For the purpose of this chapter, the i~ following terms shall have meanings herein given to them. ~ "Taxicab" means and includes every motor vehicle used in 5 the business of carrying passengers for hire, and the destination and route of which are under the control of the passenger or 4 passengers being carried therein. 5 The term "Owner" shall mean and include eQery person, firm, or corporation owning, controlling or leasing any taxicab. 6 The'term "driver" shall mean and include every person in ? actual charge and control of any taxicab as the driver thereof. 8 The term"taxicab s~and" shall mean-and include a portion of the street designated by the License and Permit Board of the 9 City of Tustin for the use of taxicabs while waiting for employment 10 21.020 Taxicabs and taxicab stand -- Permit required. It shall be unlawful in the City of Tustin for any owner to operate, 11 or cause to be operated, any taxicab owned or controlled by such owner in the business of carrying passengers for hire, or 12 to maintain any taxicab stand, unless such owner has a permit so to do as herein provided. 13 21.030 Taxicabs and taxicab stand -- ~pplication for 14 permit. Any owner desiring to obtain the permit required by Section 21.020 hereof shall make application therefor to the i5 License and Permit Board. Each such application shall be accompanies by a bond or policy of insurance and permit fee as 16 are hereinafter provided for, shall be in writing, and shall set forth the following: (a) The name, age, business and residence addresses i8' of applicant, if a natural person; or if a corporation, its name, date and place of incorporation, address of its principal 19 place of business, and the names of its principal officers, together with their respective residence addresses; or if a 20 partnership, association or unincorporated company~ the names of the partners or of the persons comprising such association Zi cr company, and the business and residence of each partner or person. (b) A description of'each taxicab which the applicant 2~ proposes to use, t]~e name of the manufacturer, engine and serial numbers, an.l state license number thereof. (c) The name~ ',7!ncC'~ram or insignia proposed to be 25 used on such taxica,.~ or 'taxicabs. 26 (d) The schedule of rates of fare proposed to be charged for carrying passengers in such taxicab or taxicabs. (e) The street number ~nd exac~ location of the 28 place or places where the applicant proposes to stand each taxicab. 29 /// 3! / -21 (f) If the applicant desires a taxicab stand upon a public highway or street within the City of Tustin, he shall so state in his application, and shall set forth the names and re- spective addresses of all lessees,. sublessees and owners in actual or constructive possession of the ground floor of any building or parcel of real property contiguous co that portion of highway or street where such taxicab stand is proposed to be located; the applicant shall also accompany said application with the written consent of all of sa.id lessees, sublessees and owners of said building or parcel of real property to the location of such taxicab ,at the proposed location. The signatures of such lessees, sublessees and owners shall be acknowledged .before a duly corn- miss ioned notary .public. (g) ' A sworn financial statemen't of the applicant pre- pared by a certified public accountant with audit if an individual or corporation or, if an association or partnership, a sworn financial statement of each of the persons financially interested in the business; a statement as tO whether or not the applicant or any of the persons herein mentioned has any unpaid judgments standing ~Tainst him, and if So, the nature of the transaction or acts 9'i~Ting rise to such judgments, the court in which the same were rendered, and the amount of each unpaid or unbonded judgment; a statement of any bankruptcies either personal or business of the applicant including the nu~er, court and the date of discharge. (h) The experience of the applicant, both in the City of Tustin and elsewhere, in the operation of a~ulances, motorbuses, or taxicabs or other colon carriers for the transportation of passengers. (i) ~e facts which applicant believes tend to establish that public convenience and necessity require the granting of a certificate. (j) ~ether or not the applicant for such certificate of public convenience and necessity, any of the meters, officers, or directors of applicant thereof has, at any time within five (5) years prior to the date of such application been arrested, con- rioted or pleaded guilty to any crime, felony or misdemeanor, and, if so, the date nature of the offense or arrest and the court in which such charge was made, conviction was obtained or plea of guilty was ~jtered, and the disposition of the case and imposition of sentence and its terms. (k) Whether there are any liens, mortgages, or other sncumhrances, including but not limited to conditional sales contracts, on such taxicabs and~ if so, the amount and character thereof and tlqe name of the holder thereof. (1) The applicant shall furnish such additional infor- mation as the License and Permit Board may require. (m) The' applicant or-apolic~nts~sh~ll appear personally .