2 AN ORDINANCE OF THE CITY COUNCIL, CITY OF TUSTIN, CALIFORNIA,
AMEND!NG ORDINANCE NO. 637 RELATING TO PROVISIONS OF THE
3 UNIFORMI FIRE CODE REGARDING THE SALE OF CHRISTMAS TREES. .
4 The City Council of the City of Tustin does hereby ordain
5 that the Tustin City Code be hereby amended as follows:
6 1. Subs~ctions KK and LL of Section 10-5 o~ Article 2 of
7 Chapter i0 of the Tustin City Code is hereby amended to read as
8 follows:
~ KK. Section 2'7.206 is hereby amended to read as follows:
10 Section 27,206 No person shall display for sale,
11 sell, or engaget-in the business of selling Christmas trees
I2 -without having obtained a permit to do so as provided'
13 herein and by permit procedures of the City of Tustin~
14 (a) Permits and issuance of permits for the sale of
15 cut Christmas trees shall be approved for established and
16 bona fide, non-profit, charitable, fraternal, patriotic,
17 service or religious organizations which have been estab-
18 lished for one (1) year and'regularly meet within the City
19 of Tustin. Permits Shall be granted only after payment of
20
a Twenty-Five Dollar ($25.00) inspection fee. A fee-exempt
21 business license shall also be required for such sales by
22 charitable organizations.
(b) Permits a¼d issuance of permits for the sale of
24
cut Christmas trees shall be approved for temporary-retail
25
sales organizations or individuals only after payment of
26
a Twenty-five Dollar ($25.00) inspection fee. A business
27 license application accompanied by a business license fee
28
of Twenty-five Dollars ($25.00) is required for the retai~'
29
-' sale of .cut Christmas trees..

Provided, however, that businesses with fixed places of
31
business within the City shall be exempt from the require-
32
ment of payment of an inspection fee.

' LL, Section 27.2'U7 is hereby amended to read as foi. iows:
2 Section 27.207. No person.shall sell, display for
3 'sale, or store any cut Christmas trees within the City of
4 Tustin except for the period from November 15 to Deceraber

5 31 of the s~me calendar year/unless an application there-
6 for ~s filed with the Chief of the Tustin Fire Department
7 and the applicant therefor shows that the proposed location
8
and method of such activity will not constitute a fire
9 hazard or violation of any law, and such applicant makes
10
a clean-up guarantee deposit of $100.00 with the City cf
11
Tustin, and agrees in said application that unless, no
12
later than the !0th day of J. anuary following the issuance
13
~. of such permit, all unsold trees, combustible waste, 'and
14
heavy accumulations of sawdust are removed from the place
15 where such trees were sold, displayed for sale or stored,

~ the Same may be removed and disposed of by. the City of
- 17
Tustin and that said City may apply said deposit in pay-
18
ment of all of its costs,, including its overhead expenses,
19
in connection with such removal. The Chief of the Fire
20
Department shall cause any of such items remaining after
21
J. anuary 10 o~ each year, to be removed as soon as possible,
22
and shall report the cost thereof to the City Finance
23
Director, and he s~all apply sufficient of said deposit
24
toward payment of such costs, and the overhead expenses
25
of the City, and shall return to such applicant any amount
26
of such deposit in excess thereof. Fire Chief shall re-
27
port in writing to the City.Finance Director as soon as

possible after January 10 of each year the names of all
29
' permittees who have removed such items and he shall then
30
return said clean-up deposit to such applicant.

Provided; however, that fixed places of business within
the City shall be exempt from the requirements of this
section.
]ii 2. The City Council hereby finds and determines that the.
2 enactment of this Ordinance as an emergency, urgency measure' is
required for the preservation of public health and welfare, and__l
4 this Ordinance shall go into effect inunediately upon adoption~
5
PASSED.~/,]D ADOPTED as an urgency measure at a regular
7 meeting of the Tustin City Council, held on the 1st day of
8 December, 1975.
