HomeMy WebLinkAboutORD 611 (1974) ORDINANCE NO. 611 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, REZONING PROPERTY ON APPLICATION NC~ ZC 73-6 OF THE IRVINE COMPANY _~ The City of Tustin, California, does hereby ordain as follows: 1. The City Council hereby finds and determines: a) That a rezoning proceeding was duly initiated by the Planning-Commission on application of the Irvine Company for a zone change from Planned Community (Residential) District to the Planned Community (Industrial) District for the property. bounded by the Santa Ana Freeway, Myford Road, Santa Fe Railroad, and proposed Jamboree Road~ described in Exhibit "A" attached hereto and incorporated herein by this reference as though set forth herein in fut b) That public hearings were duly called, noticed and held on said application by the Planning Commission and bv the City Council of the City of Tustin_. c) That a draft environmental impact report was filed for subject property, hearings duly called~ noticed and held on said draft report and the Environmental Impact Report, as amended was adopted by the City Council. d) That the proposed zoning is in conformance with the Land Use Element of the General Plan and any and all plan elements in conflict are herewith amended in accordance with the precise designations as indicated by the text and diagrams of the Planned Community (Ind- ustrial) Regulations, referred hereby and a part~' hereof as though set forth herein ~n fullo 2. The City Council does hereby rezone the subject property to the Planned Conununity (Industrial) District, subject to the following conditions: a) Development criteria~ processes and uses shall be in accord with the Planned Community District ~egu!ations~ as amended~ to include the diagrams, representations, and commitments as contained in the report of the Irvine Company dated December 5~ 1973, entitled, ~'Irvin~ ~ndustrial Complex, Tustin Conununity Plan.~' b) The following additional conditions, criteria and stipulations as recommended by the Plannj. ng Commission are hereby applied, to be implemented at the discretion of the City Council in conjunction with the a?provai of Tract Maps and incremental plans for th.e subject area~ 1) Walnut Avenue shall be posted at ~ed ~iil Avenue to read as follows: Commercial Vehicles Over 6,000 Ibs. ' PROHIBITED 1 -I 2) NO building permits shall be issued for the area northerly of Walnut Avenue until the Z following street improvements have been made by the property owner, as shown on illustration 8 "A" of the EIR Addendum. 4 ~ a. The construction of the Myford Interchange access road to the industrial complex, with 5 four lane access 'from off-ramp radius. 6 b. The construction of Walnut Avenue from the proposed Jamboree Blvd. to interconnect with ~ Myford Road. 8 c. The construction of Myford Road between "D" Street and Walnut Avenue. 9 3) No building permits shall be issued for the 10 area southerly of Walnut Avenue, with the exception of the parcel designated for neigh- 11 borhood commercial, until the following imp- rovements have been made by the property owner: a. Jamboree Blvd. is constructed south of Walnut 18 Avenue to interconnect with the Moulton Parkway. 14 b. Myford Road is constructed south of Walnut Avenue to interconnect with the Moulton Parkway. c. The construction of flood control facilities ~6 to the satisfaction of the City Engineer to mitigate against the adverse impact of an 1~ intermediate regional flood. 18 4) The Jamboree interchange with the Santa Ana Freeway be constructed prior to the elimination 19 of the present Myford Freeway interchange. 20 5) That new building permits shall not be issued when traffic counts reach ninety (90%) Percent 2I of the projection shown on illustration "A" of the EIR addendum, until the Jamboree inter- ~ change is constructed at the Santa Ana Freeway. 2~ 6) The hours of rail switching operations for rail service to the industrial complex be restricted ~4 to the hours of 9:00 ~,m to 4:00 p,m, 25 7) Any on-site noise generation within the complex be limited to 70 dBA during daytipe hours and 26 65 dBA during nightime hours, as measured at the perimeter of any lot within the complex. 8) The City reserves the right to require improve- 28 ment of the Jamboree Blvd. right-of-way by the Irvine Company or its successors, a, Those areas d~sign~ted by the site development ~0 plan or tract maps for common open space, like trails, and/or Dark areas shat] be ~moroved ~1 by the !rvine Company or its successors. .... 9) Access tO the proposed Industrial Complex shall Z not be provided from proposed Jamboree Blvd., .... e~xcept at-the intersection of Walnut Avenue. 8 10) Construction of an eight (8) foot high berm 4 with full landscaping along Jamboree Road, to include a 46' building setback area.
