HomeMy WebLinkAboutORD 636 (1974) ORDINANCE NO. 636 ~ AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA AMENDING THE TUSTIN CITY CODE RELATIVE TO BUILD- ~ ING REGULATIONS, AND ADOPTING THE 1973 UNIFORM BUILDING CODE, 1973 UNIFORM MECHANICAL CODE AND ~ , 1973 UNIFORM PLUMBING CODE. 4 The City Council of the City of Tustin, California does 5 hereby ordain that the Tustin City Code is hereby amended as 6 follows: 7 1. Article Ii,~"Building Code", of Chapter 6 of the 8 Tustin City Code, is hereby amended to read as follows': 9 .Article II-Building Code Sec. 6-3 Adopted 11 For the purpose of prescribing regulations for ~he erection, 12 construction, enlargement, alteration, repair, moving removal, conversion, demolition, occupancy, equipment, use, height and 15 area of building structures, all of the provisions of the 1973 edition of the Uniform Building Code, adopted and published by the 1~ International Conference of Building Officials, including the appendix thereto, and excepting Chapters 38, 51 and 57 thereof, 15 of which not less than three (3) copies have been and now are filed in the office of the City Clerk of the City of Tustin, are 16 hereby adopted and incorporated herein as fully as though.set forth in full herein, save and except such portions as are here- ' 17 inafter deleted, modified or amended. 18 Sec. 6-3.1 Amendments, Additions and Deletions The 1973' edition of the Uniform Building Code is hereby amended as follows: ~0 (a) Section 205 The second paragraph of Section 205 is hereby deleted, and the following paragraph substituted therefor: Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of arseperate offense for each and every day or portion thereof during which any viola- tion of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable as for a violation of the Code of the City of Tustin. (b) Section 303 / · 28 Section 303 is .hereby amended to read 'as follows: ' /. ~9 Section 303 tab 'BU'ILDkNG '~ERMk'T 'FEES-. 50 A fee for each building permit shall be paid to the Building Official as set forth by resolution of the City Council. 51 The determination of value or valuation under any of 5~ the provisions of this Code shall be made by the Building Official. The valuation to be used in computing the permit and plan-check fee shall be the total value of all construction work for which the permit is issued, as well as well as all finish work, painting, ing, electrical, plumbing, heating, air conditioning, elevators, fire-extinguishing systems and any Other permanent work or permanent equipment. ~ Where work for which a permit is required by this Code is started or proceeded with prior to obtaining said permit, the fees specified by said Resolution'shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this Code"in the execution of the work nor from any other penalties prescribed herein. (b) PLAN-~HECKING FEES. (c) EXPIRATION OF PLAN CHECK. Applications for which no permit is issued within 180 days following the date of appli- cation shall expire by limitation and plans submitted for checking may thereafter be returned to the applicant or destroyed by the Building Official. The Building Official may extend the time for action by the applicant for a period not exceeding 180 days upon written request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken. In order to renew action on an application after expiration the applicant shall resubmit plans and pay a new plan-check fee. (d) REINSPECTION FEE. The fee for. each reinspection shall be $10.00. (c) Section ~807 Section 1807 is h~reby deleted in its entirety. (d) Section 1907 Section 1907 is hereby deleted in its entirety. 2. Article IV of Chapter 6 of the Tustin City C6de is 'hereby amended to read as followS: Article IV - Mechanical Code Sec. 605 Adopted For the purpose of requiring permits for and providing rules and regulations for the protection of the public health and safety, and establishing minimum regulations for the installation, alteration,'design, construction, quality of materials, location, operation and"maintenance of heating, ventilating, comfort cooling · refrigeration systems, incinerators, and other miscellaneous heat- producing appliances, and the inspection thereof, all of the pro- visions of that certain Code, known as the "Uniform Building Code, volume 2", also known as the "1973 Uniform Mechanical Code", including the appendix thereto, of which not l~ss.that three (3) copies have'been and now are filed in the office of the City Clerk of the City of Tustin, are hereby adopted and incorporated herein, as fully as though set forth herein, save and except such portions as are hereinafter deleted, modified or amended. 4 Sec. 6-5.1 Amendments, Additions and Deletions' 5 The 197'3 Uniform Mechanical '~ode is hereby amended as follows: Section 202 Amend second paragraph of Section 202 to ~ead as 8 follows: 9 Any person, firm, or corporation violating any of the 10 provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violatio~ 11 of any provisions of this Code is committed, continued, or 'permitted and upon conviction of any such violation such person shall be 12 punishable as for a violation of the Code of the City of Tustin. 15 (b) Section 304 14 Section 304 is hereby amended to read as follows: 15 Section 304 Mechanical Permit Fees. A fee for each mechanical permit shall be paid to the Building Official as set 16 forth by resolution of the City Council. 17 3. Article V of Chapter 6 of the Tustin'~ity Code is 18 hereby amended to read as follows: ~9 Article V - Plumbing Code Z0 Sec. 6-6 Adopted For the purpose of requiring permits and providing rules and ~ regulations for the protection of the public health and safety, and establishing minimum regulations for the installation, alter- ~5 ation, design, construction, quality of materials, location, operation and maintenance of plumbing, piping, drainage systems ~4 and private sewer and ~isposal systems and the inspection thereof in the City of Tustin,' all of the provisions of that certain code, ~ ~5 known as the 1973 edition of the Uniform Plumbing Code, including the appendix thereto, of which ~0t less than three (3) copies have. been and are now filed in the office of the City Clerk of the City ~6 of Tustin, are hereby adopted and incorporated herein, save and 27 except such portions as are~hereinaf~e~d~let~di~mod~ied±6r~-_r~ amended. ! ~8 Sec. 6.6.1 Amendments, Additions and DeletiOns ~9 .The 1973 edltion of the Uniform Plumbing Code iS hereby amended as follows: 50 51 (a) Section 323 5~ Section 323 is hereby a~ded to Chapter 3 to read as follows: Section 323 Fees. A fee for each Plumbing Permit shall'be p~id to the Building Official as set forth by resolution of the City Council. ~.. 8 ' (b) Section 324 4 Section 324 is hereby afided to Chapter 3 to read as follows: Section 324 Penalties. Any person, firm, or corpora- 6 tion violating any of the provisions of this code shall be deemed guilty of a misdeameanor and each such person shall be deemed 7 guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of 8 this code is committed, continued, or permitted, and upon conviction of any such violation such person shall be punishable 9 as for a violation of the Code of the City of Tustin. 10 Any person, firm or corporation violating any of the provisions of this Code shall be deemed guilty of a separate 11 offense for each and every day or portion thereof during which any violation of any provisions of this Code is committed, 12 continued, or permitted, and upon conviction of any such violation such person shall be punishable as for a violation of the Code of the City of Tustin. 14 4. The City Clerk shall certify to the passage of this Ordinance, and shall cause the same to be published once within 15 fifteen (15) days after its adoption, in the Tustin News, a newspaper of general circulation, printed, published and circulatec 16 in said City, and immediately upon and after its passage it shall take effect and be in full force.
