HomeMy WebLinkAboutORD 654 (1975) ORDINANCE NO. 654 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE ZONING ORDINANCE, ORDINANCE NO. 157, AS AMENDED, CREATING THE CLASSIFICATION OF THE COMMERCIAL GENERAL (CG) DISTRICT AND AMENDING THE ZONING MAP FOR PROPERTIES ON FIRST STREET, WESTERLY OF PROSPECT AVENUE The 'City Council of the City of Tustin, California, does ~rdain as follows: Section 1. Section 3 of Ord".nance 157 is amended to add the classification of: Commercial General or "CG" District Section 2. That the following sectiDn or subsections are hereby added to the City of Tustin Municipal Code to read as follows: 4.9 1 "CG" (Co~ercial General) Description and Purpose To provide for and encourage the orderly developmet!~-- h of commercial areas throughout t e city in accorda~.! with the Land Use Element of the General Plan, whi~j will serve the demand for a wide variety of goods and services. .1 Permitted Uses None but the following uses or uses which i~ the opinion of the Planning Commission are similar will be allowed in ~he Commerai~l Gen'e~aI District (CG): .11 All uses authorized in the Professio~a~-"Office. (P~ District. .12 Retail businesses, exemplified by the following list when-- conducted within a building: (1) ~.ntiques and curios (2) Art goods (3) Appliance stores (4) Bakeries (5) Bicycle sales (including repairs) (6) Books and stationary (7) Cei'amics (not including molding - casting or manufacturing - by any process) (8) Clothing (9) Confectionary (10) Department stores /l · ' ll (11) Drug store (including sundries and notions) (12) Dry goods (13) Florist Shops (14) Food Market (15) Hardware (but not including equipment rentals) (16) Household goods and furnishings (17) Jewelry stores (including repair 'and wa tchma k in g ) (18) Leather goods (19) Liquor stores (including "on sales") (20) Musical supplies and instruments (21) News stands (22) Office supplies and equipment (23) Paint and wallpaper (24) Radio and TV stores and service (25) Real estate offices (26) Religious -supplies (27) Shoe stores (28) Sporting goods (but not including boat and motor sales ) (29) Variety store Service businesses, exemplified by the following sales incidental thereto, when conducted within a building (1) Banks & Finance companies (including those providing drive-in service) (2) Barber shops (3) Beauty Parlor ( 4 ) Blueprin ting - (5) Coin-operated dry-cleaning establishments (provided no pressing is done on the premises) (6) Coin-operated self-service laundromats (7) Dry-cleaning and Laundry Agencies (pick-up and delivery ~). (8) Interior Decorator (9) Job Printing (10) Locksmith (11) Photograph Gallery (12) Public Utility Business Offices (~excluding corporation yards) (13) Restaurants (not including drive-ins) (14) Seamstress and/or Millinery Shop (15) Shoe and/or Luggage Repair Shop (16) Studios (17) Tailor Shop ' (18) Telephone Answering Service (19) Travel Agency (20) Typing and Addressing Service .2 Permitted Uses Subject to Use Permit. The following additional uses are permitted in the CG District subject to approval of a Use Permit: ,2~1 Amusement and Recreation Facilities 2.2 Any development in excess of five (5) acres in total parcel size. 2.3 Automobile vehicle sales 2.4 Auto supplies and services -2- 2.5 Bakeries, wholesale 2.6 Billiard Parlors-and~pool Ha~ls 2.7 Bowling Alley 2.8 Building Supplies 2.9 Business School 2.10 Churches, schools, and public places of assembly 2.11 Cleaning and laundry establishments (on-premise) 2.12 Clubs 2.13 Drive-in and take-out establishments for food or services 2.14 Fraternal Organizations and Lodge 2.15 Health Clubs, massage parlors, and gymnasiums 2.16 Manufacturing, fabrication, distribution facilities occupying less than 50% of floor area and less than 50% of operations 2.17 Mortuaries 2.18 Motels and Hotels 2.19 Nursery Schools 2.20 Outd~r"markets and sales establishments 2.21 Pet shops 2.22 Rest Homes and Convalescent Hospital Facilities 2.23 Service Stations 2.24 Small animal hospitals or clinics 2.25 Social Halls 2.26 Theatres 2.27 Veterinarian services ' 3 Restricted Uses .31 No warehousing or storage other than accessory storage of commodities sold at retail on the premises shall be permitted except as otherwise provided by this section. .32 No manufacturing, processing or treatment of products other than that which is clearl~ indicated to the retail business conducted on the premises shall be permitted. ~ ~ .33 Not more than five (5) persons shall be engaged on the premises in the incidental manufacturing, processing or treatment of products as permitted herein. .34 None of the above listed uses or any other use determined to be permitte~ shall maintain any out- side storage or work. areas. Nor shall there be any storage of any commercial vehicle normally associated with any of the permitted uses. Pro- vided further that any use permitted herein re- quiring such vehicle shall provide a permanent parking and/or loading sp~ce for such vehicle. .35 No residential use shall be permitted in any structure used for commercial purposes, except for caretaker facilities incidental to the permitted use. -3- '-'.41 Limitations and Exceptions Use of PrOperties