HomeMy WebLinkAboutORD 666 (1975) ORDINANCE NO. 666 AN ORDINANCE OF THE CITY COUNCIL, CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE RELATING TO RULES AND REGULATIONS .FOR PARKS AND PLAYGROUNDS The City Council of the City of Tustin, California, does hereby ordain as follows: 1. The Tustin City Code is hereby ameHded by the addition thereto of provisions as follows: Section 74-12: It shall be unlawful for any person to go on, be in, loiter or remain in, on, within or upon any park, or playground of the Gity of Tustin between the hours of 10:00 P.M. and 6:00 A.M. or during any period of time which shall have been d2signated by resolution or minute order of the City Council as a period when such facility shall be closed; provided, however, that special permits to occupy and use particular parks and playgrounds ~'ri~ ~D~'in bOt!r~ may be issuec] by the City Ad',~i_nis- trator pursuant to the .procedures and standards prescribed in Section 74-15 of the Tustin City Code. Section 74-13: Posting Signs. 'Signs prescribing the hours that a particular facility ms closed shall be posted. Section 74-14: Prohibited Actions, Activities and items. The following' activities~ sports and uses are hereby prohibited in any park, or playground: (a) Possession or use of 'fireworks -(b) Possession or use of alcoholic beverages or narcoti'cs (c) Gambling (d) Possession or use of firearms or weapons, in- cluding, but not limited to, air rifles, slings, knives and clubs (e) Littering~ defacing or damaging of property (f) Giving private lessons for commercial purposes (g) Use of abusive or profane language (h) Interruption or interference with City authorized or directed programs (i) Climbing on buildings, roofs, zences, shade structures or trees (j) Damaging or removing. trees, plants. or lawn (k) Throwing or propelling any dangerous object (1) Altering facilities. or installation of any new material, equipment or apparatus 59 1 '(m) Any use which is incompatible with _the facit.ity or area, hazardous, destruchiver in conflict 2 the rights of ott~ers, or in violation of any statute or ordinance. 3 · Sec6ion 74-15: The activities hereinafter set forth--- 4 in this section may only be conducted in any-park or playground, upon obtaining a permit therefor as 5 = provided herein, and only when conducted in complete .conformity .with such permit and compliance wj. th all ~ of its terms, conditions and restrictions: 7 (a) Archery 8 (b) Camping 9 (c) Golf 10 (d) Motorized vehicles ~1 (e) Powered model crafts or rockets 12 (f) Any open fire except in designated barbeque pits~ grills or stoves (g) Permitting the presence of any animal 14 (h)' Advertising or selling merchandise 15 (i) Use of any sound amplifying equipment (j) AssemSlies or rallies with in excess o~ 35 pers~ 17 A permit for any of such activities may be obtained 18 upon written applica'tion to the City A~inistrator. The City Administrator shall consider whether 'the time~ 19 place and manner of the proposed use will pose a dan~er threat or likelihood of detriment to the health, 20 safety or general welfare of the community and shall balance th~ interest of the applicant against the 2! general public welfare- Upon the determination that there will be no substantial likelihood of detrimental 22 effect, the City Administrator shall give a written 23 approval of th~ application upon such terms, restric- tions, limitations and conditions as he shall reasonably dete~ine to be appropriate to a~'ford 24 prqper .protection. 25 PASSED AND ADOPTED at a regular meeting of the City 26 Council, City of Tustin, held on the lst day of December, 19'75. 27 30 ATTEST: 31 6O · STATE OF C~\LI ~.nO~NIA ) COUNTY OF OP~-~NGE ) SS C]iTY OF TUSTIN RIr~H C.