~efore the License and Permit Board if he, she or they be indivi- duals, and the officers of such a~pplicant shall so appear per- sonally if-the applicant be a corporation. 1 21.040 Taxicabs and stands--Criteria for issuance of permit--Issuance and approval of rates. Upon receipt of any 2 such application referred to in Section 21.030 hereof, the License and Permit Board shall make investigation, and may there- 5 after grant the same if it s~.~a!l find: 4 (a) That t?.2 bond or policy of insurance hereinafter required has been furnished,. and that the 'sam~ is in the form 5 required, and that the surety thereon is approved by the Licens~ and Permit Board; and 6 (b) That each taxicab described therein is adequate 7 and safe for the 'purpose for which it is to be used, and is equipped as herein required; and (c) That the applicant is of good moral character, has 9 -complied with all the terms and conditions of this chapter and is competent to operate a taxicab business; and !0 (d) That the public-convenience or n~cessity requir.e tl the operation of such taxicab or taxicabs within the City of Tustin; and (e) That the name, monogram or insignia to be used upon 15 such taxicab or taxicabs is not in conflict with and does not imitate any other name, monogram or insignia used by any other 14 person, firm or corporation heretofore licensed by said License and Permit Board, in such manner as to be misleading or tend to !5 deceive or defraud the public; and i6 (f) In case of an application for a taxicab stand, that the location of said stand is such that it will not congest or 17 interfere with travel on any public highway or street, and is n~ prohibited by any ordinance of the City of Tustin. i8 (g) That the schedule of rates of fare proposed to be 19 charged are fair and reasonable. 20 The granting of said permit shall constitute the approval of the LiCense and Permit Board of the proposed schedule of rates. 21.050 Taxicabs and stands--Revocation of permit--Criteria-, 22 Procedure. Any permit granted pursuant to the provisions of this chapter may be revoked by the License and Permit Board for vioL 25 !ation of the provisions of this chapter, or of any other ordinanc of the City of Tustin, or of af-y law of the State of California, 24 or for the existence of any state of facts which would have been a good reason for denying such permit when applied for, whether 25 such state of facts existed at the time application was made for ..... - ..... such permit or not. No permit shall be revoked except in the following manner: (a) The License and Permit Board shall fix a time and '~' 28 place for the hearing of the issue of the revocation of such Dermi and shall cause there to be served upon the permittee notice of 29 such time and place of hearing, together with a statement of charges whfch are the basis for such hearing, at least ten (I0) S0 days before the... time fixed for such hearing. (b) Service of such notice and statement may be made upon the permittee personally or may serve the same upon permittee by delivering the same by Registered United States Mail, postage prepaid, to permittee, at the address given in his application for permit. (c) Such hearing shall be public and permittee shall have th~ right to produce witnesses on his own behalf and to be represented by a~ attorney. (d) The findings and decisio~ of the License and Permit Board upon such hearing shall be final and conclusive. 21.060 Taxicabs and stands--Permit fee~ A permit fee shall required for every person, firm or corporation requesting a permit under this chapter. Such permit fee shall be in addition to any business license which'permittee shall be required to pay under the provisions of Section 21.100 hereof. Permit fees for Taxicabs and taxicab stands shall be~&s~ e~tablished.b~ ~sol~tion of'-the City Council. 21.070 Taxicabs and stands--Issuance of permit after revocation. In the event that the permit of any person, firm or corporation has been revoked, such person, firm or corporation shall not be granted a permit for a period of six months after such revocation. 