HomeMy WebLinkAboutORD 660 (1975) ORDINANCE NO. 660 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, CALLING A SPECIAL ELECTION TO BE HELD ON THE 4TH DAY OF NOVEMBER, 1975 PERTAINING TO THE ANNEXTION OF TERRITORY KNOWN AS THE "SYCAMORE-REDHILL ANNEXATION NO. 85 OF THE CITY OF TUSTiN. The City of Tustin, California, ordains as follows: 1. The City Council finds and determines: A. By Resolution No. 75-419 the City Council, City of Tustin, declared its intention to call a special election to be held on the 4th day of November, 1975, in certain inhabited territory contiguous to said City proposed to be annexed to the City, for the purpose of submitting to the qualified electors residing in said territory the question whether or not tbe terr.~tory shall be annexed tc the City; and B. Copy of said Resolution was published as required by law; and C. A hearing was held pursuant to Section 35117 of the Government Code for receipt and consideration of written requests for exclusion of property from the proposed annexation filed prior to the time of said hearing and for hearing any and all interested persons appearing at said hearing; and D. All proceedings have been had in accordance with said Resolution and the .AnneXation Act of 1913, reference thereto hereby being made for further particulars; and E. The territory proposed to be annexed is described in Exhibit "A attached hereto and incorporated herein by this reference as though set forth in full hereat. 2. A special election is hereby called to be held on the 4th day of November, 1975, in the territory hereinafter described and proposed to be annexed to the City of Tustin, for the p~rpose of submitting to the qualified electors residing in said territory the question whether or not such territory shall be anne:<~d to, incorporated in, made a part of the City of Tustin, and whether or ~ot the property in said territory shall, after ,~uch annexation, be subject to taxation, equally with the property within the 35 City of Tustin, to pay the entire bonded indebtedness of the City of Tustin outstanding or authorized at the date of the first publication of the Notice of Election enumerated in Exhibit "B" which is attached hereto and incorporated herein by reference as if fully set forth herein. 3. For the purpose of holding said election there shall be one (!) voting precinct comprising all of said territory. Whereas there are no more than 300 persons registered to vote in said precinct, pursuant to Sections 14620.5 and 22032 of the Elections Code of the State of California, there shall be no polling place in the precinct for said election- The City Clerk shall, not less than 29 days prior to election day, mail an application blank for an absent voter ballot to each registered voter, together with a statement than there will be no polling place in the precinct for the election, and if the voter desires to vote at the election, he shall apply for an absent voter ballot not less than seven days before the election or vote at the office of the City Clerk on election day. The City Clerk's office is located - Tustin City Center, Centennial Way at Main Street, Tustin, California, and shall be open between the hou= of 7 o'clock A.M. and 7 o'ciock P.M. for any voter who has not vote:I on an absent voter ballot. 4. Upon the ballots to be used at said election there shall be printed the words: SHALL TERRITORY DESCRIBED AS SYCAMORE-REDHILL ANNEXATIO>~ NO. 85 OF THE CITY OF TUSTIN BE ANNEXED TO THE C~-TY OF TUSTIN, AND THE PROPERTY IN SUCH TERRITORY BE, AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF TUSTIN, TO PAY THE ENTIRE BONDED INDEBTED~<ESS OF THE CITY OF TUSTIN OUTSTA.-'~D!~G OR AUTtiORIZED AT TIlE DATE OF THE FIRST FUBLiCATION OF THE NOTICE OF ELECTION, FOR THE ACQUISITION, CONSTRUCTION OR CON~LETION OF brU~<ICiPAL I.'-fPROVEMENTS? Opposite these words there sha].]. be printed the ~.yords "YES" and and to the ri~%ht of each of these last two words there shall be a voting square. If a=~ elector shall s~amp a cross (x) in the voting square after -2- the printed word "YES", the vote of such elector shall be counted in favor of the annexation of said territory to 'the City of Tustir and if an elector shall stamp a cross (x) in the voting square after the printed word "NO", the vote of such elector shall be counted against such annexation. On all particulars not herein recited said election shall be held in conformity, as near as may be, with the laws of the State of California concerning general elections and with said Annexation Act of 1913. 5. The City Clerk of the City of Tustin, California, shall publish a Notice of said special election as required by the Annexation Act Of 1913, at least once a week for the four (4) weeks prior to the date of the election on November 4, 1975, in the Register, a newspaper of general circulation printed and published outside 'of the City of Tustin and in the territory proposed to be annexed.. 6. That the City Council hereby finds and determines that the enactment of this Ordinance as an emergency, urgency measure is required for the preservation of public health and welfare, and this Ordinance shall go into effect immediately upon adoption 7. The City Clerk of the City of Tustin, California, shall certify to the adoption of this Ordinance and cause the same to be published once in the Tustin News, a newspaper published in the City of Tustin, County of Orange, State of California.
