HomeMy WebLinkAboutORD 662 (1975) 48 i ORDINANCE NO. 662 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY 0F TUSTIN, CALIFORNIA, AMENDING ORDINANCE NO. 611 3 PERTAINING TO CONDITIONS OF ZONE CHANGE 73-6 ~ RELATED TORAILL OPERATIONS SERVING THE IRVINE 4 INDUSTRIAL COMPLEX The City of Tustin, California, does hereby ordain 6 as follows: ~ !. The City Comncil hereby finds and determines: 8 a. That an amendment to OrdinanCe No. 611 was duly initiated by the Planning Commission on applica- 9 tion of ~e Atchison, Topeka and Santa Fe Raihvay Company to amend the wording of !0 paragraph 6 which reads: "The hours of rail switching operations for rail service to the industrial complex be restricted to the hours I1 of 9:00 a.m. to 4:00 p.m." b. That public hearings were duly called, noticed I~ and held on said application by the Planning Com~mission and by the City Council of the 14 City of ~ustin. !5 c. That the prcposed amendment is categorically exempt from an EnvirOnmental Impact Report on " I~ the basis of certification of an underlying E!R. -,- 17 d. That the proposed amendment is in accord with an agreement between the City Council and the 18 Atchison, Tooeka and Santa Fe Railway Company as approTed in March 1975, setting forth the 19 responsibilities of the ATSF RR for application the Public Utilities Con~nission for a variance ~0 from PUC General Order No. 135, to limit the Walnut Avenue Grade Crossing to a maximum of ~I five (5) mi~:utes traffic blockage. ~--9" 2 The City Council does hereby amend Paragraph 6 of Ordinance No. 6!1 to read as follows: "Rail operations shall be conducted so -~s not to 2~i exceed 55 riB(A) for any instance between the hours of 10 p.m. and 7 a.m., (as measured at the residential ~5 bo~Indaries of Tracts 8590 and Tracts 8763), and the Walnut Avenue crossing shall be opened and unobstruc- 2~ tive for vehicle traffic between the hours of 6:30 a.m. to 9:00 a.r.a. and 3:30 p.m. to 6:00 p.m., ~"'7I except for urgency rail operations and then not to Z, ~ exceed a continuous period of more than five minutes,' PASSED AND ADO?TED at a regular meeting of the City 29 Council of the City of Tustin, California, held on the 2nd day of September, 1975. //~' /~/~ /<~r' ?j// .....:.,,,.,,...,.,,, ?