21.080 Taxicabs and stands--Licenses and permits not transferable. No license or permit, granted pursuant to the pro- visions of this chapter, may be transferred to any other person, persons, company, partnership, joint venture or corporation. 21.090 Taxicabs--Bond or insurance required"Terms'- Council may require replacement. It shall be unlawful for any owner or driver of a taxicab to drive or operate a taxicab within the City of Tustin and no permit for the operation thereof shall be granted, unless there is on file with the City Clerk of the City of Tustin and in full force and effect at all times while such taxicab is being operated, either: '(a) A bond of the owner of such taxicab, approved by the License and Permit Board and the City Attorney with a solvent and responsible surety company authorized to do business in the state of California and approved by the City Attorney, as surety in the sum of Three Hundred Thousand Dollars, conditioned that sai'd owner will play all loss or damage that may result to persons i(including passengers in said taxicab) or property from the negligent o~eratiOn of s~c~ taxicab or from t~e violation of the provisions .of this chapter o~ of .any other ordin-ance of the City of Tustin or any law of the State of California. Recovery on said bond shall be limited to One Hundred Thousand Dollars for the injury or death of one person, and to Three Hundred Thousand Dollars for the injury or death of two or more persons in the same accident, and to Fifty Thousand Dollar~ for injury or de- struction of property. Such bond shall run to the City of Tustin and shall inure~ by its terms to the benefit to any and all persons suffering loss or damage covered hereby, and shall provide that. suit may be brought thereon in any court of competent jurisdict by any such' person. Said bond shall provide that there shall be continuing liability thereon, notwithstanding any recovery -5- 1 If at al~y time in the judgment of the City Council, said bond is not sufficient for any reason, the License and Permit Board may ~ require such owner to replace said bond with another bond or a policy of insurance as hereinafter provided, satisfactory to the 5 License and Permit Board, and in default thereof, may revoke such owner's permits and licenses; or 4 (b) A po].icy of insurance approved by the License and S Permit Board in ~, solvent and res ~onsible company ~uthorized to do business in the State of.'California insuring the owner of 6 such taxicab against loss by reason of injury or damage that result to persons (including passengers in said taxicab) or V property from the negligent operation of such taxicab. Said policy may be limited to One HUndred Thousand Dollars for the 8 injury or death of one person, and Three Hundred Thousand Dollars for the injury or death of two or more .persons in the same acciden 9 and to Fifty Thousand Dollars for injury or destruction of propert. Said .policy of insurance shall guarantee the payment to any and al i0 such persons suffering injury or damage to person or property , and to those entitled to recover for ~he death of an5, such person, !t of any final judgment rendered against such owner, within the limits above mentioned, irrespective of the financial condition or 12 any actions or omissions of such owner, and shall inure to the benefit of such persons and those entitled to recover for the deat' !5 of any such person. If, at any time, such policy of insurance shall be cancelled by the company issuing the same or the authorit' 1~ of such company to do business in the State of California shall be revoked, or in the judgment of the License and Permit Board said 15 company is insolvent, the License and Permit Board shall require said owner to replace such policy with another policy or bond as 16 above provided, satisfactory to the License and Permit Board and default thereof may revoke such owner's permit and license. 21.100 Taxicabs--License required--License not to issue i8 before permit obtained. Every person, firm or corporation opera' ting a taxicab or taxicabs within the City Of Tustin shall obta~ i9 a business license therefor and pay to the City of Tustin the business license fee provided for by ordinance or ordinances of 20 the City of Tustin. Such business license shall be issued in the same manner provided by ordinance of the City of Tustin for the 21 issuance Of other business licenses, but shall no{ be issued for the use of such taxicab or taxicabs until. a permit for the use 2~ of such taxicab or taxicabs has been obtained as provided in th js chapter. 21.130 Taxicabs--Former permittee not to drive taxicab for 2.