HomeMy WebLinkAboutORD 656 (1975) ORDINANCE NO. 656 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE ZONING ORDINANCE OF THE CITY OF TUSTIN, RELATIVE TO APPEALS OF DECISIONS OF THE COMMUNITY DEVELOPMENT DIRECTOR The City of Tustin, California, does ordain as follows: The City Council finds and determines: A. The City has established policies ~and criteria for the physical development of the City as related to signs, 'landscaping, and architectural design, with said policies being imD!emented within the discretion and interpretation of the Cor~munitv Development Department. B. To provide assur. ance of due process and protection against arbitrary decisions of delegated authority, the City C. ouncil hereby determines that an appeal process to the Planning Commission and City Council is necessary and desirable in the interest of the public welfare. C. An amendment to the Zoning Ordinance (Ordinance No. 157, as amended) and the Sign Code (Ordinance No. 614, as amended) has been duly considered to assign the duties of the prior existing Development Preview CommiSsion to the Planning Commission. D.That the proposed amendment is the form hereby set forth should be adopted. E. That the proposed amendment is categorically exempt from the requirement of an Environmental Impact Report. Section 5.280 of the Zoning Ordinance of the City of Tustin, and Section 3 D. Article I of the Sign Ordinance (Ordinance No. 614) are hereby amended to read as follows: Appeals Appeal of any decision of the Community Development Director may be made by any person to the Planning Co~aission pursuant to the following procedures: 1. Within seven (7) days of any decision an appeal may be filed in writing with' the Community Development Department stating. the reason for said appeal, accompanied by a fee of $30.00, provided, however, that any appeal filed pursuant to Section 5.280 by the City Council or any me~%ber thereof shall not be subject to the requirement of payment of any fee. 2. The Planning ConLmission shall schedule a hearing of said appeal at a meeting to be held within thirty (30) days of the filing of such appeal or at such other times as may be determined by the Planning Comaission from tmme to time. 3. The decision of the Planning Commission shall be final unless an appeal is filed with the City Council within fifteen (15) calendar days of the date of the action taken by the Planning Commission. Appeals to the City 22 I Council shall be filed under the same procedures as other appeals on the Zoning Ordinance.