Zoned Other Than "CG," for General ~6'mm~c~l 'Pu~6oses. Where property classified for "CG" uses has a depth of two hundred (200) feet or less, as measured at right angles from the street fro~tage indicated as business frontage, additional adjoining .property may-be used for commercial purposes when such adjoining property fronts upon the side street, and the side of such adjoining property abuts upon the property classified for "CG" purposes. The additional property so used shall be a part of and an extension of the particular use occupying the corner property. The use of subject property shall require approval of a Conditional Use Permit. .42 Exception to Height Limitations Height limitations of this section may be exceeded for those structures removed more than 200 feet from any single-family residential zone, subject to approval of a Conditional Use Permit. .~.--..43 Exception toL. Setback Requirements Exceptions to the general setback requirements of this section shall be made only in conformance with the development criteria of specific. plans as approved by the City Council. .50 Site Development Standards .51 Maximum Structural Height The maximum height of any building or structure shall not exceed three storiesnor thirty-f~ve (35) feet; provided, however, that penthouse or roof structures for the housing of elevators, stai!~ays, tanks, ventilating fans or similar equipment required to operate and maintain the buildings, and fire or parapet walls, skylights, towers, roof signs, flagpoles, chimneys, smoke- stacks, wireless masts or similar structures may exceed such. height limit; provided no space above such height limit shall be allowed for the purpose of providin9 additional floor space. .52 Structural Setbacks .521 Front Yard A minimum of ten (10) feet front structural setback shall be required from the ultimate street right of way line. .521 Side Yard X"~mum of ten (10) feet side yard structural setback shall be required from the ultimate street right of way line or adjoining residential lot. OtheI~ise, no side yard setback shall be required. -4- \14 ' .522 Rear Yard Where any commercially zoned property rears upon the rear or side yard of property classified for single-family residential purposes, there shall be a rear yard of not less than fifteen (15) feet. Where the commercial property rears upon an alley or private drive easement, there shall be a rear yard setback of not less than five (5) feet. Otherwise, no rear yard need be provided. .53 Parking Requirements Desian -531'~ Parking areas shall be designed and landscaped · in accordance with the criteria contained in City Council Resolution No. 73-35 (Guidelines for Planning, Zoning & Development). .532 Off-Street Parking Requirements ~etail Stores: 1 parking space for each 200 sq. ft, of total floor area used for retail sales or storage, excluding equipment rooms, elevators, and stairways. Banks and Office Buildings: 1 parking space for ~ach 300 square feet of gross floor area, calculated to be all floor space under roof. Restaurants: 1 parking space for each 3 seats-- plus 1 space for each 300 square feet used for' kitchen, storage, or food preparation. Assembly Areas: 1 parking space for each 3 seats, based upon total occupancy load of the assembly area, plus 1 space per each 300 square feet of service area. Medical-Dental Offices and Clinics: 6 parking. spaces per ea.ch 1,000-~q.ft.,-O~ poStion %hereof, gro. ss floor. area, calcu!ate~ to De all floor space under roof. Combined Sales and Assembly or Proce~sing ~aci!ities: 1 parking space for each 200 sq.ft. of total retail sales floor area plus 1 parking space for each 500 square feet of floor a~ea for service, storage or processing. Service Stations: 6 spaces per service station ~ite,~in addition to inside bays. Hotels and Hotels': t space for each guest unit ~lus accommodations for resident manager and auxiliary facilities. Unclassified Uses: Authorized but unctassifie~ uses shall provide parking accommodations equivalent to the standards f6r comparable uses. -5- 15/'j .54 LOt Coverage Commercial sites may have 100% lot coverage less that required for landscaping and parking requirements. .55 Lot Size (Building Site) A building site shall occupy not less than a 3,000 square feet parcel. .56 Refuse Storage Requirements Refuse storage areas shall conform to the standards and criteria contained in the Guidelines for Pla~nning, Zoning and Development, as adopted by the City Council. .57 Street Dedication Highway dedication and improvements shall be as required by.- Ordinance No. 293. Section 3. The Zoning Map of the City of Tustin is hereby amended '- in accordance with Exhibit "A" , with said properties declared to be subject to the regulations pertaining to such designated districts. Section 4. Properties designated by Exhibit' "A" within the "CG-PUD" District, are subject to the requirement for a Use Permit pursuant to the applicable procedures of Planned Unit Developments. .56 Suffix (Supplemental Provisions) Properties designated "CG-PUD" =on the Zoning Map shall require the submission and approval of design plans for a Use Permit pursuant to the requirements fo~ Planned Unit Developments.