~ six months after revocation. In the event that the taxicab oermit of any person has been revoked by the .License and Permit Board 25 such person shall not own~ control, operate or drive any taxicab within the City of Tustin for a period of six months after the 26 revocation of such permit. 27 21.140 Taxicabs--Drivers' hours. It shall be unlawful for any person to drive or operate any taxicab, or to cause any .person 28 to drive or operate any taxicab, within the City of Tustin, for ~ r~ore than ~wol~-e consecutive hourS, or for more than twelve hours i~ spread over a to, of sixteen consecutive hours, or to operate 29 ~! drive any tax%cab within the City of Tustin after having been or . ~0 on duty, ei. ther operating or driving a taxicab, or in any office' or garage of the holder of any taxicab perm.it hereunder, or at ~1 any taxicab stand, or any conEoination of such acts, for more tha. twelve consecutive hours spread over a total of sixteen '(16) con- ~2 secutive hours. No person shal 1 drive or operate any taxicab, or -6- ! cause any person to drive or operate any taxicab within the City of ~k~stin unless such driver has had at least eight (8) consecutiv ~ hours rest, while not on duty, within the last preceding twenty- four (24) hours, during which eight (8) consecutive hours he shal 5 have perforn',ed no acts or du'cies in connection with such taxicab business. 4 21. 150 Taxicabs--A!lowing person to drive for excessive ~" ~ hours prohibited. It shall.'be unlawful for the holder of any taxicab permit, issued pursuant to the provisions of this chapter, 6 to cause, or permit any person to violate any of the provisions' of Section 21. 140 hereof. ? 21.160 Taxicabs--Change of rates. Should an owner of a 8 taxicab desire to change his schedule of rates, he shall make written application to the License and Permit Board so to do. 9 Upon receiving such application the License and Permit Board shall conduct a public hearing upon such application, and shall give 10 the applicant at least 10 days written notice 'of the time and place of such hearing. Upon such hearing the License and Permit 1i Board shall determine whether' such rates shall be changed, and shall have the right to deny such application, or may make such i2 change as 'it determines the facts warrant. The decision of the License and Permit Board upon such hearing shall be final and i3 conclusive. 1~ 21. 170 Taxicabs--Rate charged must conform to rate schedule. It shall be unlawful for any owner or driver of any taxicab witlnin go the City of Tustin to charge any rate different from the schedule of rates on file and approved by ti%e License and Permit Board. 16 21.180 Taxicabs--Refusal to pay legal fare prohibited. it --- i~ shall be unlawful for any person to refuse to pay the legal fare for any taxicab licensed under this chapter, after having hired 18 the same, and any person who'shall hire any taxicab so licensed with the intent to defraud the person from whom it is hired shall !9 be punishable as .provided by the Code. 20 21.190 Taxicabs--Use of most direct route required. The driver of-a taxicab shall carry passengers by the most direct 21 route possible that will carry such passengers safely and ex- peditiously to their destination. 21.200 Taxicabk--Stopping and oarking. It shall be unlawful 23 for the owner or driver of any taxicab to park or stand the same upon any public highway or street in the City of Tustin, other 24 than at a taxicab stand for which suci~ owner has a permit, for any period of time longer than is necessary to discharge passengersI 25 occ.upying said taxicab; or receive passenqers then waiting for such taxicab; provided further, tl~at a taxicab shall in no Case · 26 be parked for a period lon.q-er th~n five minutes on any .public high~:ay or street within _',-~2 City of 2'uszin, except in a taxicab 2~ stand for which such owner h~s a .pe. rmizo. - 28 21.210 TaXicabs--Use of additional-vehicles. In the event that any holder of a L~ermit issued pursuant to the provisions of --- 29 ~his chapter should desire to operate-any taxicabs in addition to those specified in his p~rmit, he shall app'!y to the Chief of D0 Police for i~er:',it so to do. Such application shall be accomDP. nied by all pertinent infor~j. ation and data req.uired to be furnished by 31 Section 21.030 hereof, and shall be accompaniea by a b6nd or : -7- ! policy of insurance of the type required by Section 21,090 hereof. In the event the Chief of Police finds that such 2 taxicab fulfills the requirements set forth in this chapter, he sahll grant a permit, permitting such addition. The License 3 and Permit Board shall have the power to review any action taken by the Chief of Police in denying any application for a 4 permit and sh~ll have the power to revoke a permit granted by the Chief of Police when, in the opinion of the License and 5 Permit Board, such ~ction on.its part is in the public interest. 