, and as provided in the Government Code of the State of ,-- . 28 California; and 29 WHEREAS, on the 22ndday of April, 1976, the Council of the City of ' Z0 Tug tin did pass and adopt Resolution No, ~3~ ~ determining and declaring 31 that a majority protest of one-half of the value of the privately and 3Z publicly o~raed proper~y had not. been made b7 owners as shown hy the last " i20 I equalized assessment roll of the property wi.thin the territory to be Z annexed, and as provided in the Government Code of t.he State of Californla; 3 and 4 WHEREAS, said territory is contiguous to the City of Tugtin, and is 5 uninhabited territory in the County of Orange,' as defined in said Code, and 6 is further described in Exhibit "A" attached hereto and incorporated herein V by this reference; and · 8 W~LEREAS, the City Council of the City of Tustln, California, finds and 9 determines that the enactment of this ordinance as an emergency, urgency 10 measure is required for the preservation of public health and welfare, and 11 this ordinance shall go into effect immediately upon adoption. 1Z NOW, ~LEREFORE, said Council of the City of Tug tin, California, does 13 hereby approve the annexation of the territory described in Exhibit "A" to 14 the City of Tugtin, and does hereby further ordain that the said territory 15 be, and is hereby, annexed td the City of Tugtin. adjourned 16 PASSED AND ADOPTED as an urgency measure at a regular/meetinZ of the 17 City Council, City of Tugtin, California, .held.on the 22nd day of April, 1976. , 1976.
