HomeMy WebLinkAboutORD 667 (1975)61 ORDINANCE NO. 667 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, REZONING PROPERTY OF THE IRVINE COMPANY ON ZONE CHANGE APPLICATION NO. 75-3. The City Council of the City of Tustin, California, doe.'~ ordain as follows: 1. The City Council finds and determines: A) That a proper application (No. 75-3) was filed on behalf of the Irvine Company to amend the Zoning Classi- fication and .Neighborhood Plan for Peppertree Neighborhoo~ as adopted pursuant to Ordinance No. 528, for the portio~,~ thereof known~ as Lot 116 of T.ract No. 7813, to authorize the deve_!opment of a single-family residential sub- division with dedication and improvement of additional park land. B) That after a public hearing duly called, noticed. and held, the Planning Commission of the City of Tustir recommended said amendment. C) T-hat after a public hearing duly called, noticed and held, the City Council has determined that said amendment should be adopted. D) That an Environmental Impact Repo~rt has been certified for the underlying project rela~ed to the amendment to the General Plan. E) That said p-roposed amendment classifies the existing and additional public park land as Public and Institution F) That the proposed development will be in accordance with the subdivision ordinance of the City of Tustin, Ordinance No. 528, related to the development standardsI the Uniform Building Code, the Fire Code and the policies of the City Council as administered by the various departments of the City. G) That the proposed zone change is in conformance 62 with the Tustin Area General Plan. H) That th'e zone district boundaries are described in 2 in Exhibit "A" attached hereto a.nd incorporated herein by. this reference and are as shown on Exhibit "B" attached 4 hereto and-incorporated herein by this.. reference. 5 2. The Zoning Ordinance of the City of Tustin is hereby amended to designate Lot 115 of Tract No. 7813 and the portion. 7 of Lot 116 as shown on said Exhibit "B" as Public and Institutiona_' 8 with the remainder of Lclt 116 classified as Planned Community (Residential) (Low Medium. Densi.ty Residential, 5 du/acre), subject 10 to the following conditions: 11 12 A) In lieu of imposition of usual building excise fees that the applicant cause to.be constructed at its sole 13 14 cost and expense on the property shown on Exhibit "C" attached hereto and incorporated herein by'this reference 15 ~ 16 three tennis courts to specifications of 'City and ~' 17 dedicate said property with said improvements to the 18 City of Tustin for public park purposes, with City to then pay to the applicant the sum of $2,000,'00, as. a 19 contribution toward a part of the co.st-of construction 20 of one such tennis court,' 21 22 B) That the applicant dedicate to the..