6 The applicant may appeal the ruling of the Chief of Police by applicatio~ to the License and Permit Board. The findings ~ and decision of the License and P~rmit Board upon such appeal shall be final. 8 21.220 Taxicabs--Replacement of vehicles. In the event 9 that any holder of a.permit issued pursuant to the provisions of this chapter should desire to replace any taxicab, for which 10 he has a permit, by another taxicab, he shall apply to the Chief of Police for permit so to do. Such application shall be lli~ accompanied by all pertinent information and data required to be furnised by Section 21.030 hereof, and shall be accompanied 12 by a bond or policy of insurance of the type required by Section 21.090 hereof. In the event the Chief of Police finds that I~ such taxicab fulfills the requirements set forth in this chapter he shall grant a permit, permitting such replacement. The 14 License and Permit Board of the City of Tustin shall have the power ~o review any action taken by the Chief. of Police in 15 denying any application for a permit and shall have the power to revoke a permit granted by the Chief of Police when, in the 16 opinion of the License and Permit Board, such action on its part is in the public interest. The applicant may appeal the ruling of the Chief of Police i~ by application to the License and Permit Board. The flndings and decision of the License and Permit Board upon such appeal 19 shall be final. 20 21,230 Taxicabs--Name of owner to be on door. Every taxicab shall have painted or affixed upon the exterior part of ~i a door on each side of the same, the name of the owner or the fictitious name under which the owner operates, together with 22 the telephone number of said owner, in distinct letters not less than two and one-half inches in height and not less than 23 five-sixteenths of an inch stroke. 24 21.240 Taxicabs--Change of name, monogram,'or insignia. it shall be unlawful for any person, firm or corporation to 25 change its name, monogram, or insignia without first making application to the License and Permit Board for a new taxicab 26 permit and the granting of such permit as in zhis chapter provided. 21.250 Taxicabs--Operation with defective or unsanitary 28 equipment prohibitea--Inspection. It shall be unlawful for any owr'~r to drive, or to cause ~o be driven or operated any 29 i; taklcaib within the City of Tustin while the same or any of the equipx~ent uEed hereon or therewith shall be in a defective, ~0 ~i uns.~fe ~.if unsanitary condition. Every taxicab shall at all ,~imes be subject to the insoection .of any police officer or health inspector of the City. I 21.260 Mechanical condition--Inspection. The police department may examine and inspect every vehicle regulated By 2 this chapter to determine that its equipment, including the lights, brakes, tires and mechanical parts are in a good state 5 of repair, free from obvious defects; and to determine that such vehicle will not be dangerously defective in operation. 4 The police department may inspect other parts of the vehicle. ~.~ The Chief of Police shall prescribe the dates and times for 5 inspection of taxicabs and it shall be the aut~ and responsibility of each permittee to see that all of his taxicabs are presented 6 for inspection at the time and date so specified. The police derpartment may make periodic inspections for the purpose set forth in this section. 21.270 Same--Enforcement. No person. shall operate any 9 vehicle for hire designated in the certificate of public convenienc~ and necessity issued to him hereunder when it is not in a safe I0 operating condition, or permit a driver to operate a vehicle in a manner contrary to the provisions of this chapter, and the !i Chief of Police shall have the power to revoke or suspend a holder's certificate of public convenience and necessity in the !~ event he is found guilty of a violation hereof. 1S 21. 280 Same--Necessary equipment. (1) Every vehicle licensed hereunder shall at all times carry t.~e following equipment, unless otherwise waived for good- 15 reason by the Chief of Police: 16 ~I (a) A spare tire, capable of being 'used on any of the wheels of the vehicle. !~-~(b) A set of 'tools for changing tires. (c) Three (3) operable safety flares. i9 (2) In addition to the foregoing equipment it shall be mandatory that all vehicles have the following: (a) Two (2) independently acting braking systems, either one of which will be capable of stopping the vehicle without load at a distance of thirty-seven (37) feet when operating on a level, dry, asphalt street at a speed of twenty (20) miles per hour. 2~i (b) All glass in windshield, windows and doors of safety or shatterproof glass. 25 (c) Suck other equipment and systems as may be. 26 required byethe Vehicle Code or other statutes of the State of California. 27 ~-~, ~[ 21.290'Stands--Permit to designate kocatioH--Painting of ~o ~! curT--., The License and Permit Board shall designate in any permit granted by it uhe exact location of the taxicab stand; 29 ~such pc:rmi~ shall also s~ Lcify the' exact nunSbet of feet and location of any parking of stand space reserved for such taxicab ~' =~ stand, -. ~ whic~ reserved space may at any time be changed, diminished or increased by the License and Per:~%it Board. No person, firm or corporation shall park any vehicle in any taxicab stand except a taxicab permitted so and ~rmit Board to do by permit granted by the License ~ 21.340 Stands--Revocation of permit for failure to usa. In the event that any parson, firm or corporation holding permit to operate and maintain a taxicab stand, should fail for a periad of two consecutive weeks to use such taxicab stand for his taxicab or taxicabs, the License and Permit Board may revoke such taxicab stand permit, after a hearing as provided in Section 21.050 hereof. 21.350 Driver's permit 'required- It is unlawful for any driver to operate any taxicab within the City of Tustin unless ch~r~ exists a valid ~ermit so to do obtained in compliance with the sections provided herein-. The application must be verified by'the applicant and endorsed by such employer. The willful statement or furnishing of false information upon said application is grounds for denial of said permit as provided for herein. 21.370 Examination and issuance of driver's permit. Upon application for a driver's permit and before it shall be issued, '.LXe applicant shall be fingerprinted and a record thereof filed in the Police Department. Applicant shall file with said application two photographs, provided by the applicant, one to be filed with the application and one to be permanently attached to the driver's permit when issued. No permanent license shall be granted for a period of two weeks subsequent to the date of said application; however, the Chief of Police is hereby empowered to issue a temporary driver's permit. The fee of five dollars shall be retained for the driver's permit, if granted, and for :,cost of examination if not ~ranted. The driver's permit shall ~, be posted in a place conspicuous from the passenger compartment !7~!of the taxicab while said driver operates same. It is the _l!respo~sibility of the cab company to provide and place a holder !Si~for said permit. i9!M 21.380 Denial--Termination--Transfer. The Chief of ![Poiicemay deny the said aDD!ication or having issued the 20~-permit, revoke or suspend ~e same if the Chief of Police shall !i determine ~hat the applicant or taxicab driver is of bad moral character or has willfully faisified said application for uilt of driver's permit or is g y violation of any of the prc-'-'=sions of this chapter or o~ ~ny lawful regulation promulgated pursuant thereto or has been convicted of any offense involving moral turpitude. For tile purposes of this section moral turpitude is !] everything done contrary to justice, honesty, modesty, or good :i morals. Any drAver's permit granted pursuant tc the provisions of this chapter may be revoked or suspended in accordance with the applicable provisions of this chapter. -1~- 1 21.400 Each permittee shall maintain full, coml~lete, and accur.ote records in its offices at all times which show in a 2 clear manner the hours and dates each taxicab has been in operation, the hours and dates each operator of a taxicab has 5 operated a taxicab and which taxica'b he has opera heal, un.e hours and dates each employee of the permittee has worked and at what ~ activity. Such records shall be kept in the principal office of the permittee and skall be produced and made available for 5 immediate inspection to any member of the PoliCe Department of the City of Tustin upon demand. 6 Each" permittee ~hall cause to be delivered to the Police ~ Department of the .CLay of Tustin on or before the tenth (10th) day of each month a complete and accurate list of the persons 8 ~,'ho have operated the permittee's taxicabs during the preceding month. 9 21.410 Permittees holding valid taxicab permits on the -I0 ~ date this ordinance becomes effective shall not be required to , submit a new application for permit unless the License and ~ Permit iL..?ard deteff'--!nes that t~e public health, safety and !i 1 ~ conveni~,ce requi~ such a new application.
